In short
This law, the Spanish Trade Agreement Act, 1936, was enacted to implement parts of a trade agreement between the Irish Free State and Spain, specifically concerning the proper labeling of Spanish wines and other liquors.
What it regulates
- The use of specific descriptions for wines and other liquors.
- The conditions under which certain descriptions are considered false trade descriptions.
- The power of the Minister for Industry and Commerce to issue, extend, or revoke orders regarding these descriptions.
- The application of the Merchandise Marks Acts, 1887 to 1931, to these descriptions.
Who it concerns
- Importers and sellers of wine and other liquors in Saorstát Eireann (Irish Free State).
- The Minister for Industry and Commerce.
Key points
- The Minister for Industry and Commerce can declare certain descriptions (like "Sherry," "Malaga," "Rioja") as false trade descriptions if applied to wines or liquors not originating from specific Spanish regions.
- For a description not to be considered false, the wine or liquor must have been imported with a certificate of origin from a competent Spanish authority, confirming its production in the correct Spanish region.
- The Minister can issue "declaratory orders" specifying the descriptions and regions, and these orders can be extended or revoked.
- There was a limited exemption for liquors imported before the Act's passing, lasting for one year from that date.
- The Schedule lists specific descriptions (e.g., Sherry, Malaga, Rioja) and their corresponding Spanish regions (e.g., Xeres, Malaga, Burgos, Soria, Alava, and Logrono).
