I mbeagán focal
This law amends and extends existing licensing acts to allow for the licensing of certain premises located in bogs for the sale of intoxicating liquor. It establishes a specific process for granting, renewing, transferring, and varying these licenses.
Cad a rialaíonn sé
- The grant and renewal of "on-licences" for premises in bogs.
- The transfer of these "on-licences" to new individuals.
- The variation of the premises to which an "on-licence" applies within a bog.
- The exclusion of certain provisions of the Intoxicating Liquor Act, 1927, for licenses attached to licensed bog premises.
Cé dó a mbaineann sé
- Individuals seeking to obtain or hold a license for the sale of intoxicating liquor in bog premises.
- The Minister for Industry and Commerce, who approves the grant, renewal, transfer, and variation of these licenses.
- The Revenue Commissioners, who issue and amend the licenses based on the Minister's approval.
Príomhphointí
- An "on-licence" permits the sale of intoxicating liquor for consumption either on or off the premises.
- The Minister for Industry and Commerce must be satisfied that it is "expedient" to grant an "on-licence" for bog premises and that the applicant is a "fit and proper person."
- The Minister issues a certificate of approval, which the Revenue Commissioners then use to grant, renew, or transfer the "on-licence."
- Variations to the licensed premises within a bog, such as extensions or exclusions, also require the Minister's approval and a certificate.
