Article 15
(1)(c) of Regulation No 44/2001, and second, whether the fact that those sites can be consulted on the internet is sufficient for that activity to be regarded as such. 48 As is apparent from the orders for reference, this question is asked in the context of two separate disputes. 49 In Case C‑585/08, the dispute involves a trader, Reederei Karl Schlüter, which concluded a contract with a consumer, Mr Pammer, domiciled in a Member State other than that in which that company is established. It does not appear to be in dispute that the contract falls within the scope of the trader's commercial activities. 50 According to the observations submitted to the Court by Mr Pammer, he found out that the voyage existed by consulting the intermediary company's website on which various voyages were advertised. He initially contacted the intermediary company by email to obtain further information and subsequently booked the voyage by post. 51 In Case C-144/09, the dispute involves a trader, Hotel Alpenhof, which concluded a contract falling within the scope of its commercial activities with a consumer, Mr Heller, domiciled in a Member State other than that in which the hotel concerned is located. It is not in dispute that Mr Heller found out that the hotel existed and made and confirmed his reservation at a distance, by means of the internet. 52 In these two cases, the Oberster Gerichtshof is seeking to decide whether the trader directed its activity to the Member State of the consumer's domicile,

(1)(c) of Regulation No 44/2001, in order to determine which court has jurisdiction to give judgment on the disputes in the main proceedings. 53 Article 15
(1)(c) of Regulation No 44/2001 constitutes a derogation both from the general rule of jurisdiction laid down in Article 2
(1)of the regulation, which confers jurisdiction upon the courts of the Member State in which the defendant is domiciled, and from the rule of special jurisdiction for contracts, set out in Article 5
(1)of the regulation, under which jurisdiction lies with the courts for the place of performance of the obligation in question (see, to this effect, Case C-464/01 Gruber [2005] ECR I‑439, paragraph 34). 54 If the trader's activity were to be regarded as 'directed to' the Member State of the consumer's domicile,

(1)(c) of Regulation No 44/2001, it would follow, in Case C‑585/08 between Mr Pammer and Reederei Karl Schlüter, that the Austrian courts would have jurisdiction, in accordance with Article 16
(1)of the regulation, should the consumer elect to bring the dispute before them and not before the courts of the Member State in which the defendant, Reederei Karl Schlüter, is established, that is to say, the German courts. In Case C-144/09, since the consumer, Mr Heller, is domiciled in Germany, the courts of that State would have jurisdiction, in accordance with Article 16
(2)of the regulation, and not those of the Member State in which Hotel Alpenhof is located, which is Austria. 55 Regulation No 44/2001 does not define the concept in Article 15
(1)(c) of activity 'directed to' the Member State of the consumer's domicile. This concept, like those in Article 13 of the Brussels Convention, which Article 15 of the regulation replaces, must be interpreted independently, by reference principally to the system and objectives of the regulation, in order to ensure that it is fully effective (see Case C-96/00 Gabriel [2002] ECR I-6367, paragraph 37). 56 It is necessary in this connection, as indicated in recital 19 in the preamble to Regulation No 44/2001, to have regard to the interpretation which the Court has placed on Article 13 of the Brussels Convention, whilst taking account of the changes which have been made to that article by the regulation. 57 The Court has already held that, in the system established by Regulation No 44/2001, Article 15
(1)(c) occupies, as it is clear from recital 13 in the preamble to the regulation, the same place and fulfils the same function of protecting the weaker party as does point 3 of the first paragraph of Article 13 of the Brussels Convention (Case C-180/06 Ilsinger [2009] ECR I‑3961, paragraph 41). 58 As regards the latter provision, the Court has indeed repeatedly held that the special rules introduced by the provisions of the Brussels Convention on jurisdiction over consumer contracts serve to ensure adequate protection for the consumer, as the party deemed to be economically weaker and less experienced in legal matters than the other, commercial, party to the contract (see, inter alia, Gruber, paragraph 34, and Case C-27/02 Engler [2005] ECR I‑481, paragraph 39). 59 However, the Court has also stated - in Ilsinger, paragraph 48 - that the wording of Article 15
(1)of Regulation No 44/2001 is not identical in every respect to that of the first paragraph of Article 13 of the Brussels Convention. In particular, it held in paragraph 50 of that judgment that the conditions for application which consumer contracts must fulfil are now worded more generally than they were, in order to ensure better protection for consumers with regard to new means of communication and the development of electronic commerce. 60 The European Union legislature has thus removed the conditions requiring, first, the trader to have addressed a specific invitation to the consumer or to have advertised in the State of the consumer's domicile and, second, the consumer to have taken in that State the steps necessary for the conclusion of the contract, replacing them with conditions applicable to the trader alone. The trader must pursue its commercial activities in the Member State of the consumer's domicile or, by any means, direct such activities to that Member State or to several States including that Member State, and the contract must fall within the scope of such activities. 61 The wording of Article 15
(1)(c) must be considered to encompass and replace the previous concepts of a 'specific invitation addressed' to the consumer and 'advertising', covering, as the words 'by any means' indicate, a wider range of activities. 62 This change, which strengthens consumer protection, was made because of the development of internet communication, which makes it more difficult to determine the place where the steps necessary for the conclusion of the contract are taken and at the same time increases the vulnerability of consumers with regard to traders' offers. 63 It is not clear, however, from Article 15
(1)(c) of Regulation No 44/2001 whether the words 'directs such activities to' refer to the trader's intention to turn towards one or more other Member States or whether they relate simply to an activity turned de facto towards them, irrespective of such an intention. 64 The question which this raises is whether intention on the part of the trader to target one or more other Member States is required and, if so, in what form such an intention must manifest itself. 65 That intention is implicit in certain methods of advertising. 66 The Court has held that 'advertising' and 'specific invitation addressed'
Article 13
of the Brussels Convention cover all forms of advertising carried out in the Contracting State in which the consumer is domiciled, whether disseminated generally by the press, radio, television, cinema or any other medium, or addressed directly, for example by means of catalogues sent specifically to that State, as well as commercial offers made to the consumer in person, in particular by an agent or door-to-door salesman (Gabriel, paragraph 44). 67 The classic forms of advertising expressly referred to in the previous paragraph involve the outlay of, sometimes significant, expenditure by the trader in order to make itself known in other Member States and they demonstrate, on that very basis, an intention of the trader to direct its activity towards those States. 68 That intention is not, on the other hand, always present in the case of advertising by means of the internet. Since this method of communication inherently has a worldwide reach, advertising on a website by a trader is in principle accessible in all States, and, therefore, throughout the European Union, without any need to incur additional expenditure and irrespective of the intention or otherwise of the trader to target consumers outside the territory of the State in which it is established. 69 It does not follow, however, that the words 'directs such activities to' must be interpreted as relating to a website's merely being accessible in Member States other than that in which the trader concerned is established. 70 Whilst there is no doubt that the aim of Articles 15
