Article 3

. The assessment of this minimum depends on all the circumstances of the case, such as the duration of the treatment, its physical or mental effects and, in some cases, the sex, age and state of health of the victim. The Court has considered treatment to be "inhuman" because, inter alia, it was premeditated, was applied for hours at a stretch and caused either actual bodily injury or intense physical or mental suffering. It has deemed treatment to be "degrading" because it was such as to arouse in the victims feelings of fear, anguish and inferiority capable of humiliating and debasing them. In considering whether a punishment or treatment was "degrading" within the meaning of Article 3, the Court will have regard to whether its object was to humiliate and debase the person concerned and whether, as far as the consequences are concerned, it adversely affected his or her personality in a manner incompatible with Article

  1. However, the absence of any such purpose cannot conclusively rule out a finding of a violation of Article
  2. In order for a punishment or treatment associated with it to be "inhuman" or "degrading", the suffering or humiliation involved must go beyond that inevitable element of suffering or humiliation connected with a given form of legitimate treatment or punishment.». Συνεπώς, το Άρθρο 3 της Ε.Σ.Δ.Α. καθιστά παράνομο για την Δημοκρατία να εκδώσει εκζητούμενο πρόσωπο σε χώρα στην οποία, σύμφωνα με τις προβλέψεις, υπάρχει πραγματικός κίνδυνος να τύχει μεταχείρισης κατά τρόπο ασύμβατο με τις διατάξεις του Άρθρου 3 της Ε.Σ.Δ.Α. Ο ουσιώδης χρόνος, για σκοπούς εξέτασης του κινδύνου παραβίασης των προνοιών του Άρθρου 3 της Ε.Σ.Δ.Α., είναι ο χρόνος κατά τον οποίο εξετάζεται το αίτημα για έκδοση (Βλ. Chahal v Ηνωμένου Βασιλείου

