ANGLICAN CHURCH (PROPERTY) [CAP. 19. 1 CHAPTER 19 ANGLICAN CHURCH (PROPERTY) ORDINANCE To make some provisions concerning certain property destined for Divine Service according to the rites of the Anglican Church, and other property connected therewith. (21st June, 1876)* Enacted by ORDINANCE VI of 1876 as amended by Ordinance XIV of 1895 and Act XXXIX of 1972. l. This Ordinance may be cited as the Anglican Church (Property) Ordinance. Short title. Amended by: XXXIX.1972.2. 2. (1) The right of ownership over the church situate in Valletta, between Piazza Celsi, Strada Ponente, and Strada Teatro †, built at the expense of Her late Majesty Queen Adelaide, on a site granted by the Government of Malta, and destined for Divine Service according to the rites of the Anglican Church, is, by virtue of this Ordinance, transferred to this church as now established. Property in Valletta vested in the Anglican Church as now established. Amended by: XIV.1895.1; XXXIX.1972.3. (2) The ownership of the registers, library, plate and furniture appertaining to the said church, are hereby vested in the said Anglican Church. 3. The said Anglican Church is in virtue of this Ordinance also vested with the right of ownership over the tenement situate in Ridolfo Street, within the limits of Sliema, of which Jane Trower, by a deed dated the seventh of April eighteen hundred and sixtysix, received by Notary George Domenico Page, had made a donation to the Episcopal See of Gibraltar and, for that See, to the Anglican Bishops who would successively occupy the said See; and the said Anglican Church is moreover vested with the right of ownership over the church which, on a portion of the said tenement, has since, at the expense, wholly or partly, of the said Jane Trower, or of Bishop Dr. Walter John Trower, then in possession of the See of Gibraltar, been erected for Divine Service according to the rites of the said Anglican Church. Property in Sliema vested in the Anglican Church. 4. The said Anglican Church is, in virtue of this Ordinance, likewise vested with the right of ownership over a portion, and the dominium utile over the other portion, of the lands situate in Sliema, between the said Ridolfo Street and Tonna Street, which, by a deed dated the eighteenth of February eighteen hundred and seventy-three, received by the said Notary George Domenico Page, the late Bishop Charles Amyand Harris, then in possession of the said See of Gibraltar, had purchased with his own money and of which he had made a donation to the same See. Other property in Sliema vested in the Anglican Church. *See Proclamation No. 11 of 1876. †Now Independence Square, West Street, and Old Theatre Street, respectively. 2 CAP. 19.] ANGLICAN CHURCH (PROPERTY) Exemption from operation of Mortmain Law. Amended by: XXXIX.1972.4. Cap. 201. 5. The said Anglican Church is in virtue of this Ordinance authorized to hold and enjoy the immovable property mentioned in the foregoing articles, without being bound to sell or transfer the same, notwithstanding any provision of the Mortmain Act. Powers vested in Bishop of Gibraltar exercisable by Anglican Bishop. 6. Any right or power which, by virtue of either of the deeds of donation mentioned in articles 3 and 4, was vested in or granted to the Bishop of Gibraltar for the time being, is hereby transferred to the Anglican Bishop for the time being, who by mandate or other act of the competent authority, may be authorized to exercise episcopal functions within buildings situate in Malta and destined for Divine Service according to the rites of the Anglican Church. Saving clause. 7. Saving the provisions of articles 3, 4 and 6, nothing in this Ordinance contained shall affect any disposition expressed in any of the deeds of donation mentioned in those articles where such disposition, independently of this Ordinance, would be valid according to law.