(1)(c) and 16 of Regulation No 44/2001 is to protect consumers, that does not imply that that protection is absolute (see, by analogy, with regard to Council Directive 85/577/EEC of 20 December 1985 to protect the consumer in respect of contracts negotiated away from business premises (OJ 1985 L 372, p. 31), Case C-215/08 E. Friz [2010] ECR I-0000, paragraph 44). 71 As the Advocate General has observed in point 64 of her Opinion, if that had been the intention of the European Union legislature, it would have laid down as a condition for the application of the rules relating to consumer contracts not the 'directing of activities to a Member State' but the mere existence of the website. 72 Whilst seeking to confer further protection on consumers, the European Union legislature did not go as far as to lay down that mere use of a website, which has become a customary means of engaging in trade, whatever the territory targeted, amounts to an activity 'directed to' other Member States which triggers application of the protective rule of jurisdiction referred to in Article 15
(1)(c) of Regulation No 44/2001. 73 It is accordingly clear from the proposal for a regulation that is mentioned in paragraph 43 of the present judgment that the European Union legislature rejected a suggestion by the Commission seeking the insertion, in the preamble of Regulation No 44/2001, of a recital according to which the marketing of goods or services by electronic means accessible in a Member State constitutes an activity 'directed to' that State. 74 This interpretation is also borne out by the joint declaration of the Council and the Commission at the time of the adoption of Regulation No 44/2001, reproduced in recital 24 in the preamble to Regulation No 593/2008, according to which the mere fact that a website is accessible is not sufficient for Article 15
(1)(c) of Regulation No 44/2001 to be applicable. 75 Consequently, it must be held that, in order for Article 15
(1)(c) of Regulation No 44/2001 to be applicable, the trader must have manifested its intention to establish commercial relations with consumers from one or more other Member States, including that of the consumer's domicile. 76 It must therefore be determined, in the case of a contract between a trader and a given consumer, whether, before any contract with that consumer was concluded, there was evidence demonstrating that the trader was envisaging doing business with consumers domiciled in other Member States, including the Member State of that consumer's domicile, in the sense that it was minded to conclude a contract with those consumers. 77 Such evidence does not include mention on a website of the trader's email address or geographical address, or of its telephone number without an international code. Mention of such information does not indicate that the trader is directing its activity to one or more other Member States, since that type of information is, in any event, necessary to enable a consumer domiciled in the Member State in which the trader is established to make contact with it. 78 Furthermore, some of that information has become mandatory in the case of services offered on line. As the Court has already held, by virtue of Article 5
(1)(c) of Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market ('Directive on electronic commerce') (OJ 2000 L 178, p. 1), a service provider is required to supply to recipients of the service before the conclusion of a contract with them, in addition to its email address, other information which allows the service provider to be contacted rapidly and communicated with in a direct and effective manner (Case C-298/07 Bundesverband der Verbraucherzentralen und Verbraucherverbände [2008] ECR I‑7841, paragraph 40). That obligation applies whichever the Member State to which the trader directs its activity and even if its activity is directed solely to the Member State in which it is established. 79 It follows that the distinction drawn by certain governments and certain parties that submitted observations to the Court between websites enabling the trader to be contacted electronically, indeed even the contract to be concluded on line by means of an 'interactive' site, and websites not offering that possibility, a distinction according to which only the former are to be included in the category of sites that enable pursuit of an activity 'directed to' other Member States, is not decisive. If a geographical address or other contact details for the trader are given, the consumer can in fact contact it in order to conclude a contract. This opportunity for contact exists, whether or not the trader has envisaged doing business with consumers domiciled in Member States other than that in which it is established. 80 Among the evidence establishing whether an activity is 'directed to' the Member State of the consumer's domicile are all clear expressions of the intention to solicit the custom of that State's consumers. 81 Clear expressions of such an intention on the part of the trader include mention that it is offering its services or its goods in one or more Member States designated by name. The same is true of the disbursement of expenditure on an internet referencing service to the operator of a search engine in order to facilitate access to the trader's site by consumers domiciled in various Member States, which likewise demonstrates the existence of such an intention. 82 However, a finding that an activity is 'directed to' other Member States does not depend solely on the existence of such patent evidence. In this connection, it should be noted that, by its legislative resolution on the proposal for a regulation that is referred to in paragraph 43 of the present judgment (OJ 2001 C 146, p. 101), the European Parliament rejected wording stating that the trader had to have 'purposefully directed his activity in a substantial way' to other Member States or to several countries, including the Member State of the consumer's domicile. Such wording would have resulted in a weakening of consumer protection by requiring proof of an intention on the part of the trader to develop activity of a certain scale with those other Member States. 83 Other items of evidence, possibly in combination with one another, are capable of demonstrating the existence of an activity 'directed to' the Member State of the consumer's domicile. In cases such as those in the main proceedings, the following features, which have been invoked before the Court and the list of which is not exhaustive, would, subject to the relevant national court ascertaining that they are present, constitute evidence of an activity 'directed to' one or more other Member States

