Diese Beurteilung (der Unzumutbarkeit der Benennung des datenschutzrechtlich Verantwortlichen durch den Antragsteller) wird vom VwGH auf seine Vertretbarkeit hin überprüft (vgl. zu all dem VwGH 5.6.2025, Ra 2024/04/0008, Rn. 26 ff).Die DSB (bzw. in weiterer Folge das BVwG) hat zu beurteilen, ob dem Antragsteller die Benennung des Beschwerdegegners grundsätzlich zumutbar war.
