Ārlietu ministrijas informācija Rīgā 2020. gada 24. janvārī Par starptautisko līgumu spēkā stāšanos Ārlietu ministrija informē, ka: 1. 2020. gada 7. janvārī spēkā stājās Protokols Latvijas Republikas valdības un Eiropas Kodolpētījumu organizācijas (CERN) līgumam par zinātnisko un tehnisko sadarbību augstas enerģijas daļiņu fizikā (parakstīts 2019. gada 19. decembrī Ženēvā un 2020. gada 7. janvārī Rīgā, apstiprināts ar Ministru kabineta 2019. gada 17. decembra noteikumiem Nr. 658). 2. 2019. gada 29. decembrī spēkā stājās Somijas Republikas valdības, Latvijas Republikas valdības, Norvēģijas Karalistes valdības, Polijas Republikas valdības, Krievijas Federācijas valdības, Zviedrijas Karalistes valdības līgums par Ziemeļu dimensijas Kultūras partnerības sekretariāta izveidi (parakstīta 2018. gada 28. maijā, Rīgā, apstiprināta ar Ministru kabineta 2016. gada 12. janvāra noteikumiem Nr. 22). 3. 2019. gada 1. jūlijā spēkā stājās Pasaules Pasta konvencijas Papildprotokols (parakstīts 2018. gada 7. septembrī Adisabebā, apstiprināts ar likumu "Par Pasaules Pasta konvencijas Papildprotokolu", stājies spēkā 2019. gada 3. oktobrī). 4. 2019. gada 1. jūlijā spēkā stājās Pasaules Pasta savienības konstitūcijas Desmitais papildprotokols (parakstīts 2018. gada 7. septembrī Adisabebā, apstiprināts ar likumu "Par Pasaules Pasta savienības konstitūcijas Desmito papildprotokolu", stājies spēkā 2019. gada 3. oktobrī). 5. 2019. gada 1. jūlijā spēkā stājās Pasaules Pasta savienības Vispārīgā reglamenta Otrais papildprotokols (parakstīts 2018. gada 7. septembrī Adisabebā, apstiprināts ar likumu "Par Pasaules Pasta savienības Vispārīgā reglamenta Otro papildprotokolu", stājies spēkā 2019. gada 3. oktobrī). Pielikumā: 1. Protokols Latvijas Republikas valdības un Eiropas Kodolpētījumu organizācijas (CERN) līgumam par zinātnisko un tehnisko sadarbību augstas enerģijas daļiņu fizikā kopija angļu un latviešu valodā. 2. Līce PROTOCOL TO THE COOPERATION AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF LATVIA AND THE EUROPEAN ORGANIZATION FOR NUCLEAR RESEARCH (CERN)concerningScientific and Technical Cooperation in High-Energy Physics2019The Government of the Republic of Latvia (hereinafter referred to as "GRL"),on the one hand,andThe European Organization for Nuclear Research (hereinafter referred to as "CERN"), an Intergovernmental Organization having its seat at Geneva, Switzerland,on the other hand,hereinafter collectively and individually referred to as the "Parties" and the "Party" respectively,CONSIDERING:The Cooperation Agreement (ICA-LV-0137) between the Government of the Republic of Latvia and the European Organization for Nuclear Research (CERN) concerning Scientific and Technical Cooperation in High-Energy Physics concluded in 2016 ( the "2016 Cooperation Agreement");That Article 4.1 of the 2016 Cooperation Agreement provides that its execution is subject to the conclusion of detailed Protocols;That this protocol (the "Protocol") provides an operational framework for cooperation between the Parties,agree as follows:ARTICLE 1Scope1.1 The purpose of this Protocol is to establish an operational framework for collaboration between the Parties in scientific and technical cooperation in particle physics, including in experimental collaborations, and in such other fields of common interest as the Parties may identify.1.2 In application of the foregoing, the Parties may decide to collaborate, inter alia, in the following activities:(
- i)Participation of Latvian students in CERN’s Student Programmes and the Summer School Programme;(
- ii)Participation by Latvian teachers in CERN’s Teacher Programme;(iii) Visits by Latvian students to CERN;(
- iv)Scientific and technical input by CERN towards the possible development by Latvia of a Centre of High Energy Physics and Accelerator Technologies in Latvia; and(
- v)Teaching activities at Latvian Universities by senior physicists and engineers from CERN.The implementation and modalities of such activities shall be subject to priority for CERN’s scientific programme, the availability of its resources and internal capacity.1.3 The Parties shall use the results of their collaboration for peaceful purposes only.1.4 The provisions of the 2016 Cooperation Agreement shall mutatis mutandis apply to the execution of this Protocol.ARTICLE 2Organization2.1 Except as agreed otherwise by the Parties, the execution of this Protocol is subject to the conclusion of Addenda between CERN and Ministry of Education nad Science, scientific institutes and universities, including their funding bodies, from Latvia, detailing the scope of the collaboration between the parties to the Addendum, the required resources, each party’s contribution and the time schedule and the management (including the appointment of representatives) of such collaboration.2.2 It is understood that if an institute or university from Latvia would become a member of an experimental collaboration at CERN, the provisions of the pertinent Memorandum of Understanding shall prevail over the provisions of this Protocol and the relevant Addendum in respect of its contribution to such experiment.2.3 The procurement of any materials, equipment and services in the execution of this Protocol shall be in accordance with the rules and procedures of the procuring Party.2.4 Any collaboration shall cease through the termination of the activity concerned or of this Protocol, or the pertinent Addendum.ARTICLE 3Personnel3.1 The Parties shall ensure the selection of personnel with the necessary skills and competence to take part in the collaborations.3.2 Except as agreed otherwise, each Party shall pay for the travel of its own personnel to the other Party or, as the case may be, to any other destination.3.3 Where CERN acts as a host Party or otherwise receives Latvian personnel in the execution of this Protocol, the Latvian personnel may be appointed as associated members of the personnel pursuant to the conditions set out in the CERN Staff Rules and Regulations from which it follows that, for the duration of their association with CERN (
- i)the Latvian personnel shall have a legal link with a Latvian scientific institute or university, (
- ii)the Latvian scientific institute or university shall be responsible for their social insurance, (iii) the Latvian personnel shall maintain medical insurance cover adequate in Switzerland and France for themselves and accompanying family members, which shall include cover for occupational illness and accidents for the Latvian personnel, (
- iv)such medical insurance shall also cover for any duty travel required as part of a collaboration and (
- v)the Latvian personnel shall have adequate financial resources to support themselves and accompanying family members. The Latvian scientific institute or university shall hold CERN free and harmless from liability in connection with the subject matter of this Article.ARTICLE 4Mandate of the Latvian national contact personIt is understood that the Ministry of Education and Science of the Republic of Latvia shall appoint a national contact person to coordinate the execution of this Protocol on the part of Latvia.To facilitate the activities detailed at Article 1.2, this role includes in particular:(
- i)liaising between CERN and the Government of the Republic of Latvia, including between Latvian scientists and engineers and relevant CERN Groups, as well as with the experimental collaborations at CERN;(
- ii)coordinating the participation of Latvian students and teachers in CERN programmes; and(iii) promoting and coordinating guest lectures by CERN physicists and engineers in Latvia.ARTICLE 5Contact personsFor the purpose of the implementation of this Protocol, the contact persons shall be:For the Government of the Republic of Latvia:Dr Toms Torims, Professor at Riga Technical University and national contact person, email: Toms.Torims@rtu.lvFor CERN:Dr Christoph Schaefer, Senior Adviser, International Relations Sector, email: Christoph.Schaefer@cern.chor such successors as each Party may designate and communicate to the other Party.The contact persons shall meet or otherwise communicate whenever deemed appropriate.ARTICLE 6Safety6.1 The personnel of each Party shall comply with the rules of conduct and safety in force at the host Party.6.2 Any activity, equipment or other item contributed by a Party under this Protocol shall conform to the safety rules, including any specific safety requirements, in force at the host Party where such activity will be performed or such equipment or other item will be installed and operated.ARTICLE 7Intellectual property7.1 Information disclosed under this Protocol by one Party to the other Party shall not create any proprietary right in respect of such information for the receiving Party.7.2 Title in intellectual property developed by a Party in the execution of this Protocol shall be vested in that Party, who shall grant a free, non-exclusive license to such intellectual property to the other Party for the execution of its scientific programme (including through its partners and sub-contractors).7.3 Where title in intellectual property is jointly vested in the Parties, they shall agree on the making available to third parties of such intellectual property, provided that in any event, they shall grant to each other a free, non-exclusive