(1)(c) of Regulation No 44/2001: the international nature of the activity at issue, such as certain tourist activities; mention of telephone numbers with the international code; use of a top-level domain name other than that of the Member State in which the trader is established, for example '.de', or use of neutral top-level domain names such as '.com' or '.eu'; the description of itineraries from one or more other Member States to the place where the service is provided; and mention of an international clientele composed of customers domiciled in various Member States, in particular by presentation of accounts written by such customers. 84 So far as concerns the language or the currency used, the joint declaration of the Council and the Commission mentioned in paragraph 11 of the present judgment and reproduced in recital 24 in the preamble to Regulation No 593/2008 states that they do not constitute relevant factors for the purpose of determining whether an activity is directed to one or more other Member States. That is indeed true where they correspond to the languages generally used in the Member State from which the trader pursues its activity and to the currency of that Member State. If, on the other hand, the website permits consumers to use a different language or a different currency, the language and/or currency can be taken into consideration and constitute evidence from which it may be concluded that the trader's activity is directed to other Member States. 85 In a case such as that between Hotel Alpenhof and Mr Heller, there would appear to be several items of evidence amongst those set out in paragraphs 83 and 84 of the present judgment such as to demonstrate that the trader directed its activity to one or more Member States other than the Republic of Austria. It is, however, for the relevant national court to ascertain that that is the case. 86 Hotel Alpenhof contends, however, that the contract with the consumer is concluded on the spot and not at a distance, as the room keys are handed over and payment is made on the spot, and that accordingly Article 15
(1)(c) of Regulation No 44/2001 cannot apply. 87 In that regard, the fact that the keys are handed over to the consumer and that payment is made by him in the Member State in which the trader is established does not prevent that provision from applying if the reservation was made and confirmed at a distance, so that the consumer became contractually bound at a distance. 88 In Case C‑585/08, between Mr Pammer and Reederei Karl Schlüter, the referring court has been able to provide only a small amount of information concerning that company's activity, the intermediary company's site and the relationship between the two companies. 89 The fact that the website is the intermediary company's and not the trader's site does not preclude the trader from being regarded as directing its activity to other Member States, including that of the consumer's domicile, since that company was acting for and on behalf of the trader. It is for the relevant national court to ascertain whether the trader was or should have been aware of the international dimension of the intermediary company's activity and how the intermediary company and the trader were linked. 90 The international nature of the activity in question, namely the organisation of voyages by freighter from Europe to the Far East, constitutes relevant evidence, but does not in itself enable it to be concluded that the trader directed its activity to other Member States, including that of the consumer's domicile. The trader's activity would involve such a feature even if the trader, by itself or through the intermediary company, pursued its activity only in Germany and did not direct it to other Member States. Consequently, other evidence, in particular from among the evidence referred to in paragraphs 83 and 84 of the present judgment, must necessarily be present, such as mention of telephone numbers with the international code, the use of a language other than German or mention of an international clientele composed of customers domiciled in various Member States, in order to establish that the trader was envisaging doing business with customers domiciled in the European Union, whatever the Member State. 91 On the other hand, mention of the email address or geographical address of the intermediary company or the trader does not constitute relevant evidence, as is clear from paragraph 77 of the present judgment. The same is true of use of the German language and the ability to book a voyage in that language when that is the trader's language. 92 In view of the foregoing considerations, the answer to be given to the referring court is that, in order to determine whether a trader whose activity is presented on its website or on that of an intermediary can be considered to be 'directing' its activity to the Member State of the consumer's domicile,

(1)(c) of Regulation No 44/2001, it should be ascertained whether, before the conclusion of any contract with the consumer, it is apparent from those websites and the trader's overall activity that the trader was envisaging doing business with consumers domiciled in one or more Member States, including the Member State of that consumer's domicile, in the sense that it was minded to conclude a contract with them. 93 The following matters, the list of which is not exhaustive, are capable of constituting evidence from which it may be concluded that the trader's activity is directed to the Member State of the consumer's domicile, namely the international nature of the activity, mention of itineraries from other Member States for going to the place where the trader is established, use of a language or a currency other than the language or currency generally used in the Member State in which the trader is established with the possibility of making and confirming the reservation in that other language, mention of telephone numbers with an international code, outlay of expenditure on an internet referencing service in order to facilitate access to the trader's site or that of its intermediary by consumers domiciled in other Member States, use of a top-level domain name other than that of the Member State in which the trader is established, and mention of an international clientele composed of customers domiciled in various Member States. It is for the national courts to ascertain whether such evidence exists. 94 On the other hand, the mere accessibility of the trader's or the intermediary's website in the Member State in which the consumer is domiciled is insufficient. The same is true of mention of an email address and of other contact details, or of use of a language or a currency which are the language and/or currency generally used in the Member State in which the trader is established. Στην παρούσα περίπτωση υπάρχει συζητήσιμη υπόθεση ότι η συμφωνία είναι καταναλωτική. Η ενάγουσα είναι πιστωτικό ίδρυμα και παρέχει πιστωτικές διευκολύνσεις. Φαίνεται να υπάρχει άλλη εταιρεία που έχει την ίδια ονομασία με την ενάγουσα με έδρα την Αγγλία και είναι στην Αγγλία που η εναγόμενη 2 υπέγραψε την συμφωνία. Δεν έχω μαρτυρία για την σχέση μεταξύ των δύο εταιρειών αλλά η ύπαρξη εταιρείας με ονομασία Bank of Cyprus UK είναι αποδεικτικό στοιχείο που μπορώ να λάβω υπόψη μου για να κρίνω ότι η ενάγουσα εταιρεία κατευθύνει έστω και μέσου συνεργάτιδας εταιρείας τις δραστηριότητες της στο κράτος μέλος. Ακόμη όμως και να αποδειχθεί ότι η εταιρεία κατευθύνει τις δραστηριότητες της στο Ηνωμένο Βασίλειο για να επικαλείται ο αιτητής τις διατάξεις του άρθρου 15c πρέπει να αποδείξει και ότι η συγκεριμένη συμφωνία ήταν ως αποτέλεσμα αυτών των δραστηριοτήτων. Εδώ υπάρχει πραγματική διάσταση των μερών σε σχέση με τα γεγονότα διότι η ενάγουσα τράπεζα ισχυρίζεται ότι δεν είναι η ίδια που προσέγγισε την εναγόμενη 2 για την σύναψη του δανείου. Το δάνειο συνήφθηκε από την εναγόμενη 1 που είναι εταιρεία με έδρα το Παραλίμνι και είναι αυτή που απευθύνθηκε στην τράπεζα για δάνειο ώστε να αγοράσει ένα ακίνητο. Η εναγόμενη 2 είναι διευθύντρια της εναγόμενης 1 και γι' αυτό εγγυήθηκε τις υποχρεώσεις της εναγόμενης
- Οπότε δυνατόν να μην έχει εφαρμογή το άρθρο 15c εάν ήθελε αποδειχθεί ότι το δάνειο συνήφθηκε από την εναγόμενη 1 στην Κύπρο και μετά απλά έγινε η υπογραφή της συμφωνίας εγγύησης στην Αγγλία για σκοπούς διευκόλυνσης της εναγομένης
- Συνεπώς, ο αιτητής δεν έχει αποδέιξει ότι η συμφωνία αυτή είναι καταναλωτική. Παρόλο τούτο ο Κανονισμός 44/2001 προνοεί ότι έχει δικαιοδοσία το κράτος μέλος εκεί όπου ο εναγομενος διαμένει εκτός όπως προβλέπεται στον κανονισμό. Σκοπός του κανονισμού 44/2001 ως και επίσης της Σύμβασης των Βρυξελλών είναι ο καθορισμός της δικαιοδοσίας για την επίλυση αστικών και εμπορικών διαφορών μεταξύ κρατών μελών και όχι η ενοποίηση ή ρύθμιση των διαδικαστικών κανονισμών που διέπουν αυτές τις διαφορές σε κάθε κράτος μέλος. ( βλ. DFDS Torline[9]). Στην περίπτωση που κριθεί οριστικά ότι η συμφωνία δεν είναι καταναλωτικής φύσεως τότε δικαιοδοσία έχει το Κυπριακό Δικαστήριο διότι για ζητήματα που προκύπτουν από την εκτέλεση συμφωνίας δικαιοδοσία έχει σύμφωνα με το άρθρο 5 .
