Statute Law (Restatement) Act, 2002
In short
This law provides for the creation of "restatements," which are single, consolidated texts of existing statutes or statutory instruments, and outlines how these restatements are to be created and used. Its purpose is to make the law more accessible by presenting it in a clear, unified format.
What it regulates
- The process for creating a "restatement" of a statute or statutory instrument.
- What information must or may be included in a restatement, such as annotations and certification dates.
- The legal effect of a restatement, clarifying that it does not change the law itself.
- The procedure for laying restatements and related orders before the Houses of the Oireachtas.
Who it concerns
- The Attorney General, who is responsible for authorizing and certifying restatements.
- The Oireachtas, as restatements and related orders must be laid before both Houses.
Key points
- A restatement is a single text certified by the Attorney General as a statement of the law.
- It may exclude spent, repealed, or surplus provisions.
- A restatement does not have the force of law and does not alter the substance or operation of any provision it relates to.
- A certified restatement is considered prima facie evidence of the law and is judicially noticed.