license to such intellectual property for the execution of their scientific programmes (including through its partners and sub-contractors).7.4 The providing Party gives no warranty in respect of intellectual property made available by it to the other Party under this Protocol, and the receiving Party shall hold the providing Party free and harmless from any liability arising from its use (including by its partners and sub-contractors) of such intellectual property.ARTICLE 8Publications8.1 In accordance with the principle of providing open access to information and always subject to provisions of Article 7, the Parties shall strive to jointly publish the results of their collaboration.8.2 All publications shall acknowledge the collaboration including, if so requested by a Party, the persons having taken part in the development of the results that form the subject of the publication.ARTICLE 9LiabilityExcept in case of gross negligence or wilful misconduct by the other Party or as may result from Articles 3.3 or 7.4 of this Protocol, each Party shall bear its own loss and damage in connection with this Protocol. Notwithstanding the foregoing, each Party shall hold the other Party free and harmless from liability for loss or damage caused by the former to third parties under or in connection with this Protocol.ARTICLE 10Confidentiality10.1 Each Party shall treat as confidential any information provided to it by the other Party and designated as confidential or of which its confidential character should reasonably be understood. Except as agreed otherwise in writing, this confidentiality obligation shall continue for a period of five
- i)Latvijas studentu līdzdalība CERN studentu programmās un vasaras skolas programmā,(
- ii)Latvijas skolotāju līdzdalība CERN Skolotāju programmās;(iii) Latvijas studentu vizītes CERN;(
- iv)CERN zinātniskais un tehniskais ieguldījums Latvijas Enerģētikas un Paātrinātāju tehnoloģiju centra iespējamā attīstībā Latvijā, un(
- v)CERN vecākajiem zinātniekiem un inženieriem sniegt lekcijas Latvijas augstākās izglītības iestādēs,Šādu darbību ieviešana un īstenošana ir prioritāra CERN zinātniskajā programmā, tās resursu pieejamībā un iekšējā kapacitātē.1.3 Puses savas sadarbības rezultātus izmanto vienīgi miermīlīgiem nolūkiem.1.4. Uz šā Protokola izpildi mutatis mutandis attiecas 2016. gada sadarbības nolīguma noteikumi.2. PANTSOrganizācija2.1. Ja vien Puses nav vienojušās citādi, šā Protokola izpilde ir atkarīga no šā Protokola papildinājumu noslēgšanas starp CERN un Izglītības un zinātnes ministriju, zinātniskajiem institūtiem vai augstākās izglītības iestādēm, ieskaitot to finansēšanas iestādes no Latvijas, kuros detalizēti norādīta papildinājuma pušu sadarbības joma, šādai sadarbībai nepieciešamie līdzekļi, katras puses ieguldījums, grafiks un pārvaldība (tostarp pārstāvju iecelšana).2.2. Ir saprotams, ka, ja Latvijas zinātniskais institūts vai augstākās izglītības iestāde no kļūst par CERN eksperimentālā sadarbības pasākuma dalībnieku, priekšroku dod spēkā esošā saprašanās memoranda noteikumiem, nevis šim Protokolam un attiecīgajam papildinājumam, par tās ieguldījumu šādā eksperimentā.2.3. Jebkuru šā Protokola īstenošanai nepieciešamu materiālu, iekārtu un pakalpojumu iepirkumu veic saskaņā ar iepirkumu veicošās Puses noteikumiem un procedūrām.2.4. Jebkura sadarbība tiek izbeigta, izbeidzot attiecīgo pasākumu, vai šā Protokola un tā papildinājumu darbību.3. PANTSPersonāls3.1. Puses nodrošina tādu darbinieku atlasi, kuriem ir nepieciešamās zināšanas un kompetence, lai piedalītos sadarbības pasākumos.3.2. Ja vien nav noteikts citādi, katra Puse sedz ceļošanas izmaksas, kas radušās saistībā ar tās darbinieku došanos apmeklēt otru Pusi vai attiecīgajā gadījumā uz jebkuru citu galamērķi.3.3. Ja CERN darbojas kā uzņēmēja Puse vai citādi uzņem Latvijas personālu šī Protokola ietvaros, Latvijas personālu var iecelt par personāla asociētajiem locekļiem saskaņā ar nosacījumiem, kas izklāstīti CERN Personāla noteikumos un nolikumos, no kuriem izriet, ka tik ilgi, kamēr vien viņi ir saistīti ar CERN, (
- i)Latvijas personālam ir tiesiskas saiknes ar Latvijas zinātnisko institūtu vai augstākās izglītības iestādi, (
- ii)Latvijas zinātniskais institūts vai augstākās izglītības iestāde ir atbildīga par personāla sociālo apdrošināšanu, (iii) Latvijas personāls saņem medicīnisko apdrošināšanu tādā līmenī, kāds pastāv tā uzņemšanas valstīs, proti, Šveicē un Francijā, kā pašiem tā viņu pavadošajiem ģimenes locekļiem, ieskaitot apdrošināšanu par arodslimībām un nelaimes gadījumiem Latvijas personālam, (
- iv)šāda medicīniskā apdrošināšana sedz arī visus ceļa izdevumus, kas nepieciešami sadarbības ietvaros un (
- v)Latvijas personālam ir pietiekami finanšu resursi, lai uzturētu sevi un pavadošos ģimenes locekļus. Latvijas zinātniskais institūts vai augstākās izglītības iestāde atbrīvo CERN no saistībām par šī panta priekšmetu.4. PANTSLatvijas kontaktpersonas pilnvarojumsIr saprotams, ka Latvijas Republikas Izglītības un zinātnes ministrija (turpmāk – IZM) ieceļ valsts kontaktpersonu jautājumos, kas nodrošina šī Protokola izpildi no Latvijas puses;Lai īstenotu darbības, kas minētas 1. panta 2. punktā, šī loma īpaši sevī ietver:(
- i)uzturēt sakarus starp CERN un Latvijas Republikas valdību, tajā skaitā starp Latvijas zinātniekiem un inženieriem un attiecīgajām CERN grupām, kā arī eksperimentālajiem pasākumiem, kas ietver CERN;(
- ii)koordinēt Latvijas studentu un skolotāju dalību CERN programmās;(iii) popularizēt un koordinēt CERN fiziķu un inženieru vieslekcijas Latvijas Republikā;5. PANTSKontaktpersonasSaistībā ar šā Protokola īstenošanu, pārstāvji ir:Latvijas Republikas valdības pārstāvis ir:Dr. Toms Torims, Rīgas Tehniskās universitātes profesors un valsts kontaktpersona e-pasta adrese: Toms.Torims@rtu.lvun CERN pārstāvis ir:Dr. Kristofs Šēfers [Christoph Schaefer], Starptautisko attiecību sektora vecākais konsultants, e-pasta adrese: Christoph.Schaefer@cern.chVai citas norīkotas kontaktpersonas, par kurām Puses savstarpēji paziņo iepriekš.Kontaktpersonas satiekas vai citādi sazinās, kad vien uzskata to par nepieciešamu.6. PANTSDrošība6.1. Katras Puses darbinieki ievēro uzņemošā Pusē spēkā esošās profesionālās ētikas un drošības normas.6.2. Jebkurai darbībai ,iekārtai vai citam priekšmetam, ko rada Puse, pamatojoties uz šo Protokolu, ir jāatbilst drošības noteikumiem, kas ir spēkā uzņemošā Pusē, kur šādas darbības tiks veiktas vai šādas iekārtas vai citas lietas tiks uzstādītas un ekspluatētas.7. PANTSIntelektuālais īpašums7.1. Informācija, ko viena Puse izpauž otrai Pusei, pamatojoties uz šo Protokolu, nerada saņēmējai Pusei īpašumtiesības uz šo informāciju.7.2. Īpašumtiesības uz intelektuālo īpašumu, ko Puse radījusi, īstenojot šo Protokolu, pieder šai Pusei, un tā bez maksas piešķir otrai Pusei neekskluzīvu licenci izmantot šādu intelektuālo īpašumu tās zinātniskās programmas īstenošanai (tostarp ar tās partneru un apakšuzņēmēju starpniecību).7.3. Ja īpašumtiesības uz intelektuālo īpašumu kopīgi pieder abām Pusēm, tās vienojas par šāda intelektuālā īpašuma pieejamību trešajām personām ar nosacījumu, ka jebkurā gadījumā tās bez maksas piešķir viena otrai neekskluzīvu licenci izmantot šādu intelektuālo īpašumu to zinātnisko programmu īstenošanai (tostarp ar tās partneru un apakšuzņēmēju starpniecību).7.4. Nodrošinātāja Puse nesniedz garantijas attiecībā uz intelektuālo īpašumu, kura pieejamību tā nodrošinājusi otrai Pusei saskaņā ar šo Protokolu, un saņēmēja Puse atbrīvo nodrošinātāju Pusi no jebkādas atbildības, kas saistīta ar šāda intelektuālā īpašuma izmantošanu (tostarp izmantošanu, ko veic tās partneri un apakšuzņēmēji).8. PANTSPublikācijas8.1. Puses cenšas kopīgi publiskot savas sadarbības rezultātus saskaņā ar informācijas brīvas pieejamības principu, vienmēr ievērojot 7. panta noteikumus.8.2. Visās publikācijās ir jābūt minētam sadarbības pasākumam, tostarp, ja Puse pieprasa, personām, kuras ir piedalījušās publikācijā apspriesto rezultātu sasniegšanā.9. PANTSAtbildībaIzņemot otras Puses rupju nolaidību vai tīšus pārkāpumus vai gadījumus, kas izriet no šā Protokola 3.3. vai 7.4. panta, katra Puse sedz savus zaudējumus un kaitējumu, kas tai radies saistībā ar šo Protokolu. Neņemot vērā iepriekš minēto, katra Puse atbrīvo otru Pusi no atbildības par zaudējumiem vai kaitējumu, ko pirmā Puse radījusi trešajām personām, īstenojot šo Protokolu, vai saistībā ar šo Protokolu.10. PANTSKonfidencialitāte10.1. Katra Puse ievēro tās informācijas konfidencialitāti, kuru tai sniegusi otra Puse un kura noteikta kā konfidenciāla informācija vai kuras konfidencialitāte loģiski izriet no tās būtības. Ja vien rakstiska vienošanās neparedz citādi, šis konfidencialitātes ievērošanas pienākums ir spēkā piecus
- Konfidencialitātes ievērošanas pienākums neattiecas uz informāciju, attiecībā uz kuru saņēmējai Pusei ir pierādījumi, ka tā ir bijusi publiski pieejama, pirms sniedzēja Puse to ir sniegusi; tā ir kļuvusi par publiski pieejamas informācijas daļu pēc šādas sniegšanas un tas nav noticis saņēmējas Puses rīcības dēļ; šā Protokola parakstīšanas brīdī tā jau ir bijusi saņēmējas Puses rīcībā; saņēmēja Puse ir likumīgi saņēmusi šo informāciju no trešās personas, neuzņemoties pienākumu ievērot konfidencialitāti; saņēmēja Puse ir sagatavojusi attiecīgo informāciju atsevišķi un ārpus šā Protokola darbības jomas.