- (α) του κανονισμού 44-2001 το κράτος μέλος όπου θα γίνει εκτέλεση των υποχρεώσεων που προκύπτουν από την συμφωνία. Πρόκειται για απλή συμφωνία, το δάνειο και τα χρήματα χορηγήθηκαν στον πρωτοφειλέτη στην Κύπρο και η αποπληρωμή του δανείου θα γινόταν στο πιστωτικό ίδρυμα που είναι εγγεγραμμένο στην Κύπρο. Έχω εξηγήσει πιο πάνω γιατί δεν θεωρώ ότι η επίδικη συμφωνία δεν είναι καταναλωτική ως εκ τούτου δεν ευσταθεί η θέση της εναγόμενης 2 ότι Κυπριακά Δικαστήρια δεν έχουν δικαιοδοσία να επιλύσούν την διαφορά. Επιπρόσθετα, σύμφωνα με τους καθ'ων η αίτηση ο άλλος λόγος που Δικαστήρια της Κύπρου έχουν αποκλειστική δικαιοδοσία για την επίλυση της διαφοράς είναι επειδή με την αγωγή διεκδικούνται θεραπείες ειδικά εναντίον ακίνητης περιουσίας ως η παράγραφος 8 Γ Δ Ε Στ Η Θ και Ι της Έκθεσης Απαιτήσεως και το άρθρο 22 .1 του κανονισμού προνοεί ότι διαδικασία αντικείμενο της οποίας έχει την προώθηση αιτημάτων εναντίον ακίνητης ιδιοκτησίας που βρίσκεται στην επικράτεια της χώρας μπορεί να εγερθεί μόνο στα Δικαστήρια εκείνου του κράτους μέλους . (in rem proceedings). Η εναγόμενη 2 με έχει παραπέμψει σε νομολογία του Δικαστηρίου Κοινοτήτων για να με πείσει ανεπιτυχώς ότι το αντικείμενο αυτής της διαφοράς δεν είναι ακίνητη ιδιοκτησία και ως εκ τούτου για την επίδικη διαφορά δεν έχουν αποκλειστική δικαιοδοσία τα Κυπριακά Δικαστήρια. Στην υπόθεση Reichert v kockler[10] το Δικαστήριο Ευρωπαϊκών Κοινοτήτων επεξήγησε ότι δεν πρέπει να ερμηνευθεί φιλελεύθερα το άρθρο 16 του κανονισμού 44/2001 σε σχέση με την έννοια της διαδικασίας το αντικείμενο της οποίας είναι η ακίνητη περιουσία. Πρέπει να ερμηνευτεί περιοριστικά ώστε να καλύπτει μόνο τις περιπτώσεις όπου η διαδικασία πράγμα που έχει ως αντικείμενο και σκοπό την εφαρμογή και εκτέλεση δικαιωμάτων επί ακίνητης ιδιοκτησίας που βρίσκεται στο συγκεκριμένο κράτος μέλους. Ο λόγος που η διαταξη ερμηνεύεται περιοριστικά είναι επειδή το άρθρο προνοεί ότι αποκλειστική δικαιοδοσία έχει το Δικαστήριο όπου βρίσκεται η ακίνητη ιδιοκτησία σε διαφορετική περίπτωση ο διάδικος στερείται το δικαίωμα να επιλέξει που θα καταχωρήσει την αγωγή και σημαίνει ότι δυνατόν αυτός ο χώρος (FORUM) να μην είναι εκεί όπου διαμένει η εναγόμενη. Σκοπός του άρθρου όπως επεξηγήθηκε είναι ως εξής: ´Objective is that the courts of the locus rei sitae are the best placed for reasons of proximity to ascertain the facts satisfactorily and to apply the rules and practices which are generally those of the state in which the property is situated. exclusive jurisdiction actions which seek to determine extent content ownership or possession of immovable property or the existence of other rights in rem and to provide the holders of the right with the protection of the rights which attach to their interest.' Με την παρούσα αγωγή ζητούνται αναγνωριστικά δικαίωματα σε σχέση με την διάθεση ακίνητης περιουσία που βρίσκεται στην Κύπρο. Επίσης ζητούνται διατάγματα σε σχέση με την διάθεση της περιουσίας όπως είναι η ειδική εκτέλεση συμφωνίας ως αποτέλεσμα της οποίας θα γίνει εγγραφή δικαστική απόφασης επί της ακίνητης περιουσίας στο κτηματολόγιο που βρίσκεται στην επικράτεια της Κυπριακής Δημοκρατίας. Τα γεγονότα της Αγγλικής υπόθεσης στην οποία με παρέπεμψε η εναγόμενη 2 διαφέρουν εντελώς από τα γεγονότα της δικής μας υπόθεσης. Δεν είναι υπόθεση ανάλογη ως προς τα γεγονότα ώστε η υπόθεση Watt vs Alpha Panaretti Public Ltd.[11] να είναι καθοδηγητική για το ζήτημα που εγείρεται από την εναγόμενη σε σχέση με τα γεγονότα της δικής μας υπόθεσης. Στην Watt αγοραστές ακίνητης ιδιοκτησίας κινήσαν αγωγή εναντίον του πιστωτικού ιδρύματος επειδή ισχυρίσθηκαν ότι ήταν θύματα απάτης σε σχέση με την αγορά ακίνητης ιδιοκτησίας στην Κύπρο και παράλληλη σύναψη δανείου μαζί με την αγορά της περιουσίας. Σκοπός των αγοραστών ήταν η ακύρωση της συμφωνίας αγοράς ακίνητης ιδιοκτησίας εξαιτίας απάτης κατά την σύναψη της συμφωνίας. Το Αγγλικό Δικαστήριο ανέφερε ότι η διαδικασία στρεφόταν κατά προσώπων και όχι εναντίον περιουσίας. Το αποτέλεσμα της απόφασης θα ήταν ακύρωση της συμφωνίας και διεκδίκηση δικαιωμάτων κατά προσώπων. Στην περίπτωση που ηθελε πετύχει εκείνη η αγωγή η τράπεζα δυνατόν να έχανε την εξασφάλιση επί του δανείου. Όμως αυτή η διαφορά δεν ήταν διεκδικηση in rem αλλα in personam ως αποτέλεσμα του οποίου δυνατόν το πιστωτικό ίδρυμα να έχανε την εξασφάλιση του. Η δική μας περίπτωση