In short
This law amends the Damage to Property (Compensation) Act, 1923, to increase compensation payments for property damage by ten percent and outlines how these additional payments will be made. It also addresses financial obligations related to an agreement between the British Government and the Government of the Irish Free State.
What it regulates
- An increase of ten percent to compensation amounts for certain property damage.
- The method of payment for these additional compensation sums, either in money or securities.
- The issuance of securities for additional payments in specific compensation cases.
- The charging of certain sums on the Central Fund to meet obligations to the British Government.
Who it concerns
- Persons entitled to compensation under the Criminal Injuries Acts for injuries to which Part II of the Principal Act applies.
- The Minister for Finance.
- The British Government and the Government of the Irish Free State.
Key points
- A sum equal to one-tenth of the original compensation will be paid in addition to the original amount.
- Sums less than fifty pounds will be paid in money; sums of fifty pounds or more will be paid in securities, or a combination of securities and money if not a multiple of fifty pounds.
- No reinstatement condition will be attached to these additional payments.
- Judges should not consider the provisions of this Act or Article 4 of the Agreement in the Treaty (Confirmation of Amending Agreement) Act, 1925, when determining compensation amounts.
- The Irish Free State will pay the British Government a sum of one hundred and fifty thousand pounds immediately, and an annual sum of two hundred and fifty thousand pounds for sixty years starting in 1926, charged on the Central Fund.