- PANTSDarbības termiņšŠis Protokols stājas spēkā, kad to parakstījusi pēdējā puse. Ja
- gada sadarbības līgums nepārtraukti ir spēkā, šis Protokols sākotnēji ir spēkā piecus
- un

- Parakstīts 19.12.2019.AGREEMENT BETWEENTHE GOVERNMENT OF THE REPUBLIC OF FINLANDTHE GOVERNMENT OF THE REPUBLIC OF LATVIATHE GOVERNMENT OF THE KINGDOM OF NORWAYTHE GOVERNMENT OF THE REPUBLIC OF POLANDTHE GOVERNMENT OF THE RUSSIAN FEDERATIONTHE GOVERNMENT OF THE KINGDOM OF SWEDENON THE ESTABLISHMENT OF THE SECRETARIAT OF THE NORTHERN DIMENSION PARTNERSHIP ON CULTUREThe Government of the Republic of Finland, the Government of the Republic of Latvia, the, Government of the Kingdom of Norway, the Government of the Republic of Poland, the Government of the Russian Federation and the Government of the Kingdom of Sweden, hereinafter referred to as the Parties,RECALLING the Political Declaration on the Northern Dimension Policy of 24 November 2006 between the European Union, the Republic of Iceland, the Kingdom of Norway and the Russian Federation,HAVING REGARD to the decision by the Northern Dimension Senior Officials at their meeting in Stockholm on 12 November 2009 and the intent to establish a Northern Dimension Partnership on Culture, hereinafter referred to as the NDPC,FULLY RELYING on the provision of the Northern Dimension Policy Framework Document, effective as of 1 January 2007,AFFIRMING the provisions of the Memorandum of Understanding setting out the modalities of Establishing the Northern Dimension Partnership on Culture signed in Saint Petersburg on 20 May 2010,Have agreed as follows:Article 1 Establishment of the Secretariat1.1 The Parties hereby establish the Secretariat of the Northern Dimension Partnership on Culture hereinafter referred to as the Secretariat.1.2 The Secretariat shall be established as a legal body.1.3 The seat of the Secretariat shall be in Riga, Latvia hereinafter referred to as the Host Country.Article 2 Legal PersonalityThe Secretariat shall possess a legal personality in the Host Country. It shall have such legal capacity as may be necessary for the exercise of its functions and the fulfilment of its purposes, including the capacity to contract, to acquire and dispose of movable and immovable property and to institute and participate in legal proceedings.Article 3 Immunities and Privileges3.1 The Secretariat and its property and assets shall enjoy such privileges and immunities as are necessary to exercise its functions and fulfil its objectives.3.2 The permanent personnel of the Secretariat shall enjoy on the territory of the Host Country the privileges and immunities necessary for the exercise of their functions in connection with the activities of the Secretariat.3.3 A Host Country Agreement with regard to the legal capacity of the Secretariat, its privileges and immunities and its personnel shall be concluded between the Secretariat and the Host Country.Article 4 Decision MakingAll decisions shall be made by consensus between the Parties to this Agreement.Article 5 Aims and Functions of the Secretariat5.1 The Secretariat is a working body of the NDPC and shall provide administrative, analytical and technical support to the work of the NDPC.5.2 Detailed aims and functions of the Secretariat are set out in the Terms of Reference as Addendum 1 to this Agreement.Article 6 Budget and Financial Contribution Scheme6.1 The Secretariat shall have an operating budget for each calendar year. The Parties to this Agreement shall finance the budget through assessed annual contributions based upon the Financial Contribution Scheme set out in the Addendum 2 to this Agreement.6.2 The financial contributions in aggregate should amount to at least EUR 110 000 annually in order to enable the establishment and the functionality of the Secretariat.6.3 Minimum annual financial contribution payable by a Party shall be EUR 10 000.6.4 The Financial Contribution Scheme shall be reviewed every third year and any changes thereto are to be decided upon by the Parties to this Agreement, meeting within the Steering Committee.Article 7 Personnel7.1 The Secretariat shall be led by a Head of Secretariat, who shall be selected among qualified individuals and be a citizen of a country of one of the Parties to this Agreement. The Head of Secretariat shall be appointed by the Parties to this Agreement, according to the rules set forth in the Addendum 1 Terms of Reference, Paragraph 3.7.2 Additional personnel required for the successful performance of the tasks of the Secretariat shall be appointed in accordance with the Terms of Reference and within the financial resources available.Article 8 Dispute ResolutionAny dispute, controversy or claims arising out of, or concerning interpretation and application of this Agreement shall be resolved by consultations and negotiations between the Parties to this Agreement.Article 9 Entry into Force9.1 Each Party shall notify the Depositary through diplomatic channels of the completion of the national legal procedures necessary for the entry into force of this Agreement. The Depositary shall inform the other Parties of the receipt of each notification.9.2 This Agreement shall enter into force and the Secretariat shall become fully operational on the thirtieth day, following the date on which all Parties have notified the Depositary of their acceptance of this Agreement.9.3 The Depositary shall inform the Parties of the date of entry into force of this Agreement.Article 10 Amendments10.1 Amendments shall be accepted only by mutual agreement by the Parties to this Agreement. Proposals to amend this Agreement shall be done in writing and communicated through the Depositary to all the Parties, through diplomatic channels. Agreed amendments shall be communicated to all the Parties by the Depositary.10.2 Amendments shall enter into force on the thirtieth day following the date on which all the Parties have notified the Depositary of their acceptance of the amendments.10.3 The Depositary shall inform the Parties of the date of entry into force of the amendments.10.4 Notwithstanding Article 10, Paragraphs 10.1 to 10.3 of this Agreement, Addendum 2 containing the Financial Contribution Scheme can be revised by a decision of the Parties to this Agreement, according to Article 6 Paragraph 6.4 of this Agreement. Similar procedures apply for amendments of Addendum 1, containing Terms of Reference, provided consultations with the Steering Committee and as accepted by the Parties to the Agreement, the Terms of Reference can be amended.Article 11 Withdrawal11.1 Any Party may withdraw from this Agreement by written notice submitted to the Depositary. The withdrawal shall take effect at the end of the calendar year following the year in which the Depositary has received the notice.11.2 The remaining Parties shall consult and agree on the future existence and structure of the Secretariat.11.3 A withdrawal from the NDPC shall consequently also result in a withdrawal from this Agreement.Article 12 AccessionAny Partner of the NDPC may at any time after the entry into force of this Agreement make a request to the Depositary to accede to this Agreement. The Depositary shall inform all the Parties to this Agreement of such request. If the request is approved by the Parties, the accession shall enter into force for the new Partner of the NDPC on the sixtieth day upon receiving by the Depositary of the notification of the completion of national legal procedures by the acceding Partner of the NDPC.Article 13 The DepositaryThe Host Country shall be the Depositary of this Agreement.Article 14 Termination of the Agreement14.1 This Agreement remains in force five years and will be automatically prolonged unless otherwise decided.14.2 This Agreement may be terminated upon consensus decision of the Parties to this Agreement. All the costs related to the termination of this Agreement and dissolution of the Secretariat shall be discussed by the Parties prior to the termination of this Agreement.In witness whereof the undersigned being duly authorized by their respective Governments have signed this Agreement.Done [in/at (place) on (date) of (month and year)] in one original copy in English to be kept by the Depositary. - IntroductionIn order to make the Northern Dimension Partnership on Culture (NDPC) more coherent and efficient it was decided to establish the Secretariat (of the Northern Dimension Partnership on Culture, (Secretariat) according to the Agreement on the Establishment of the Secretariat of the Northern Dimension Partnership on Culture (Agreement). The objective of the Secretariat is to provide administrative, analytical, and technical support to the multilateral coordinated activities under the framework of the NDPC.The scope of the mandate and the activities of the Secretariat, in addition to the organizational setup and the financial arrangements, are described in these Terms of Reference.The seat of the Secretariat shall be in Riga, Latvia, hereinafter referred to as the Host Country.The working language of the Secretariat shall be English.
- ScopeWithin the framework set forth in these Terms of Reference the Secretariat shall primarily:2.1 provide administrative, analytical and technical support to the meetings of the Steering Committee and the High Level Meetings by preparing and circulating necessary information and documents for consideration and discussions2.2 prepare draft minutes of the meetings of the Steering Committee and the High Level Meetings to be circulated to all the Parties of the NDPC;2.3 render administrative support to the NDPC, which may include organizing meetings, preparing written material and summary reports, maintaining updated registers and mailing lists and providing other form of technical services;2.4 ensure updating the NDPC website and other communication means of the NDPC and assist the NDPC in being a focal point for networks, projects and other culture, cultural tourism and creative industries activities in the Northern Dimension area;2.5 prepare specific information material and analytical or descriptive background information for the use of the NDPC, as requested in writing by the Chairmanship of the Steering Committee and as approved by the Parties to the Secretariat in the Steering Committee;2.6 assist upon request from the Steering Committee with elaboration and implementation of the activities of the NDPC in the field of culture, cultural tourism and creative industries inter alia by providing administrative, technical and analytical support to the Steering Committee with these tasks;2.7 facilitate coordination and information exchange within the NDPC and with the organizations of relevance to the NDPC;2.8 support the annual event in Saint Petersburg fostering creative industry.2.9 represent, upon request and instructions of the Steering Committee, the NDPC in international fora, as appropriate.
- Head of Secretariat3.1 The Secretariat shall be led by the Head of Secretariat, who shall be selected among qualified individuals and who shall be a citizen of a country of one of the Parties to the Agreement and should be appointed not later than three months after the signing of the Agreement.3.2 The Head of Secretariat shall be appointed by the Parties to the Agreement on the basis of merits with due consideration to gender awareness and geographical balance in accordance with the principle of rotation. The Chairmanship of the Steering Committee, provided the approval of the Parties to the Agreement, is authorized to sign the employment contract with the Head of Secretariat on behalf of the NDPC.3.3 Upon the time the Agreement is signed, the Head of Secretariat shall be authorized by the Steering Committee to sign the Host Country Agreement, as described in Article 3 Paragraph 3.3 of the Agreement. The Head of Secretariat shall also be authorized to sign any subsequent amendments to the Host Country Agreement, as approved by the Steering Committee.3.4 The Head of Secretariat shall:3.4.1 propose working plans and activities as instructed by the Chairmanship of the Steering Committee, provided the approval of the Parties to the Agreement;3.4.2 present budget proposals of the Secretariat for each calendar year for the information of the Steering Committee and for the approval by the Parties to the Agreement;3.4.3 prepare and submit accounts and other reports to the Parties to the Agreement and to the Steering Committee;3.4.4 submit annual reports to the Parties to the Agreement and to the Steering Committee;3.4.5 conclude and manage contracts on behalf of the Secretariat regarding acquirement of goods and services for the Secretariat;3.4.6 monitor the performance of contractors who perform tasks that have been outsourced by the Secretariat;3.4.7 develop Staff Regulations, Administrative Manual and Financial Rules to be set out in the Personnel Handbook of the Secretariat and to be approved by the Parties to the Agreement.
- Personnel4.1 The Secretariat shall be staffed commensurate to its tasks. In addition to the Head of Secretariat there shall initially be only one Secretary/Accountant.4.2 Additional personnel required for the successful performance of the tasks of the Secretariat shall be appointed within the financial resources available and as approved by the Parties to the Agreement.4.3 Permanent Personnel means the Head of Secretariat and other professional personnel of the Secretariat, who perform functions of the Secretariat as defined in the Terms of Reference as their main employment.4.4 A balance among nationalities of the Parties to the Agreement shall be sought as well as rotation when appointing the Permanent Personnel of the Secretariat.4.5 Contracts for the Permanent Personnel of the Secretariat shall be offered for a period of up to three years, with a possibility of a prolongation for one year. Permanent Personnel can re-apply only once for their own position. Prolongation excludes renewed application.4.6 Additional personnel may be seconded from other entities upon acceptance of the Steering Committee. Acceptance of seconded personnel is subject to the condition that the sending entity (government, regional administration or sponsoring institution) covers all the expenses, except the use of office facilities, which are covered by the Secretariat. The seconded personnel are considered legally employed by the sending entity.4.7 Internships may be offered to young professionals or other individuals who for a fixed period, maximum of three months, will be affiliated with the activities of the Secretariat. Monthly allowances for internships are to be included in the annual budget for the Secretariat.