είναι διαφορετική ως προς τα γεγονότα. Οι ενάγοντες έχουν κινήσει την αγωγή για να εισπράξουν αποζημιώσεις που προκύπτουν από παράβαση συμφωνίας. Ένα δικαίωμα που τους δίδεται στην περίπτωση παράβασης της συμφωνίας είναι να κινηθούν εναντίον εξασφάλισης σε μορφή ακίνητης ιδιοκτησίας. Η απαίτηση επομένως, στρέφεται απευθείας εναντίον ακίνητης ιδιοκτησίας (βλ. παράγραφο 7 της Έκθεσης Απαιτήσεων) και το παρόν Δικαστήριο σύμφωνα με τον κανονισμό 44/2001 έχει αποκλειστική δικαιοδοσία να χορηγήσει τις αιτούμενες θεραπείες σε σχέση με ακίνητη ιδιοκτησία που βρίσκεται στην επικράτεια της Κυπριακής Δημοκρατίας στην επαρχία Λάρνακας. Οπότε το παρόν Δικαστήριο έχει δικαιοδοσία να επιληφθεί της διαφοράς που αφορά παράβαση συμφωνίας της οποίας η εκτέλεση της θα γινόταν στην Κύπρο αλλά και αποκλειστική δικαιοδοσία επειδή η απαίτηση των εναγόντων στρέφεται και εναντίον ακίνητης πειρουσίας που βρίσκεται στην Κύπρο (in rem). Μόνο αυτό το Δικαστήριο μπορεί να χορηγήσει τις αιτούμενες θεραπείες και έτσι αυτή είναι μία από τις περιπτώσεις απόκλισης του γενικού κανόνα ότι αρμοδιότητα έχει το Δικαστήριο όπου διαμένει η εναγόμενη. Συνεπώς, εφόσον το Δικαστήριο έχει δικαιοδοσία να επιληφθεί της διαφοράς και μαλιστά αποκλειστική δικαιοδοσία συμφώνως του Ευρωπαϊκού Κανονισμού δεν τίθεται ζήτημα ουσιώδης παρατυπίας που να δικαιολογεί τον παραμερισμό του κλητήριου εντάλματος. Παραμένει όμως να εξετάσω κατά πόσο χρησιμοποιήθηκε η νενομισμένη διαδικασία επίδοσης της αγωγής εκτός της δικαιοδοσίας του Δικαστηρίου. Παρόλο που η εναγόμενη 2 έχει λάβει γνώση της αγωγής είναι ορθή η θέση της εναγόμενης 2 ότι θα μπορούσε να παραμερισθεί η επίδοση εάν αυτή έγινε παράτυπα. Όσον αφορά το ζήτημα της υποκατάστατης επίδοσης η απόφαση Φραγκίσκου ν Χριστίνα Γρηγορίου[12] ξεκαθάρισε ότι σε περιπτώσεις όπου ζητείται άδεια του Δικαστηρίου για επίδοση του κλητήριου εκτός της δικαιοδοσίας δεν έχει εφαρμογή η Δ.5 των θεσμών αλλά η Δ.
- Επομένως, δεν δικαιολογείται επίδοση εκτός της δικαιοδοσίας χωρίς να συντρέχουν ειδικοί λόγοι που να δικαιολογούν απόκλιση από τον τρόπο επίδοσης που προδιαγράφεται στην Δ.
- Το λεκτικό της Δ. 6 θ. 7 είναι επιτακτικό 'Where leave is given by the court or a Judge for service of a writ of summons or notice of such writ in any foreign country with which a convention relating to such service has been or shall be extended to Cyprus the following procedure SHALL, subject to any special terms in the convention, be adopted' επομένως το Δικαστήριο δεν έχει την διακριτική εξουσία να επιτρέψει υποκατάστατη επίδοση του κλητήριου. Στην απόφαση Consortia Europe Ltd. v Fregata Holdings Ltd. [13] ο Δικαστής Ναθαναήλ επεξήγησε ότι ο Ευρωπαϊκός Κανονισμός δεν αντικαθιστά τις ουσιώδης πρόνοιες της Δ.6 θ.6 διότι ο κανονισμός δεν καθορίζει τον τύπο ή την μορφή τον προς επίδοσης εγγράφων. Σκοπός του Κανονισμού 1393/2007 είναι η διευκόλυνση στην διαβίβαση εγγράφων ώστε η δικαστικές διαδικασίες να είναι πιο αποτελεσματικές και ταχύτερες με την καθίδρυση υπηρεσίας παραλαβής εγγράφων. Όμως αυτή η υπηρεσία δεν αντικαθιστά την Δ.6.θ6 απλά υποβοηθά και επιταχύνει την επίδοση εφόσον η διαβίβαση των εγγράφων δεν είναι ασύμβατη με τον θεσμό. Όμως οι προϋποθέσεις της Δ.6 δεν καταργούνται και προπαντός δεν αφαιρείται το δικαίωμα της εναγόμενης να υπερασπίσει τον εαυτό της μετά την επίδοση της ειδοποίησης του κλητήριου εκτός της επικράτειας της Κύπρου. Στην εναγόμενη 2 επιδόθηκε επιστολή με την οποία ειδοποιήθηκε για την ουσία της διαφοράς μεταξύ των μερών, των θεραπειών που ζητούνται αλλά και επεξήγηση στην εναγόμενη 2 ότι στην περίπτωση που δεν υπερασπίσει τον εαυτό της δυνατόν να εκδοθεί απόφαση εναντίον της. Επισυνάπτονται και αντίγραφα των εγγράφων της διαδικασίας συμπεριλαμβανομένου και αντίγραφο του κλητήριου εντάλματος. Συνεπώς, η εναγόμενη 2 έλαβε ειδοποίηση του κλητήριου εντάλματος και είχε την ευκαιρία αφού έλαβε γνώση της διαδικασίας να θέσει υπόψη του Δικαστηρίου τους λόγους για τους οποίους το κλητήριο ένταλμα θα πρέπει να παραμεριστεί και τους λόγους για τους οποίους το Δικαστήριο λανθασμένα επέτρεψε την επίδοση της ειδοποίησης με παραρτήματα έγγραφα εκτός της διακιοδοσίας του Δικαστηρίου. Η διαβίβαση των εγγράφων έγινε με βάση τον κανονισμό 1348/
- Απόδειξη αυτού είναι η επιστολή του Υπουργείου Δικαιοσύνης με την οποία κοινοποιήσαν στους ενάγοντες ότι η διαδικασία της επίδοσης ολοκληρώθηκε δέοντως σύμφωνα με τις διαδικασίες επίδοσης του κράτους μέλους όπου διαμένει η εναγόμενη
