Acts Referred to Social Welfare Act, 1950 No. 14 of 1950 Number 14 of 1954. SUPERANNUATION ACT, 1954. AN ACT TO AMEND AND EXTEND THE SUPERANNUATION ACTS, 1834 TO 1947. [13th April, 1954.] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:— Definitions. 1.—In this Act— “the Minister” means the Minister for Finance; “established civil servant” means a civil servant whose service is in a capacity in respect of which a superannuation allowance may be granted. Extension to women of benefits under Superannuation Act, 1909. 2.—(1) In any application of the Superannuation Acts, 1834 to 1947, to a female person who becomes an established civil servant after the commencement of this Act, any provisions of those Acts applicable to her on account of her being a female person shall not apply to her and, in lieu thereof, the corresponding provisions of those Acts applicable to male persons shall apply to her. (2) Subject to regulations made by the Minister, a female person— (a) who was an established civil servant immediately before the commencement of this Act, and (b) who is not a former officer or employee of Cumann an Arachais NaisiĂșnta ar ShlĂĄinte to whom subsection (2) or subsection (3) of section 7 of the Social Welfare Act, 1950 (No. 14 of 1950), applies, may adopt the provisions of this Act. (3) The regulations under subsection (2) of this section may, in particular, make provision with respect to all or any of the following matters: (a) notification by a person of her wish to adopt this Act may be lodged not later than a specified date; (b) a person shall not be entitled to adopt the provisions of this Act unless the Minister decides that she is of sound health; (c) a decision of the Minister that a person is of sound health may be revoked by the Minister at any time if any information furnished by that person is found to be untrue or inaccurate in any particular within her knowledge; (d) where a person is required to undergo medical examination under the regulations she may be required to pay such fee as the Minister may determine in respect of such examination. (4) In any application of the Superannuation Acts, 1834 to 1947, to a person who adopts the provisions of this Act, any provisions of those Acts applicable to her on account of her being a female person shall not apply to her and, in lieu thereof, the corresponding provisions of those Acts applicable to male persons shall apply to her, except that the amount of the additional allowance payable on retirement shall be increased by one-half per cent. in respect of each year of pensionable service which she had completed on the commencement of this Act. Payments and expenses of Minister and sums received in respect of medical examinations. 3.—(1) The payments made and expenses incurred by the Minister in giving effect to this Act and in the administration thereof shall be paid out of moneys provided by the Oireachtas. (2) The sums received by the Minister in respect of medical examinations for the purposes of this Act shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister may direct. Short title and collective citation. 4.—(1) This Act may be cited as the Superannuation Act, 1954. (2) The Superannuation Acts, 1834 to 1947, and this Act may be cited together as the Superannuation Acts, 1834 to 1954.