- The Role of the Steering Committee5.1 The Steering Committee shall supervise and provide guidance of the activities of the Secretariat.5.2 The Steering Committee shall:5.2.1 participate in the process of appointing and dismissing the Head of Secretariat;5.2.2 approve work programmes;5.2.3 ensure that the composition and qualifications of the personnel of the Secretariat are adequate to fulfil the tasks of the Secretariat; instruct and supervise the Secretariat on the use of the financial contributions outside the Secretariat budget:5.2.4 decide the theme and the format for the annual event in Saint Petersburg, seeking to cultivate and promote creative industry in all State Parties to the Agreement. The Steering Committee shall establish a Program Committee consisting of the Members of the Steering Committee, experts from the organizing country Russia and the Northern Dimension Institute. For this purpose the partner countries in the Program Committee shall decide on the contributions from the NDPC budget.5.2.5 closely cooperate with one of the cultural institutes in Saint Petersburg appointed by the Russian Federation which for instance will conduct studies on creative industries on Russian markets, as well as promotional events relevant to the work of the NDPC. For this purpose the Russian Federation shall earmark initially 4000 euro out of their annual contribution to the Secretariat.
- Financial Contribution Scheme6.1 The operating annual budget for each calendar year shall be financed through assessed annual contributions based upon the Financial Contribution Scheme as regulated to in Article 6 of the Agreement.6.2 The financial resources of the Secretariat may also include voluntary contributions from NDPC Partners, as well as grants or payments of any kind from international and national organizations, or other sources for the purpose of furthering the mandate and the functions of the Secretariat.6.3 The Parties to the Agreement shall annually in advance, and not later than 31 March, approve the budget pertaining to the Secretariat for the subsequent calendar year. Financial contributions from the Parties to the Agreement should arrive to the account of the Secretariat not later than 1 May for each calendar year.6.4 The financial contributions, as mentioned above, are to be considered as resources of the Secretariat and shall cover only the needs and operations of the Secretariat. Any programme or project activities to be managed or supervised by the Secretariat shall be financed from sources outside the budget of the Secretariat.6.5 For financing projects of the NDPC the Parties to the Agreement may establish a special fund. The means of this special fund or other resources (such as private contributions or grants) for projects shall be placed in a separate bank account.6.6 Any contribution of additional resources has to be approved by the Steering Committee.6.7 Interest earned on contributions under the Financial Contribution Scheme shall be added to the Secretariat bank account. Interest earned on any other resources, possessed by the NDPC, and as described in Paragraph 6.4 above, pertaining for projects and activities shall also be managed by the Secretariat, but on a separate account.6.8 The Head of Secretariat shall be responsible for administering the separate Secretariat bank accounts.
- Program and Project Activities7.1 The responsibility and the involvement of the Secretariat with regard to program and project activities, which are financed outside the regular compulsory financial contributions, as set forth in Article 6 of the Agreement is to be supervised and under the instruction by the Steering Committee, as described in Paragraph 5 and Paragraph 6.4 of these Terms of Reference.7.2 The Secretariat shall report on the finance management of the separate account, opened for such programs and project activities, to the Parties to the Agreement and to the Steering Committee.7.3 The responsibility of the Secretariat with regard to any obligations concerning implementation, monitoring, reporting and evaluations of such programs and project activities is to be negotiated and decided upon in separate agreements between the Secretariat and the owners of the program and project activities.
- AccountingThe Head of Secretariat shall ensure that accounting records are kept in accordance with generally accepted accounting practice and standards and with due regard to specific requirements under the law of the Host Country.
- Auditing ProceduresThe Steering Committee shall appoint an external auditor upon proposal by the Host Country or by another Party to the Agreement.
- Amendments of these Terms of ReferenceThe Steering Committee and the Head of Secretariat may propose amendments to these Terms of Reference. After consulting the Steering Committee and with the acceptance of the Parties to the Agreement, the Terms of Reference can be amended. ADDENDUM 2FINANCIAL CONTRIBUTION SCHEMEThe Secretariat of the Northern Dimension Partnership on Culture established according to the Agreement on the Establishment of the Secretariat of the Northern Dimension Partnership on Culture (Agreement) shall have an operating budget for each calendar year. The Parties to the Agreement shall finance the budget through assessed annual contributions based upon the Financial Contribution Scheme set out in this Addendum No. 2 to the Agreement.According to the Agreement the financial contributions in aggregate should amount to at least EUR 110 000 annually in order to enable establishing the Secretariat. - pants Imunitāte un privilēģijas3.1 Sekretariātam un tā īpašumam un aktīviem ir tādas privilēģijas un imunitāte, kas ir nepieciešama, lai tas pildītu savas funkcijas un sasniegtu mērķus.3.2 Sekretariāta pastāvīgajam personālam Uzņemošās valsts teritorijā ir tādas privilēģijas un imunitāte, kas ir nepieciešama, lai pildītu savas funkcijas saistībā ar Sekretariāta darbībām.3.3 Starp Sekretariātu un Uzņemošo valsti noslēdz Līgumu, kas nosaka Sekretariāta tiesībspēju, privilēģijas, imunitāti un tā personālu.

- pants Sekretariāta mērķi un funkcijas5.1 Sekretariāts koordinē ZDKP darbu un sniedz ZDKP administratīvo, analītisko un tehnisko atbalstu.5.2 Detalizēti Sekretariāta mērķi un pienākumi ir noteikti Līguma 1.pielikumā Darba uzdevumos.
- pants Budžets un finanšu iemaksu shēma6.1 Sekretariāta finanšu gads atbilst kalendārajam gadam. Šā līguma Puses veic ikgadējās iemaksas, pamatojoties uz Finanšu iemaksu shēmu, kas noteikta Līguma
- pielikumā.6.2 Ikgadējām finanšu iemaksām jāsasniedz vismaz 110 000 EUR, lai nodrošinātu Sekretariāta izveidošanu un tā funkcionēšanu.6.3 Minimālā katras Puses ikgadējā iemaksa ir 10 000 EUR.6.4 Finanšu iemaksu shēmu pārskata reizi trīs gados, un par jebkādām iespējamām izmaiņām šā līguma Puses lemj Vadības komitejas sapulcē.
- pants Personāls7.1 Sekretariātu vada Sekretariāta vadītājs, kam ir atbilstoša kvalifikācija un kuru izvēlas no kādas Līguma Puses valsts pilsoņiem. Sekretariāta vadītāju šā līguma Puses ieceļ amatā saskaņā ar 1.pielikuma Darba uzdevumu 3.punktā minētajiem noteikumiem.7.2 Papildu personālu, kas nepieciešams, lai veiksmīgi īstenotu Sekretariāta uzdevumu izpildi, ieceļ saskaņā ar Darba uzdevumiem un pieejamo finanšu resursu ietvaros.

- Jebkuru strīdu, pretrunas vai prasības, kas rodas no, vai saistībā ar šā līguma interpretāciju un piemērošanu, šī līguma Puses risina konsultāciju ceļā.
- pants Spēkā stāšanās9.1 Katra Puse paziņo Depozitārijam pa diplomātiskajiem kanāliem par nacionālo juridisko procedūru izpildi, kas nepieciešamas, lai šis līgums stātos spēkā. Depozitārijs informē citas Puses par katra paziņojuma saņemšanu.9.2 Šis līgums stājas spēkā, un Sekretariāts uzsāk darbību trīsdesmitajā dienā pēc datuma, kad visas Puses paziņojušas Depozitārijam par šī līguma apstiprināšanu.9.3 Depozitārijs informē Puses par šā līguma spēkā stāšanās datumu.
- pants Grozījumi10.1 Grozījumus var veikt tikai ar šī līguma Pušu savstarpēju vienošanos. Priekšlikumus šī līguma grozīšanai sagatavo rakstiski un iesniedz pa diplomātiskajiem kanāliem visām Pusēm ar Depozitārija starpniecību. Depozitārijs pa diplomātiskajiem kanāliem informē visas Puses par apstiprinātajiem grozījumiem.10.2 Grozījumi stājas spējā trīsdesmitajā dienā pēc datuma, kad visas Puses ir informējušas Depozitāriju par grozījumu apstiprināšanu.10.3 Depozitārijs informē Puses par grozījumu spēkā stāšanās datumu.10.4

Izstāšanās stājas spēkā nākamā kalendārā gada beigās pēc gada, kad Depozitārijs ir saņēmis paziņojumu.11.2 Pārējās Puses apspriežas un vienojas par turpmāko Sekretariāta pastāvēšanu un struktūru.11.3 Izstāšanās no ZDKP attiecīgi nozīmē arī izstāšanos no šā līguma.
- pants PievienošanāsJebkurš ZDKP Partneris var jebkurā laikā pēc šā līguma spēkā stāšanās izteikt lūgumu Depozitārijam pievienoties šim līgumam. Depozitārijs informē visas šā līguma Puses par šādu lūgumu. Ja Puses apstiprina šo lūgumu, tad jaunā Partnera pievienošanās ZDKP stājas spēkā sešdesmitajā dienā pēc tam, kad Depozitārijs ir saņēmis paziņojumu par jaunā ZDKP Partnera nacionālo juridisko procedūru izpildi.
- pants DepozitārijsŠī līguma Depozitārijs ir Uzņemošā valsts.
- pants Līguma izbeigšana14.1 Šis līgums ir spēkā piecus gadus un tā darbība tiek automātiski pagarināta, ja netiek nolemts citādi.14.2 Šī līguma darbību var izbeigt ar šī līguma Pušu vienprātīgu lēmumu. Puses apspriež visas izmaksas saistībā ar šā līguma un Sekretariāta darbības izbeigšanu pirms šā līguma darbības izbeigšanas.To apliecinot, zemāk parakstījušās valdību pilnvarotās personas, ir parakstījušas šo līgumu.Parakstīts [(vieta), (datums) (mēnesis un gads)] vienā oriģinālā eksemplārā, angļu valodā, ko glabā Depozitārijs. - PIELIKUMSZIEMEĻU DIMENSIJAS KULTŪRAS PARTNERĪBAS SEKRETARIĀTA DARBA UZDEVUMI
- IevadsLai padarītu Ziemeļu Dimensijas Kultūras partnerību (ZDKP) vienotāku un efektīvāku, nolemts izveidot Sekretariātu (Ziemeļu Dimensijas Kultūras partnerības), pamatojoties uz Līgumu par Ziemeļu Dimensijas Kultūras partnerības sekretariāta izveidi (Līgums). Sekretariāta darbības mērķis ir nodrošināt administratīvo, analītisko un tehnisko atbalstu daudzpusējām saskaņotām darbībām ZDKP ietvaros.Sekretariāta pilnvaru un darbības apmērs papildus organizatoriskajai struktūrai un finanšu pasākumiem ir aprakstīts šajos darba uzdevumos.Sekretariāta mītne atrodas Rīgā, Latvijā, turpmāk tekstā saukta par Uzņemošo valsti.Sekretariāta darba valoda ir angļu valoda.