- Η εναγόμενη 2 δεν απέδειξε με απτά στοιχεία αυτά που αναφέρει στην ένορκη μαρτυρία. Αντιθέτως, υπάρχει γραπτή μαρτυρία ότι αποδέχθηκε την επίδοση χωρίς να εγείρει ζήτημα αποδοχής της επίδοσης ως ορίζει το άρθρο 8 του κανονισμού. Περαιτέρω, με επιστολή τους το δικηγορικό γραφείο έστειλε επιστολή που διαβιβάστηκε στην αρμόδια υπηρεσία με την οποία ζητούσαν όπως γίνει η επίδοση ως προνοείται από τον κανονισμό 1348/
- Αυτό το ζήτημα μπορούσε να εγερθεί μόνο κατά την διαδικασία παραλαβής των εγγράφων και μη αποδοχής για τον λόγο ότι η επίδοση δεν έγινε σε γλώσσα κατανοητή στον παραλήπτη των εγγράφων. Οπότε εφόσον η επιστολή με ειδοποίηση της αγωγής ήταν στην Αγγλική γλώσσα η εναγόμενη 2 δεν είχε ουσιαστικό λόγο να αρνηθεί την επίδοση. Περαιτέρω, ως σημείωσαν οι καθ' ων η αίτηση η εναγόμενη έχει διαφυλάξει όλα τα δικαιώματα μέσω του δικηγόρου με την καταχώρηση αυτής της αίτησης. Όμως δεν έχω διακρίνει να υπάρχει αντικανονικότητα στον τρόπο που έλαβε γνώση της αγωγής που δικαιολογεί τον παραμερισμό της επίδοσης για αντικανονικότητα. Η ορθή διαταγή για να δοθεί η θεραπεία που επιδιώκουν οι αιτητές είναι η Δ.16 θ.
- Δύναται να παραβλεφθεί αυτή η παρατυπία διότι στην περίπτωση που το Δικαστήριο διαπιστώσει ότι στερείται της δικαιοδοσίας να επιληφθεί της αγωγής τότε δεν υπάρχει βάσιμη αιτία αγωγής που να εκκρεμεί ενώπιον του Δικαστηρίου. Ομως η ορθή διαταγή για να δοθεί η θεραπεία που ζητούν οι αιτητές είναι η Δ.16 θ.
- Η αντίστοιχη Αγγλική διάταξη της Δ.16 κ.9 των θεσμών της Πολιτικής Δικονομίας είναι το O. 12 r.30 η οποία προνοεί τα ακόλουθα: "A defendant before appearing shall be at liberty, without obtaining an order to enteror entering a conditional appearance, to take out a summons in the Queen's Bench Division and in any other Division take out a summons or serve or serve notice of motion to set aside the service upon him of the writ or of notice of the writ, or to discharge the order authorizing such service." Σύμφωνα με το Annual Practice Book του 1958 ο εναγόμενος μπορεί να εγείρει θέματα δικαιοδοσίας ή παρατυπίας στην επίδοση του ή την έκδοση του κλητήριου εντάλματος προτού καταχωρήσει εμφάνιση στην αγωγή. Αυτά τα θέματα μπορούν να εγερθούν με την καταχώρηση αίτησης διά κλήσεως η οποία να συνοδεύεται από ένορκη δήλωση εις την οποία να εκτίθενται οι λόγοι για τους οποίους επιδιώκεται ο παραμερισμός του κλητήριου εντάλματος. Εάν ο εναγόμενος δεν εμφανισθεί στην αγωγή ή καταχωρήση εμφάνιση με διαμαρτυρία (conditional appearance) τότε του δίδεται το δικαίωμα να καταχωρήσει τέτοια αίτηση. Εάν το Δικαστήριο κατά την ακρόαση της αιτήσεως διαπιστώσει ότι συντρέχουν οι προαναφερόμενες προϋποθέσεις τότε το αποτέλεσμα είναι να εκδοθεί διαταγή για τον παραμερισμό του κλητήριου ένταλματος. Η συμφωνία δανείου έγινε εν μέρη στην Λάρνακα αλλά και στην Αγγλία αλλά η εκτέλεση και παράβαση της συμφωνίας έγινε στην Κύπρο. Συνεπώς, η βάση της αγωγής είναι η συμφωνία και έτσι φαίνεται να υπάρχει νομική βάση που να εστιάζει την δικαιοδοσία του Επαρχιακού Δικαστήριο Λαρνακας. Στην υπόθεση Karl Heinz Wunderlich v Ευθυβούλου[14] το εφετείο επεξήγησε ότι το Δικαστήριο δύναται να παραβλέψει ή να διορθώσει μία παράτυπη διαδικασία στην κατάλληλη περίπτωση αλλά δεν έχει την εξουσία να θεραπεύει θεμελιώδης παραλείψεις. Στην υπόθεση In re Hadjisoteriou[15] το Εφετείο δεν θεώρησε ότι η μη συμπερίληψη του άρθρου 9 του περί Πολτικής Δικονομίας Νόμου Κεφ. 9 στην νομική βάση της αίτησης ήταν δε ουσιώδης σφάλμα που να οδηγούσε στην ακύρωση της διαδικασία και λέχθηκε στα σχόλια της απόφασης ότι γενικά μη συμμόρφωση στους θεσμούς της πολιτικής δικονομίας θα πρέπει να θεωρηθεί παρατυπία στην διαδικασία που διορθώνεται. Όπως έχει αναφερθεί πιο πάνω δεν φαίνεται να δημιουργείται πρόβλημα δικαιοδοσίας του Δικαστηρίου με βάση των πραγματικών παραστάσεων που εμφαίνονται στην αίτηση και ένσταση. Όμως ακόμη και εάν θα μπορούσε να θεωρηθεί η επίδοση της αγωγής παράτυπη δεν θεωρώ ότι αυτός είναι ικανοποιητικός λόγος να ακυρωθεί η διαδικασία και να παραμεριστεί η επίδοση του Κλητήριου Εντάλματος. Αυτή είναι κατάλληλη περίπτωση για την εφαρμογή της Δ.64 θ.1 για να διορθωθεί η παρατυπία και να αποφευχθεί η περαιτέρω καθυστέρηση στην διαδικασία. Η αντίστοιχη Αγγλική Διάταξη της Δ.16 θ. 9 είναι το O. 12 r.
