In short
This law protects livestock from being worried by dogs on agricultural land and outlines the responsibilities of dog owners and others in preventing such incidents. It establishes offences for dog owners whose dogs worry livestock and provides defences for those who shoot dogs in specific circumstances.
What it regulates
- Offences related to dogs worrying livestock on agricultural land.
- The seizure of dogs found worrying livestock.
- Defences in legal actions for damages when a dog is shot.
- The liability of dog owners and persons in charge of dogs for such incidents.
Who it concerns
- Owners of dogs.
- Persons in charge of dogs.
- Occupiers of agricultural land.
- Owners of livestock (cattle, sheep, pigs, poultry, or horses).
Key points
- It is an offence if a dog worries livestock on agricultural land, unless the dog belongs to or is in the charge of the land occupier, their family, employee, or the livestock owner, their family, or employee.
- A good defence for this offence is proving that reasonable care was taken to prevent the worrying of livestock.
- Fines for this offence can be up to twenty pounds, or up to fifty pounds if there was a previous conviction for the same dog.
- A dog worrying livestock on agricultural land can be seized by a member of the Garda Síochána or by the finder if no owner is present, and the Dogs Act, 1906, provisions for seized stray dogs will apply.
- Shooting a dog that is worrying livestock on agricultural land is a good defence in a damages action if the shooter is the land occupier or livestock owner (or their family/employee), the livestock were lawfully on the land, and the shooting was reported to the Garda Síochána within forty-eight hours.