- Darbības jomaŠo darba uzdevumu ietvaros Sekretariāts galvenokārt:2.1 nodrošina administratīvu, analītisku un tehnisku atbalstu, organizējot Vadības komitejas sanāksmes un citas augsta līmeņa sanāksmes, kā arī sagatavojot un izplatot nepieciešamo informāciju un izskatīšanai un diskusijām nepieciešamos dokumentus;2.2 sagatavo Vadības komitejas un augsta līmeņa sanāksmju protokolu projektus, ko izplata visām ZDKP Pusēm;2.3 sniedz administratīvu atbalstu ZDKP, kas var ietvert sanāksmju organizēšanu, rakstveida materiālu un apkopojuma ziņojumu sagatavošanu, reģistru un adresātu sarakstu atjaunināšanu un cita veida tehnisko pakalpojumu sniegšanu;2.4 nodrošina ZDKP mājaslapas un citu ZDKP saziņas līdzekļu atjaunināšanu un atbalsta ZDKP kā kontaktpunktu par tīklu, projektu un citu kultūras, kultūras tūrisma un radošo industriju aktualitātēm Ziemeļu Dimensijas teritorijā;2.5 sagatavo specifiskus informatīvus materiālus un analītisku vai aprakstošu pamatinformāciju ZDKP vajadzībām, ko rakstveidā pieprasa Vadības komitejas vadītājs un Vadības komitejā apstiprina Puses;2.6 pēc Vadības komitejas pieprasījuma sniedz atbalstu ZDKP aktivitāšu izstrādē un īstenošanā kultūras, kultūras tūrisma un radošo industriju jomā, cita starpā, sniedzot administratīvu, tehnisku un analītisku atbalstu Vadības komitejai, izpildot šos uzdevumus;2.7 veicina koordināciju un informācijas apmaiņu ZDKP ietvaros un ar organizācijām, kuru darbība attiecas uz ZDKP;2.8 sniedz atbalstu, organizējot ikgadējo radošo industriju veicināšanas pasākumu Sanktpēterburgā;2.9 pēc Vadības komitejas pieprasījuma un norādījumiem, ja nepieciešams, pārstāv ZDKP starptautiskos forumos.
- Sekretariāta vadītājs3.1 Sekretariātu vada Sekretariāta vadītājs, kam ir atbilstoša kvalifikācija un kuru izvēlas no kādas Līguma Puses valsts pilsoņiem, un kuru ieceļ ne vēlāk kā trīs mēnešus pēc Līguma parakstīšanas.3.2 Sekretariāta vadītāju izvirza Līguma puses, ievērojot dzimumu līdztiesību un ģeogrāfisko līdzsvaru saskaņā ar rotācijas principu. Vadības komitejas vadītājs, kuru apstiprina šā līguma Puses, ir pilnvarots parakstīt darba līgumu ar Sekretariāta vadītāju ZDKP vārdā.3.3 Pēc tam, kad Līgums ir parakstīts, Vadības komiteja pilnvaro Sekretariāta vadītāju parakstīt Uzņemošās valsts līgumu, kā minēts šā līguma

- daļā.Sekretariāta vadītājs ir arī pilnvarots parakstīt jebkurus turpmākos Uzņemošās valsts līguma grozījumus, kurus apstiprinājusi Vadības komiteja.3.4 Sekretariāta vadītājs:3.4.
- piedāvā darba plānus un darbības, balstoties uz Vadības komitejas vadītāja norādījumiem, kam nepieciešams Līguma Pušu apstiprinājums;3.4.2 iesniedz Sekretariāta kalendārā gada budžeta ierosinājumus informācijai Vadības komitejai un Līguma Pušu apstiprināšanai;3.4.3 sagatavo un iesniedz grāmatvedības atskaites un citus ziņojumus Līguma Pusēm un Vadības komitejai;3.4.4 iesniedz gada pārskatus Līguma Pusēm un Vadības komitejai;3.4.5 Sekretariāta vārdā slēdz un pārvalda līgumus par preču un pakalpojumu iegādi Sekretariāta vajadzībām;3.4.6 uzrauga to līgumslēdzēju sniegumu, kuri pilda uzdevumus, ko Sekretariāts ir nodevis ārpakalpojumiem;3.4.7 izstrādā Personāla noteikumus, Administratīvās vadlīnijas un Finanšu noteikumus, kas izklāstīti Sekretariāta Personāla rokasgrāmatā, un ko apstiprina Līguma Puses.
- Personāls4.1 Sekretariāts nodarbina personālu atbilstoši tā uzdevumiem. Papildus Sekretariāta vadītājam sākotnēji ir tikai viens sekretārs/grāmatvedis.4.2 Papildus personālu, kas nepieciešams, lai veiksmīgi īstenotu Sekretariāta uzdevumu izpildi, Līguma Puses apstiprina un ieceļ pieejamo finanšu resursu ietvaros.4.3 Pastāvīgais personāls ir Sekretariāta vadītājs un citi Sekretariāta profesionālie darbinieki, kuri pilda Sekretariāta funkcijas, kā tas noteikts Darba uzdevumos.4.4 Ieceļot pastāvīgo Sekretariāta personālu, jānodrošina ģeogrāfiskais līdzsvars starp Līguma Pusēm, kā arī jāievēro rotācijas princips.4.5 Sekretariāta pastāvīgajam personālam tiek piedāvāts slēgt līgumus uz laiku līdz trim gadiem ar iespēju pagarināt to darbību vēl par vienu gadu. Pastāvīgais personāls var atkārtoti pieteikties uz savu amatu tikai vienreiz. Pagarinājums neietver atkārtotu pieteikumu.4.6 Ar Vadības komitejas piekrišanu papildu personālu var piesaistīt no citām iestādēm. Vadības komiteja dod piekrišanu papildu personāla piesaistīšanai tikai ar nosacījumu, ka nosūtošā iestāde (valdība, reģionālā administrācija vai sponsoriestāde) sedz visus papildu personāla izdevumus, izņemot biroja telpu nomu, par ko maksā Sekretariāts. Papildu personālam ir jābūt darba tiesiskās attiecībās ar nosūtītāju iestādi.4.7 Jauniem profesionāļiem vai citām personām var piedāvāt prakses darba iespējas Sekretariātā uz noteiktu laiku, kas nepārsniedz trīs mēnešus. Ikmēneša praktikantu stipendijas tiek iekļautas Sekretariāta gada budžetā.
- Vadības komitejas loma5.
- Vadības komiteja uzrauga Sekretariāta darbu un sniedz nepieciešamos norādījumus.5.2 Vadības komiteja:5.2.1 piedalās Sekretariāta vadītāja amatā iecelšanas un atbrīvošanas procesā;5.2.
- apstiprina darba programmas;5.2.
- nodrošina, lai Sekretariāta personāla sastāvs un tā kvalifikācija atbilstu Sekretariāta uzdevumiem; dod norādījumus un uzrauga, kā Sekretariāts izmanto finanšu iemaksas, kas nav iekļautas Sekretariāta budžetā;5.2.
- lemj par ikgadējā pasākuma Sanktpēterburgā tēmu un formātu, cenšoties attīstīt un veicināt radošās industrijas visās Līguma Pušu valstīs. Vadības komiteja izveido Programmas komiteju, kas sastāv no Vadības komitejas locekļiem, ekspertiem no Krievijas kā rīkotājvalsts un Ziemeļu Dimensijas institūta. Šim nolūkam Programmas komitejas partnervalstis lemj par iemaksām no ZDKP budžeta.5.2.
- cieši sadarbojas ar vienu no Krievijas Federācijas norādītajiem kultūras institūtiem Sanktpēterburgā, kas, piemēram, veiks pētījumus par radošajām industrijām Krievijas tirgū, kā arī publicitātes pasākumiem, kas saistīti ar ZDKP darbu. Šim nolūkam Krievijas Federācija sākotnēji piešķirs 4000 euro no savas ikgadējās iemaksas Sekretariātam.
- Finanšu iemaksu shēma6.1 Darba budžets katra kalendārā gada ietvaros sastāv no ikgadējām iemaksām, pamatojoties uz Finanšu iemaksu shēmu, kas noteikta Līguma
- pantā.6.2 Sekretariāta finanšu resursi var ietvert arī brīvprātīgas iemaksas no ZDKP Partneriem, kā arī dotācijas vai maksājumus no jebkura veida starptautiskām un nacionālām organizācijām vai citiem avotiem Sekretariāta pilnvaru un funkciju turpmākas pildīšanas nolūkā.6.3 Reizi gadā, bet ne vēlāk kā līdz kalendārā gada
- martam, Līguma Puses apstiprina Sekretariāta nākamā kalendārā gada budžetu. Līguma Puses veic finanšu iemaksas Sekretariāta kontā ne vēlāk kā līdz katra kalendārā gada
- maijam.6.4 Finanšu iemaksas, kā iepriekš minēts, tiek uzskatītas par Sekretariāta līdzekļiem un ar tām sedz tikai Sekretariāta vajadzības un darbības. Jebkuras programmas vai projekti, ko pārvalda vai uzrauga Sekretariāts, tiek finansētas no līdzekļiem, kas nav iekļauti Sekretariāta budžetā.6.5 Līguma Puses var izveidot speciālu fondu ZDKP projektu finansēšanai. Šā speciālā fonda līdzekļi vai citi resursi (piemēram, privātās iemaksas vai dotācijas) projektiem nogulda atsevišķā bankas kontā.6.6 Jebkuras papildu resursu iemaksas apstiprina Vadības komiteja.6.7 Procentus, kas nopelnīti no iemaksām, saskaņā ar Finanšu iemaksu shēmu ieskaita Sekretariāta bankas kontā. Procentus, kas nopelnīti no jebkuriem citiem ZDKP administrētajiem resursiem, kas nav iekļauti Sekretariāta budžetā un, kas attiecas uz projektiem un aktivitātēm, kā noteikts šā Pielikuma 6.
- punktā, pārvalda Sekretariāts, noguldot tos atsevišķā kontā.6.8 Sekretariāta vadītājs ir atbildīgs par atsevišķu Sekretariāta bankas kontu pārvaldīšanu.