- Σύμφωνα με το Annual Practice Book 1958 στην σελίδα 199 αναφέρονται τα ακόλουθα αναφορικά με εμφάνιση του εναγόμενου υπό διαμαρτυρία. 'A conditional appearance under protest is a complete appearance to the action for all purposes, subject only to the right reserved by the defendant to apply to set aside the writ or the service thereof , on any ground which he can sustain. A defendant has the right to appear conditionally where he has a bone fide intention to dispute the jurisdiction of the Court. The leave of the master is required merely to prevent such a proceeding from being abused e.g. where the condition is not inserted in good faith and merely for delay.' (ελεύθερη μετάφραση) «Η εμφάνιση υπό διαμαρτυρία είναι κανονική εμφάνιση στην διασικασία υπό την επιφύλαξη που έχει θέσει ο εναγόμενος με την αίτηση του να παραμείισει το κλητήριο ένταλμα ή την επίδοση του κλητήριου εντάλματος. Ο εναγόμενος έχει το δικαίωμα να εμφανισθεί υπό διαμαρτυρία εκεί όπου έχει καλή τι πίστη πρόθεση να αμφισβητήσει την δικαιοδοσία του Δικαστηρίου. Η άδεια του Δικαστηρίου χρειάζεται διά να μην επιτραπεί η κατάχρηση αυτής της διαδικασία εκεί όπου η διαμαρτυρία δεν έχει γίνει καλή τι πίστη και μόνο για σκοπούς καθυστέρησης της διαδικασίας.» Η διαδικασία που προνοείται πιο πάνω διαφέρει από την δική μας διαδικασία επειδή στην Κύπρο δεν χρειάζεται η εναγόμενη να εξασφαλίσει άδεια προτού καταχωρήσει εμφάνιση υπό διαμαρτυρία. Όμως θεωρώ ότι το πιο πάνω απόσπασμα είναι χρήσιμο διότι δείχνει ότι το Δικαστήριο δεν υποχρεούται να παραμερίσει την επίδοση του κλητήριου εντάλματος για μια παρατυπία που διορθώνεται μόνο επειδή η εναγόμενη έχει καταχωρήσει εμφάνιση υπό διαμαρτυρία και αίτηση για να παραμερισθεί η επίδοση. Εχω ήδη καταλήξει στο συμπέρασμα ότι ο ουσιαστικός λόγος καταχώρησης της αίτησης, ήτοι την μη ύπαρξη δικαιοδοσίας του Επαρχιακού Δικαστηρίου Λάρνακας , δεν ευσταθεί και έτσι απομένει μόνο το ζήτημα της επίδοσης που όπως εξήγησα πιο πάνω φαίνεται να έγινε καθόλα νομότυπα και κανονικά. Αλλά και παράτυπη να θεωρηθεί η επίδοση, αυτό δεν σημαίνει ότι ο στόχος της επίδοσης, ήτοι να λάβουν γνώση της αγωγής οι εναγόμενοι, δεν έχει επιτευχθεί. Οι εναγόμενοι έχουν λάβει γνώση της αγωγής και εχουν διαφυλαχθεί πλήρως τα δικαιώματα τους. Τα δικαιώματα των εναγομένων παραμένουν άθικτα αφού έχουν λάβει γνώση της αγωγής. Στην υπόθεση E -Phillipidou Ltd. V Littner Hampton Ltd.[16] επεξηγείται πλήρως γιατί πρέπει να δίδεται δικαίωμα στον εναγόμενο που βρίσκεται εκτός της επικράτειας της χώρας η ευκαιρία να εγείρει ζητήματα σε σχέση με την επίδοση της αγωγής. Όμως ακόμη και σε εκείνη την περίπτωση ως προκύπτει από το πιο κάτω απόσπασμα η επίδοση παραμερίστηκε επειδή ο αιτητής που αποτάθηκε για άδεια για επίδοση της ειδοποίησης του κλητήριου εκτός της δικαιοδοσίας του Δικαστηρίου προέβη σε λανθασμένη διατύπωση γεγονότος στην ένορκη δήλωση που υποστήριζε την αίτηση για να επιδοθεί η αγωγή εκτός της δικαιοδοσίας. Reverting now to the facts and circumstances of the present case the order of the Judge was to serve copy of the writ of E summons on a British national in London. This is not in compliance with r.6 of 0.6 as necessarily modified. A notice of the writ should have been served. By a notice a foreign national residing out of the jurisdiction is notified that an action was commenced against him in our Courts and he is required, after the receipt of the notice, to defend the said action, whereas a writ is a command on the defendant, after service of the writ, within the time specified to enter an appearance. There is a significant difference between a command and a courteous notice. Is this non-compliance an irregularity or a nullity? In Hewitson and Milner v. Fabre, [1888] 21 K.B. 6, the plaintiffs sued the defendant, who was a foreigner residing in France, for goods sold and delivered to him in England, and obtained a Judge's order for the service upon him of the writ out of the jurisdiction, the order being obtained upon an affidavit which stated erroneously that the defendant was a British subject. The writ was served upon the defendant in France, and judgment signed against him in default of appearance. It was held that the service of the writ instead of a notice was a nullity, and not a mere irregularity, and that the order for service of the writ arid all subsequent proceedings must be set aside. Field, J., said on pp. 8-9:- "But the evil is still greater in the case of foreign countries, the governments of which resent the service on their subjects without their leave of the process of the Courts of other nations, and for this reason the alteration has been made in the rule, and a specific distinction between serving the process itself and giving a courteous notice of it has been drawn by Order. XI., r.