- Programmu un projektu aktivitātes7.1 Sekretariāta atbildību un iesaisti programmu un projektu aktivitātēs, kas netiek finansētas no regulārajām finanšu iemaksām, kā norādīts līguma
- pantā, pārrauga un nosaka Vadības komiteja, saskaņā ar Darba uzdevumu
- pantu un 6.
- daļu.7.2 Sekretariāts atskaitās Līguma Pusēm un Vadības komitejai par atsevišķā konta, kas atvērts šādu programmu un projektu aktivitāšu nodrošināšanai, finanšu pārvaldību.7.3 Sekretariāta atbildību, kas saistīta ar šādu programmu un projektu aktivitāšu īstenošanu, uzraudzību, ziņošanu un novērtēšanu, apspriež un apstiprina atsevišķā līgumā starp Sekretariātu un programmu un projektu aktivitāšu īstenotājiem.
- GrāmatvedībaSekretariāta vadītājs nodrošina, lai grāmatvedības dokumentus sagatavotu saskaņā ar pieņemto grāmatvedības praksi un standartiem un atbilstoši Uzņemošās valsts normatīvajiem aktiem.
- Audita procedūrasVadības komiteja ieceļ ārējo auditoru pēc Uzņemošās valsts vai kādas citas Līguma Puses ierosinājuma.
- Šo darba uzdevumu grozījumiVadības komiteja un Sekretariāta vadītājs var ierosināt veikt grozījumus šajos darba uzdevumos. Pēc apspriešanās ar Vadības komiteju un ar Līguma Pušu piekrišanu šie darba uzdevumi var tikt grozīti.
- PIELIKUMSFINANŠU IEMAKSU SHĒMAZiemeļu Dimensijas Kultūras partnerības Sekretariātam, kas izveidots saskaņā ar līgumu par Ziemeļu Dimensijas Kultūras partnerības Sekretariāta izveidi (Līgums), ir apstiprināts budžets katram kalendārajam gadam. Šā līguma Puses nodrošina budžetu, izdarot ikgadējas iemaksas un pamatojoties uz Finanšu iemaksu shēmu, kas izklāstīta šā līguma
- pielikumā.Saskaņā ar Līgumu, kopējām finanšu iemaksām katru gadu jāsasniedz vismaz 110 000 EUR, lai nodrošinātu Sekretariātu. Minimālā katras Puses gada iemaksa ir 10 000 EUR.Saskaņā ar Līguma 6.

The size and weight limits are specified in the Regulations.6 Higher weight limits than those indicated in paragraph 2 apply optionally for certain letter-post item categories under the conditions specified in the Regulations.7 Member countries shall also ensure that their designated operators accept, handle, convey and deliver parcel-post items up to 20 kilogrammes.8 Weight limits higher than 20 kilogrammes apply optionally for certain parcel-post items under the conditions specified in the Regulations.Article II(Art. 18 amended)Supplementary services1 Member countries shall ensure the provision of the following mandatory supplementary services:1.1 registration service for outbound priority and airmail letter-post items;1.2 registration service for all inbound registered letter-post items.2 Member countries may ensure the provision of the following optional supplementary services in relations between those designated operators which agreed to provide the service:2.1 insurance for letter-post items and parcels;2.2 cash-on-delivery service for letter-post items and parcels;2.3 tracked delivery service for letter-post items;2.4 delivery to the addressee in person of registered or insured letter-post items;2.5 free of charges and fees delivery service for letter-post items and parcels;2.6 cumbersome parcels services;2.7 consignment service for collective items from one consignor sent abroad;2.8 merchandise return service, which involves the return of merchandise by the addressee to the original seller, with the latter’s authorization.3 The following three supplementary services have both mandatory and optional parts:3.1 international business reply service (IBRS), which is basically optional. All member countries or their designated operators shall, however, be obliged to operate the IBRS "return" service;3.2 international reply coupons, which shall be exchangeable in any member country. The sale of international reply coupons is, however, optional;3.3 advice of delivery for registered letter-post items, parcels and insured items. All member countries or their designated operators shall admit incoming advices of delivery. - Vēstuļu korespondences sūtījumus klasificē saskaņā ar Reglamentu, pamatojoties uz sūtījumu apstrādes ātrumu un sūtījumu saturu.
- Saskaņā ar 4.punktā minēto klasifikāciju vēstuļu korespondences sūtījumus var klasificēt arī pēc to formāta kā mazas vēstules (P), lielas vēstules (G), lielgabarīta vēstules (E) vai sīkpakas (E). Izmēra un svara robežlielumi ir noteikti Reglamentā.
- Svara ierobežojumus, kas pārsniedz
- punktā noteiktos, var piemērot atsevišķām vēstuļu korespondences sūtījumu kategorijām saskaņā ar Reglamentu.
- Dalībvalstis nodrošina arī to, ka to izraudzītie operatori pieņem, apstrādā, pārvadā un piegādā pasta paku sūtījumus, kuru svars nepārsniedz divdesmit kilogramus.
- Svara ierobežojumus, kas pārsniedz divdesmit kilogramus, var piemērot atsevišķiem pasta paku sūtījumiem saskaņā ar Reglamentu.II pants(

- Dalībvalstis nodrošina šādu obligāto papildpakalpojumu sniegšanu:1.
- reģistrācijas pakalpojumu izejošiem prioritāriem un aviopasta vēstuļu korespondences sūtījumiem;1.
- reģistrācijas pakalpojumu visiem ienākošajiem vēstuļu korespondences sūtījumiem.
- Dalībvalstis var nodrošināt turpmāk minēto neobligāto papildpakalpojumu sniegšanu attiecībās ar tiem izraudzītajiem operatoriem, kuri vienojušies sniegt šos pakalpojumus:2.
- vēstuļu korespondences sūtījumu un pasta paku apdrošināšanu;2.
- vēstuļu korespondences sūtījumu un pasta paku izsniegšanu ar pēcmaksu;2.
- vēstuļu korespondences sūtījumu piegādes izsekojamības pakalpojumu;2.
- ierakstītu vēstuļu korespondences sūtījumu vai apdrošinātu vēstuļu korespondences sūtījumu izsniegšanu adresātam personīgi;2.
- vēstuļu korespondences un pasta paku piegādes pakalpojumus bez maksas un nodevām;2.
- lielgabarīta pasta paku nosūtīšanas pakalpojumus;2.
- konsignācijas pakalpojumu grupētu sūtījumu nosūtīšanai uz ārvalstīm no viena sūtītāja;2.
- preču atpakaļsūtīšanas pakalpojumu, kad adresāts sūta atpakaļ preci tās sākotnējam tirgotājam pēc saskaņošanas ar šo tirgotāju.
- Trīs turpmāk minētie papildpakalpojumi ietver gan obligātas, gan neobligātas daļas:3.
- pakalpojums "Starptautiskā komerckorespondence ar apmaksātu atbildi (IBRS)", kas ir galvenokārt izvēles pakalpojums. Tomēr visām dalībvalstīm vai to izraudzītajiem operatoriem ir pienākums sniegt IBRS "atpakaļsūtīšanas" pakalpojumu;3.
- starptautiskie atbildes kuponi, kuriem jābūt apmaināmiem jebkurā dalībvalstī. Tomēr starptautisko atbildes kuponu pārdošana nav obligāta;3.
- pakalpojums "Paziņojums par izsniegšanu" attiecībā uz ierakstītiem vēstuļu korespondences sūtījumiem, pasta pakām un apdrošinātiem sūtījumiem. Visām dalībvalstīm vai to izraudzītajiem operatoriem jāpieņem paziņojumi par izsniegšanu attiecībā uz ienākošiem sūtījumiem. Taču pakalpojums "Paziņojums par izsniegšanu" attiecībā uz izejošiem sūtījumiem nav obligāts.
- Šo pakalpojumu apraksts un maksa par tiem ir noteikta Reglamentā.
- Ja iekšzemes pasta dienests iekasē īpašu maksu par turpmāk minētajiem pakalpojumiem, tad saskaņā ar Reglamentā minētajiem nosacījumiem izraudzītie operatori ir tiesīgi iekasēt tādu pašu maksu par starptautiskiem sūtījumiem:5.
- par tādu sīkpaku piegādi, kuru svars pārsniedz 500 gramus;5.
- par vēstuļu korespondences sūtījumiem, kas nodoti pēc visvēlākā nodošanas laika;5.
- par sūtījumiem, kas nodoti sūtīšanai ārpus pasta nodaļas lodziņa parastā darba laika;5.
- par sūtījuma savākšanu sūtītāja adresē;5.
- par vēstuļu korespondences sūtījuma izņemšanu ārpus pasta nodaļas lodziņa parastā darba laika;5.
- par korespondences saņemšanu pēc pieprasījuma pasta nodaļā;5.
- par tādu vēstuļu korespondences sūtījumu (izņemot sūtījumus neredzīgajiem) uzglabāšanu, kuru svars pārsniedz 500 gramus, un pasta paku uzglabāšanu;5.
- par pasta paku piegādi pēc paziņojuma saņemšanas par sūtījuma pienākšanu;5.
- par nodrošinājumu pret nepārvaramas varas risku;5.