- Under that rule, if the defendant be a British subject residing abroad, the jurisdiction which the Courts of this country posse over British subjects wherever resident would authorize the service upon him of the writ; but if he be not a British subject notice only of the writ is to be given to him, so that he ma be under no compulsion to obey it, but may be able to exercise an option in that respect. It is important to consider whether this objection lies in the mouth of the individual himself. In my opinion it is plain that it does, and. that the very object of the rule was to enable him to lake such an objection, and I have no doubt whatever that a foreigner residing abroad is competent to complain of the service of British process upon him. ...The order having been made upon a misrepresentation (however innocent) of a material fact. I think it should be set aside. It must be remembered also that the defendant was not a party to the making of the order: it was obtained ex pane, and to hold that the defendant cannot now come forward and object to it would amount to a denial of justice. I do not think there is any ground for the contention that the defendant has not come here in proper time; he has come when the necessity arose in consequence of proceedings upon the judgment being taken against him in the French Courts. The proceedings here are void ab initio, and I think the defendant is entitled to the relief which he claims". Wills, J., in a terse language said:- "I am entirely of the same opinion. The language o fOrder XI., r.6, is perfectly clear and explicit. The defendant was a foreigner residing in a foreign country, and the writ was served upon him abroad. Such a service is no service at all, for it is forbidden by the rules, and unless some act amounting to an estoppel has been done by the defendant the service is wrong and wholly void." The service of the copy of the writ on a foreign national outside the jurisdiction is a nullity. It may be set aside ex debitojustitiae and we intend to do so. We shall set aside the orderfor service of the writ and the service of the writ on the defend ants. In view of our above conclusion we need not consider the rival submissions of counsel whether the two claims of the plaintiffs come within the ambit of 0.6, r. 1(e). In the result order for service of copy of the writ on the defendants out of the jurisdiction and the service thereof are hereby set aside. Η ειδοποίηση που επιδόθηκε στην εναγόμενη 2 στην Αγγλική γλώσσα δεν διατάσσει την εναγόμενη να καταχωρήσει εμφάνιση στην αγωγή αλλά την πληροφορεί για το περιεχόμενο της αγωγής και την ενημερώνει για τυχόν συνέπειες εάν δεν υπερασπίσει τον εαυτό της στην αγωγή. Δεν έχει καταδειχθεί κανένας ουσιαστικός λόγος σε σχέση με αντικανονικότητα στην επίδοση της αγωγής που να επηρεάζει τα δικαιώματα της εναγόμενης. Αντιθέτως, προκύπτει ότι μέσω του δικηγόρου της έχει υπερασπίσει τα δικαιώματα της και έχει πλήρη επίγνωση του περιεχομένου της αγωγής. Σκοπός του κανονισμού 1393/07 δεν ήταν για να στηθούν νέα εμπόδια στην διαβίβαση δικαστικών εγγράφων μεταξύ κρατών μελών αλλά η διευκόλυνση στην επίδοση εγγράφων μεταξύ κρατών μελών. Η εναγόμενη 2 θα μπορούσε να επικαλεσθεί το άρθρο 8 και να συμπληρώσει έντυπο με το οποίο αρνείται την επίδοση ως προδιαγράφεται στο παράρτημα 2 στην περίπτωση που η επίδοση δεν ήταν σε γλώσσα κατανοητή γι' αυτήν. Όμως είναι φανερό ότι αντιλήφθηκε τι ήταν τα έγγραφα και τι έπρεπε να κάνει για να διαφυλάξει τα δικαιώματα της. Αντιθέτως, το έντυπο συμπλήρωσης της επίδοσης που κοινοποιήθηκε στους ενάγοντες μέσω του Υπουργείου Δικαιοσύνης καθώς και η καταχώρηση της παρούσας αίτησης αποδεικνύει ότι και κατανόησε το έγγραφο της επίδοσης αλλά και ότι έλαβε μέτρα αμέσως προς υπεράσπιση της αγωγής. Ο παραμερισμός της επίδοσης του κλητήριου εντάλματος θα προκαλέσει αχρείαστη καθυστέρηση στην διαδικασία αφού η όλη διαδικασία θα επαναληφθεί από την αρχή για να φθάσει στο σημείο που βρίσκεται σήμερα. Στην αντίθετη περίπτωση οποιαδήποτε μη ουσιώδης παρατυπία θα οδηγήσει σε επανεκκίνηση της διαδικασίας και θα επηρεάσει την γρήγορη και αποτελεσματική απονομή της δικαιοσύνης. Αναφορικά με το ζήτημα της ανανέωσης του κλητήριου εντάλματος συμφωνώ με την θέση των καθ' ων η αίτηση ότι το κλητήριο ένταλμα δεν ανανεώνεται αυτόματα ή ως θέμα δικαίου από το Δικαστήριο αλλά ότι ακσκείται η διακριτική εξουσία του Δικαστηρίου κατά την κρίση του Δικαστηρίου όταν χορηγείται η συγκεκριμένη θεραπεία. Δεν έχω αρμοδιότητα να κρίνω κατά πόσο το Δικαστήριο άσκησε εύλογα την διακριτική του εξουσία. Συνεπώς, κατά τον επίδικο χρόνο της επίδοσης το κλητήριο ήταν σε ισχύ και έτσι η εναγόμενη 2 δεν μπορεί με την αίτηση να εγείρει τέτοιο ζήτημα για να υποστηρίξει το αίτημα της για παραμερισμό του διαταγμάτος της ανανεωσης ή παραμερισμός της επίδοσης. Είναι γεγονός ότι η εναγόμενη έχει λάβει γνώση της αγωγής, συνεπώς, δεν συντρέχει ουσιαστικός λόγος για να παραμεριστεί η επίδοση . Η αίτηση απορίπτεται και θεωρείται ότι η εναγόμενη έχει λάβει γνώση της αγωγής. Τα έξοδα της αίτησης επιδικάζονται εναντίον της εναγόμενης όπως αυτά υπολογισθούν από τον πρωτοκολλητή.