Entry into force and duration of the Additional Protocol to the General Regulations of the Universal Postal UnionSecond Additional Protocol to the General Regulations of the Universal Postal UnionThe plenipotentiaries of the governments of the member countries of the Universal Postal Union, having met in Extraordinary Congress at Addis Ababa, in view of article 22.2 of the Constitution concluded at Vienna on 10 July 1964, have, by common consent and subject to article 25.4 of the Constitution, adopted the following amendments to the General Regulations.Article I(Art. 103 amended)Functions of Congress1 On the basis of proposals by member countries, the Council of Administration and the Postal Operations Council, Congress shall:1.1 determine the general principles for achieving the object and purpose of the Union set out in the Preamble and article 1 of the Constitution;1.2 consider and adopt, where appropriate, proposals for amendments to the Constitution, General Regulations, Convention and Agreements submitted by member countries and the Councils, in accordance with article 29 of the Constitution and article 138 of the General Regulations;1.3 set the date for the entry into force of the Acts;1.4 adopt its Rules of Procedure and the amendments to those Rules;1.5 consider the comprehensive reports on the work of the Council of Administration, the Postal Operations Council and the Consultative Committee, covering the period from the previous Congress, presented by these respective bodies in accordance with articles 111, 117 and 125 of the General Regulations;1.6 adopt the Union’s strategy;1.6bis approve the draft quadrennial UPU business plan;1.7 fix the maximum amount of the Union’s expenditure, in accordance with article 21 of the Constitution;1.8 elect the member countries to sit on the Council of Administration and the Postal Operations Council, in accordance with, inter alia, the electoral procedures laid down in the Congress resolutions pertaining to this matter;1.9 elect the Director General and Deputy Director General;1.10 set in a Congress resolution the ceiling of the costs to be borne by the Union for the production of documents in Chinese, German, Portuguese and Russian.2 Congress, as the supreme body of the Union, shall deal with such other questions concerning postal services.Article II(Art. 104 amended)Rules of Procedure of Congresses1 For the organization of its work and the conduct of its debates, Congress shall apply its Rules of Procedure.2 Each Congress may amend its Rules of Procedure under the conditions laid down in those Rules of Procedure.3 Paragraphs 1 and 2 shall also be applicable by analogy to Extraordinary Congresses.Article III(Art. 105 amended)Observers to the Union’s bodies1 The following entities shall be invited to participate in the plenary sessions and committee meetings of Congress, the Council of Administration and the Postal Operations Council as observers:1.1 the United Nations;1.2 Restricted Unions;1.3 members of the Consultative Committee;1.4 entities authorized to attend Union meetings as observers by virtue of a resolution or decision of Congress.2 The following entities, if duly designated by the Council of Administration in accordance with article 107.1.12 shall be invited to attend specific meetings of Congress as ad hoc observers:2.1 specialized agencies of the United Nations and other intergovernmental organizations;2.2 any international body, any association or enterprise, or any qualified person.3 In addition to the observers defined in paragraph 1 of this article, the Council of Administration and the Postal Operations Council may designate ad hoc observers to attend their meetings in accordance with their Rules of Procedure, when this is in the interests of the Union and its bodies.Article IV(Art. 106 amended)Composition and functioning of the CA1 The Council of Administration shall consist of forty-one members who shall exercise their functions during the period between two successive Congresses.2 The chairmanship shall devolve by right on the host member country of Congress. If that member country waives this right, it shall become a de jure member and, as a result, the geographical group to which it belongs shall have at its disposal an additional seat, to which the restrictive provisions of paragraph 3 shall not apply. In that case, the Council of Administration shall elect to the chairmanship one of the members belonging to the geographical group of the host member country.3 The forty other members of the Council of Administration shall be elected by Congress on the basis of an equitable geographical distribution. At least a half of the membership is renewed at each Congress; no member country may be chosen by three successive Congresses.4 Each member of the Council of Administration shall appoint its representative(s). The members of the Council of Administration shall take an active part in its work.5 The office of member of the Council of Administration shall be unpaid. The operational expenses of this Council shall be borne by the Union.6 The CA shall define, formalize and/or set up the standing groups and task forces or other bodies to be established within its structure, with due regard being paid to the Union’s strategy and business plan adopted by Congress.Article V(Art. 107 amended)Functions of the CA1 The Council of Administration shall have the following functions:1.1 Supervises all the activities of the Union between Congresses, ensuring compliance with the decisions of Congress, studying questions with respect to governmental policies on postal issues, and taking account of international regulatory developments such as those relating to trade in services and to competition.1.2 Promotes, coordinates and supervises all forms of postal technical assistance within the framework of international technical cooperation.1.3 Examines the draft quadrennial UPU business plan approved by Congress, and finalizes it by bringing the activities set out in the draft plan for the four-year period into line with the actual resources available. The plan should also, if appropriate, be in line with the results of the prioritization process carried out by Congress. The finalized version of the quadrennial business plan, completed and approved by the CA, will then form the basis for the preparation of the annual UPU Programme and Budget as well as for the annual operating plans to be drawn up and implemented by the CA and POC.1.4 Considers and approves the annual programme and budget and the accounts of the Union, while taking into account the final version of the UPU Business Plan, as described in article 107.1.3.1.5 Authorizes the ceiling of expenditure to be exceeded, if circumstances so require, in accordance with article 145.3 to 5.1.6 Authorizes election of a lower contribution class, if it is so requested, in accordance with the conditions set out in article 150.6.1.7 Authorizes a change of geographical group if it is so requested by a member country, taking into account the views expressed by the member countries which are members of the geographical groups concerned.1.8 Creates or abolishes International Bureau posts financed by the regular budget, taking into account the restrictions imposed by the expenditure ceiling fixed.1.9 Decides on the contacts to be established with member countries in order to carry out its functions.1.10 After consulting the Postal Operations Council, decides on the relations to be established with the organizations which are not observers within the meaning of article 105.1 and 105.2.1.1.11 Considers the reports by the International Bureau on UPU relations with other international bodies and takes the decisions which it considers appropriate on the conduct of such relations and the action to be taken on them.1.12 Designates in due course, after consulting the Postal Operations Council and the Secretary General, the specialized agencies of the United Nations, international organizations, associations, enterprises and qualified persons to be invited as ad hoc observers to specific meetings of Congress and its Committees when this is in the interest of the Union or the work of the Congress and instructs the Director General of the International Bureau to issue the necessary invitations.1.13 Designates the member country where the next Congress is to be held in the case provided for in article 101.3.1.14 Determines in due course and after consulting the Postal Operations Council the number of Committees required to carry out the work of Congress, and specifies their functions.1.15 Designates, after consulting the Postal Operations Council and subject to the approval of Congress, the member countries prepared:1.15.1 to assume the vice-chairmanships of Congress and the chairmanships and vice-chairmanships of the Committees, taking as much account as possible of the equitable geographical distribution of the member countries; and1.15.2 to sit on the Restricted Committees of the Congress.1.16 Designates those of its members that will serve as members of the Consultative Committee.1.17 Considers and approves, within the framework of its competence, any action considered necessary to safeguard and enhance the quality of and to modernize the international postal service.1.18 Studies, at the request of Congress, the Postal Operations Council or member countries, administrative, legislative and legal problems concerning the Union or the international postal service; it shall be for the Council of Administration to decide, in the above-mentioned fields, whether it is expedient to undertake the studies requested by member countries between Congresses.1.19 Formulates proposals which shall be submitted for the approval either of Congress or of member countries in accordance with article 140.1.20 Submits subjects for study to the Postal Operations Council for examination in accordance with article 113.1.6.1.21 Reviews and approves, in consultation with the Postal Operations Council, the draft Strategy for presentation to Congress.1.22 Receives and discusses reports and recommendations from the Consultative Committee and considers recommendations from the Consultative Committee for submission to Congress.1.23 Provides control over the activities of the International Bureau.1.24 Approves the annual report on the work of the Union and the annual Financial Operating Reports prepared by the International Bureau and, where appropriate, furnishes observations on them.1.25 Establishes principles, as may be considered necessary, for the Postal Operations Council to take into account in its study of questions with major financial repercussions (charges, terminal dues, transit charges, basic airmail conveyance rates and the posting abroad of letter-post items), follows closely the study of these questions, and reviews and approves, for conformity with the aforementioned principles, Postal Operations Council proposals relating to these questions.1.26 Approves, within the framework of its competence, the recommendations of the Postal Operations Council for the adoption, if necessary, of regulations or of a new procedure until such time as Congress takes a decision in the matter.1.27 Considers the annual report prepared by the Postal Operations Council and any proposals submitted by the Council.1.28 Approves the four-yearly report prepared by the International Bureau in consultation with the Postal Operations Council, on the performance of member countries in respect of the execution of the Union Strategy approved by the preceding Congress, for submission to the following Congress.1.29 Establishes the framework for the organization of the Consultative Committee and concurs in the organization of the Consultative Committee, in accordance with the provisions of article 122.1.30 Establishes criteria for membership of the Consultative Committee and approves or rejects applications for membership in accordance with those criteria, ensuring that action on the applications is accomplished through an expedited process between meetings of the Council of Administration.1.31 Lays down the Financial Regulations of the Union.1.32 Lays down the rules governing the Reserve Fund.1.33 Lays down the rules governing the Special Fund.1.34 Lays down the rules governing the Special Activities Fund.1.35 Lays down the rules governing the Voluntary Fund.1.36 Lays down the Staff Regulations and the conditions of service of the elected officials.1.37 Lays down the Regulations of the Social Fund.1.38 Exercises, within the context of article 152, overall supervision of the creation and activities of user-funded subsidiary bodies.1.39 Adopts its Rules of Procedure and the amendments to those Rules.Article VI(Art. 108 amended)Organization of CA sessions1 At its constituent meeting, which shall be convened and opened by the Chairman of Congress, the Council of Administration shall elect four Vice-Chairmen from among its members and draw up its Rules of Procedure. The Chairman and four Vice-Chairmen shall be member countries from each of the five geographical groups of the Union.2 The Council of Administration shall meet twice a year, or additionally on an exceptional basis, at Union headquarters, in accordance with the relevant procedures set forth in its Rules of Procedure.3 The Chairman and Vice-Chairmen, and the Committee Chairmen, Co-Chairmen and Vice-Chairmen, of the Council of Administration shall form the Management Committee. This Committee shall prepare and direct the work of each session of the Council of Administration. It shall approve, on behalf of the Council of Administration, the annual report prepared by the International Bureau on the work of the Union and it shall take on any other task which the Council of Administration decides to assign to it or the need for which arises in the course of the strategic planning process.4 The Chairman of the Postal Operations Council shall represent that body at meetings of the Council of Administration when the agenda contains questions of interest to the Postal Operations Council.5 The Chairman of the Consultative Committee shall represent that organization at meetings of the Council of Administration when the agenda contains questions of interest to the Consultative Committee.Article VII(Art. 109 amended)Observers1 Observers1.1 To ensure effective liaison between the work of the two bodies, the Postal Operations Council may designate representatives to attend Council of Administration meetings as observers.1.2 Member countries of the Union which are not members of the Council, as well as the observers and ad hoc observers referred to in article 105, may participate in the plenary sessions and Committee meetings of the Council of Administration, without the right to vote.2 Principles2.1 For logistical reasons, the Council of Administration may limit the number of attendees per observer and ad hoc observer participating. It may also limit their right to speak during the debates.2.2 Observers and ad hoc observers may, at their request, be allowed to cooperate in the studies undertaken, subject to such conditions as the Council may establish to ensure the efficiency and effectiveness of its work. They may also be invited to chair standing groups and task forces when their experience or expertise justifies it. The participation of observers and ad hoc observers shall be carried out without additional expense for the Union.2.3 In exceptional circumstances, members of the Consultative Committee and ad hoc observers may be excluded from a meeting or a portion of a meeting or may have their right to receive documents restricted if the confidentiality of the subject of the meeting or document so requires. This restriction may be decided on a case-by-case basis by any body concerned or its Chair. The case-by-case situations shall be reported to the Council of Administration and to the Postal Operations Council when matters of interest to the Postal Operations Council are concerned. If it considers this necessary, the Council of Administration may subsequently review restrictions, in consultation with the Postal Operations Council where appropriate.Article VIII(Art. 110 amended)Reimbursement of travel expenses1 The travel expenses of each representative of each of the members of the Council of Administration participating in its meetings shall be borne by his member country. However, one representative of each of the member countries classified as developing or least developed countries according to the lists established, respectively, by the Council of Administration and the United Nations shall, except for meetings which take place during Congress, be entitled to reimbursement of the price of an economy class return air ticket or first class return rail ticket, or expenses incurred for travel by any other means, subject to the condition that the amount does not exceed the price of the economy class return air ticket. The same entitlement shall be granted to each member of its Committees or other bodies when these meet outside Congress and the sessions of the Council.Article IX(Art. 112 amended)Composition and functioning of the POC1 The Postal Operations Council shall consist of forty-eight members who shall exercise their functions during the period between successive Congresses.2 The members of the Postal Operations Council shall be elected by Congress on the basis of qualified geographical distribution. At least one third of the members of each geographical group shall be renewed at each Congress.3 Each member of the Postal Operations Council shall appoint its representative(s). The members of the Postal Operations Council shall take an active part in its work.4 The operational expenses of the Postal Operations Council shall be borne by the Union. Its members shall not receive any payment.5 The Postal Operations Council shall define, formalize and/or set up the standing groups, task forces, user-funded subsidiary bodies or other bodies to be established within its structure, with due regard being paid to the Union’s strategy and business plan adopted by Congress.Article X(Art. 113 amended)Functions of the POC1 The Postal Operations Council shall have the following functions:1.1 Coordinates practical measures for the development and improvement of international postal services.1.2 Takes, subject to Council of Administration approval within the framework of the latter’s competence, any action considered necessary to safeguard and enhance the quality of and to modernize the international postal service.1.3 Decides on the contacts to be established with member countries and their designated operators in order to carry out its functions.1.4 Takes the necessary steps to study and publicize the experiments and progress made by certain member countries and their designated operators in the technical, operational, economic and vocational training fields of interest to other member countries and their designated operators.1.5 Takes, in consultation with the Council of Administration, appropriate steps in the sphere of technical cooperation with all member countries of the Union and their designated operators and in particular with the new and developing countries and their designated operators.1.6 Examines any other questions submitted to it by a member of the Postal Operations Council, by the Council of Administration or by any member country or designated operator.1.7 Receives and discusses reports as well as recommendations from the Consultative Committee and, when matters of interest to the Postal Operations Council are involved, to examines and comments on recommendations from the Consultative Committee for submission to Congress.1.8 Designates those of its members that will serve as members of the Consultative Committee.1.9 Conducts the study of the most important operational, commercial, technical, economic and technical cooperation problems which are of interest to all member countries or their designated operators, including questions with major financial repercussions (charges, terminal dues, transit charges, airmail conveyance rates, parcel-post rates, and the posting abroad of letter-post items), and prepares information, opinions and recommendations for action on them.1.10 Provides input to the Council of Administration for the development of the draft Union Strategy and draft quadrennial business plan to be submitted to Congress.1.11 Studies teaching and vocational training problems of interest to member countries and their designated operators, as well as to the new and developing countries.1.12 Studies the present position and needs of the new and developing countries and prepares appropriate Recommendations on ways and means of improving their postal services.1.13 Revises the Regulations of the Union within six months following the end of the Congress unless the latter decides otherwise; the Postal Operations Council may also amend the said Regulations at other sessions; in both cases, the Postal Operations Council shall be subject to Council of Administration guidance on matters of fundamental policy and principle.1.14 Formulates proposals which shall be submitted for the approval either of Congress or of member countries in accordance with article 140; the approval of the Council of Administration is required when these proposals concern questions within the latter’s competence.1.15 Examines, at the request of a member country, any proposal which that member country forwards to the International Bureau under article 139, prepares observations on it and instructs the International Bureau to annex these observations to the proposal before submitting it for approval to the member countries.1.16 Recommends, if necessary, and where appropriate after approval by the Council of Administration and consultation of all the member countries, the adoption of regulations or of a new procedure until such time as Congress takes a decision in the matter.1.17 Prepares and issues, in the form of recommendations to member countries and their designated operators (or as binding provisions if the Acts of the Union so provide), standards for technological, operational and other processes within its competence where uniformity of practice is essential; it shall similarly issue, as required, amendments to standards it has already set.1.18 Establishes the framework for the organization of user-funded subsidiary bodies and concurs in the organization of these bodies in accordance with the provisions of article 152.1.19 Receives and discusses reports from the user-funded subsidiary bodies on an annual basis.1.20 Adopts its Rules of Procedure and the amendments to those Rules.Article XI(Art. 114 amended)Organization of POC sessions1 At its first meeting, which shall be convened and opened by the Chairman of Congress, the Postal Operations Council shall choose from among its members a Chairman and four Vice-Chairmen, and the Committee Chairmen/Vice-Chairmen/Co-Chairmen, and draw up its Rules of Procedure. However, one representative of each of the member countries considered to be one of the least developed countries according to the list established by the United Nations shall, except for meetings which take place during Congress, be entitled to reimbursement of the price of an economy class return air ticket or first class return rail ticket, or expenses incurred for travel by any other means, subject to the condition that the amount does not exceed the price of the economy class return air ticket.Article XIV(Art. 117bis added)Article 117bisCoordination Committee for the Permanent Bodies of the Union1 The Chairman of the CA, the Chairman of the POC and the Director General of the International Bureau shall form the Coordination Committee for the Permanent Bodies of the Union (CCoord).2 The CCoord shall have the following attributions and functions:2.1 Contribute to the coordination of the work of the permanent bodies of the Union;2.2 Meet, when needed, in order to discuss important questions relating to the Union and the postal service and provide the Union’s bodies with an evaluation of such questions;2.3 Ensure proper implementation of the strategic planning process so that all decisions on the Union’s activities are taken by the appropriate bodies in accordance with the respective responsibilities as specified in the Acts of the Union.3 On convocation by the Chairman of the CA, the CCoord shall meet twice a year, at Union headquarters. The date and place of the meetings shall be fixed by the Chairman of the CA in agreement with the Chairman of the POC and the Director General of the International Bureau.Article XV(Art. 123 amended)Representatives of the Consultative Committee at the Council of Administration, the Postal Operations Council and Congress1 In order to ensure effective liaison with the bodies of the Union, the Consultative Committee may designate representatives to attend meetings of Congress, the Council of Administration, and the Postal Operations Council, and their respective Committees, as observers without the right to vote.2 Members of the Consultative Committee are invited to plenary sessions and Committee meetings of the Council of Administration and the Postal Operations Council in accordance with article
- They may also participate in the work of standing groups and task forces under terms established in articles 109.2.2 and 115.2.2.3 The Chairman of the Council of Administration and the Chairman of the Postal Operations Council shall represent those bodies at meetings of the Consultative Committee when the agenda of such meetings contains questions of interest to those bodies.Article XVI(Art. 127 amended)Duties of the Director General0bis The Director General shall be the legal representative of the Union.1 The Director General shall organize, administer and direct the International Bureau.2 Regarding the classification of posts, appointments and promotions:2.1 the Director General shall be empowered to classify posts in grades G 1 to D 2 and to appoint and promote officials in those grades.2.2 for appointments in grades P 1 to D 2, he shall consider the professional qualifications of the candidates recommended by the member countries of which the candidates are nationals or in which they exercise their professional activities, taking into account equitable geographical distribution with respect to continents and languages. D 2 posts shall as far as possible be filled by candidates from different regions and from regions other than those from which the Director General and Deputy Director General originate, bearing in mind the paramount consideration of the efficiency of the International Bureau. In the case of posts requiring special qualifications, the Director General may seek applications from outside;2.3 he shall also consider, for the appointment of a new official, that, in principle, persons occupying grade D 2, D 1 and P 5 posts must be nationals of different member countries of the Union;2.4 for the promotion of an official of the International Bureau to grades D 2, D 1 and P 5, he shall not be bound to apply the same principle as under 2.3;2.5 the requirements of equitable geographical and language distribution shall rank behind merit in the recruitment process;2.6 the Director General shall inform the Council of Administration once a year of appointments and promotions in grades P 4 to D 2.3 Furthermore, the Director General shall have the following duties:3.1 acts as depositary of the Acts of the Union and as intermediary in the procedure of accession and admission to and withdrawal from the Union;3.2 notifies the decisions taken by Congress to all the Governments of member countries;3.3 all member countries and their designated operators of the Regulations drawn up or revised by the Postal Operations Council;3.4 prepares the draft annual budget of the Union at the lowest possible level consistent with the requirements of the Union and submits it in due course to the Council of Administration for consideration; communicates the budget to the member countries of the Union after approval by the Council of Administration and executes it;3.5 executes the specific activities requested by the bodies of the Union and those assigned to him by the Acts;3.6 takes action to achieve the objectives set by the bodies of the Union, within the framework of the established policy and the funds available;3.7 submits suggestions and proposals to the Council of Administration or to the Postal Operations Council;3.8 following the close of Congress, submits proposals to the Postal Operations Council concerning changes to the Regulations required as a result of Congress decisions, in accordance with the Rules of Procedure of the Postal Operations Council;3.9 prepares, for the Council of Administration and on the basis of directives issued by the Councils, the draft Union Strategy and draft quadrennial UPU business plan to be submitted to Congress;3.10 prepares, for approval by the Council of Administration, a four-yearly report on the member countries’ performance in respect of the Union Strategy approved by the preceding Congress, which will be submitted to the following Congress;3.11 (Deleted.)3.12 acts as an intermediary in relations between:3.12.1 the UPU and the Restricted Unions;3.12.2 the UPU and the United Nations;3.12.3 the UPU and the international organizations whose activities are of interest to the Union;3.12.4 the UPU and the international organizations or the associations or enterprises that the bodies of the Union wish to consult or associate with their work;3.13 assumes the duties of Secretary General of the bodies of the Union and supervises in this capacity, taking into account the special provisions of these General Regulations, in particular:3.13.1 the preparation and organization of the work of the Union’s bodies;3.13.2 the preparation, production and distribution of documents, reports and minutes;3.13.3 the functioning of the secretariat at meetings of the Union’s bodies;3.14 attends the meetings of the bodies of the Union and takes part in the discussions without the right to vote, with the possibility of being represented.Article XVII(Art. 130 amended)Preparation and distribution of documents of the Union bodies1 The International Bureau shall prepare and make ava