(1996)23 Ε.Η.R.R. 413). Ο καθ' ου η αίτηση, πρέπει να αποδείξει ότι ενυπάρχουν ουσιαστικοί λόγοι να πιστεύεται ότι υφίσταται πραγματικός κίνδυνος κακομεταχείρισης του, του απαιτούμενου βαθμού σοβαρότητας, στην αιτούσα χώρα. Για να υφίσταται το στοιχείο του πραγματικού κίνδυνου υπό την έννοια που έχει προαναφερθεί, πρέπει ο κίνδυνος να μην είναι απλά μία πιθανότητα. Εντούτοις, θα γίνει αποδεκτό ότι ενυπάρχει, όταν καταδειχθεί ότι είναι πέραν από απλώς πιθανόν, σε βαθμό που υπολείπεται μιας μεγαλύτερης πιθανότητας, ότι, ως γεγονός θα επισυμβεί [Βλ. R (Lodhi) v Secretary of State for the Home Department [2010] E.W.H.C. 567 (Admin)]. Αν και το βάρος απόδειξης παραβίασης των προνοιών του Άρθρου 3 της Ε.Σ.Δ.Α., ως έχει προαναφερθεί, βαραίνει τον καθ' ου η Αίτηση, το Δικαστήριο, μπορεί να λάβει υπόψη του και πληροφορίες που δύναται να εξασφαλιστούν αυτεπαγγέλτως (Βλ. Mamatkulov και Askarov v Τουρκία, Αιτήσεις υπ' αρ. 46827/99 και 46951/99).
  1. To Ε.Δ.Α.Δ., μέσα από την νομολογία του, διαφαίνεται ότι είναι πολύ επιφυλακτικό στο να αποδεχθεί ότι η διαδικασία έκδοσης μεταξύ κρατών παραβιάζει τις πρόνοιες του Άρθρου 3 της Ε.Σ.Δ.Α. Εκτός των σπάνιων περιπτώσεων που αφορούν την θανατική ποινή, πολύ σπάνιες είναι οι περιπτώσεις όπου έχει βρεθεί ότι υπήρξε παραβίασης των προνοιών του Άρθρου 3 της Ε.Σ.Δ.Α. στις περιπτώσεις όπου η έκδοσης του καθ' ου η αίτηση αφορούσε αίτημα συνδρομής που είχε υποβληθεί από κράτος με μακρύ ιστορικό σεβασμού της δημοκρατίας, των ανθρωπίνων δικαιωμάτων και του κράτους δικαίου (Βλ. Harkins and Edwards v Ηνωμένο Βασίλειο, Αιτήσεις υπ' αρ. 9146/07 και 32650/07). Συνθήκες κράτησης και ιατροφαρμακευτική περίθαλψη
  2. Στην προκείμενη περίπτωση, η Καθ' ης η Αίτηση, ισχυρίζεται ότι, εάν εκδοθεί προς τις αρχές της Ρωσικής Ομοσπονδίας, εκεί θα κρατηθεί σε φυλακές όπου οι συνθήκες είναι τέτοιες, που θα επηρεάσουν την κατάσταση της υγείας της, το ιστορικό της οποίας είναι βεβαρημένο. Συγκεκριμένα, κατά την μαρτυρία της, ανέφερε τα εξής: «Έχω πάρα πολύ υψηλή πίεση, έχω πολύ υψηλή χοληστερίνη, ζάχαρο και χαμηλή αιμοσφαιρίνη. Έχω συνέχεια πολύ δυνατούς πονοκέφαλους, δεν μπορώ να κοιμηθώ τις νύχτες, γι' αυτό με παρακολουθούν ειδικοί γιατροί και μου παραχωρούν κάποια φάρμακα για να μπορώ να κοιμηθώ. Επίσης έχω διαγνωστεί ότι έχω πολύ σοβαρό πρόβλημα με το συκώτι και το στομάχι μου, γενικά, έχω πολλά προβλήματα υγείας. . είχα πάθει εγκεφαλικό επεισόδιο και επειδή μου είπαν ότι είναι πολύ επικίνδυνη η κατάσταση, μπορεί να επαναληφθεί το εγκεφαλικό επεισόδιο, γι' αυτό και με παρακολουθούν πολύ στενά οι γιατροί στο Ισραήλ.».
  3. Όπως τονίστηκε από το Ε.Δ.Α.Δ. στην υπόθεση Harkins and Edwards v Ηνωμένο Βασίλειο, Αιτήσεις υπ' αρ. 9146/07 και 32650/07, η απόλυτη φύση των προνοιών του Άρθρου 3 της Ε.Σ.Δ.Α. δεν σημαίνει ότι κάθε μορφής κακομεταχείριση αποτελεί εμπόδιο στο να εκδοθεί ένα πρόσωπο από χώρα που είναι μέρος στην Ε.Σ.Δ.Α. Ως σημειώνεται στην εν λόγω απόφαση του Ε.Δ.Α.Δ., η Ε.Σ.Δ.Α., δεν επιδιώκεται όπως χρησιμοποιείται σαν μέσο υποβολής από τα κράτη που εξετάζουν αίτημα συνδρομής, προτύπων της Ε.Σ.Δ.Α., σε άλλα κράτη. Συνεπώς, μεταχείριση που μπορεί να παραβιάζει τις διατάξεις του Άρθρου 3 της Ε.Σ.Δ.Α. λόγω πράξης ή παράλειψης χώρας συμβαλλόμενης στην Ε.Σ.Δ.Α., μπορεί να μην επιτυγχάνει το ελάχιστο επίπεδο σοβαρότητας που απαιτείται για να υπάρχει παραβίασης του Άρθρου 3 της Ε.Σ.Δ.Α. σε μία υπόθεση έκδοσης. Για παράδειγμα, η αμέλεια ενός κράτους μέρους στην Ε.Σ.Δ.Α. να παράσχει την κατάλληλη ιατροφαρμακευτική περίθαλψη εντός της δικαιοδοσίας του, έχει οδηγήσει το Ε.Δ.Α.Δ. να καταλήξει σε εύρημα παραβίασης του Άρθρου 3 της Ε.Σ.Δ.Α. Τέτοιες όμως παραβιάσεις, δεν έχουν γίνει εύκολα αποδεκτές από το Ε.Δ.Α.Δ., σε περιπτώσεις που αφορούσαν μεταχείριση που παρασχέθηκε εκτός των εδαφών ενός κράτους μέλους, κατόπιν έκδοσης προσώπου από αυτό (Βλ. Aleksanyan v Russia, Αίτηση υπ' αρ. 46468/06, 22/12/2008 και N. v Ηνωμένο Βασίλειο, Αίτηση υπ' αρ. 26565/05, 27/05/2008).
  4. Εντούτοις, η έκδοσης ενός εκζητούμενου προσώπου που είναι φυσικά ή και ψυχικά ασθενής, μπορεί να παραβιάζει τις πρόνοιες του Άρθρου 3 της Ε.Σ.Δ.Α., όταν η ασθένεια αποδειχθεί ότι είναι αρκετά σοβαρή και ότι η κατάστασης της υγείας του καθ' ου η αίτηση θα επιδεινωθεί από μόνο το γεγονός της έκδοσης (Βλ. Aleksanyan v Russia, Αίτηση υπ' αρ. 46468/06, 22/12/2008, N. v Ηνωμένο Βασίλειο, Αίτηση υπ' αρ. 26565/05, 27/05/2008 και Pretty v Ηνωμένο Βασίλειο, Αίτηση υπ' αρ. 2346/02, 29/04/2002).
  5. Σχετικά με τα προαναφερόμενα, στην υπόθεση Aleksanyan v Russia, Αίτηση υπ' αρ. 46468/06, 22/12/2008 το Ε.Δ.Α.Δ. ανέφερε τα εξής: «
  6. The Court often faces allegations of insufficient or inadequate medical care in places of detention. In exceptional circumstances, Article 3 may go as far as requiring the conditional liberation of a prisoner who is seriously ill or disabled. Thus, in Farbtuhs v. Latvia, (no. 4672/02, 2 December 2004), the Court concluded that the detention of a disabled 79-year-old applicant was in breach of Article 3 on account of "his age, infirmity and health situation" (see also Papon v. France (no. 1) (dec.), no. 64666/01, ECHR 2001-VI, and Priebke v. Italy (dec.), no. 48799/99, 5 April 2001).
  7. In deciding whether or not the detention of a seriously ill person raised an issue under Article 3 of the Convention, the Court has taken into account various factors. Thus, in Mouisel v. France, no. 67263/01, §§ 40-42, ECHR 2002‑IX) the Court examined such elements of the case as (a) the medical condition of the prisoner, (b) the adequacy of the medical assistance and care provided in detention and (c) the advisability of maintaining the detention measure in view of the state of health of the applicant. This test was further developed in the case of Gelfmann v. France (no. 25875/03, 14 December 2004), where the Court took into account, among other relevant factors, the dynamics of the applicant's health condition, the possibility of conditional release or parole for a seriously ill detainee if his health deteriorated, and the applicant's own attitude (namely his persistent refusal to cooperate with the doctors). In the cases of Henaf v. France (no. 65436/01, §§ 49 et seq., ECHR 2003‑XI) and Mousiel v. France (cited above) the Court also analysed whether the application of handcuffs or shackling of a seriously ill detainee to his bed was justified by any security risks. The applicant's potential "dangerousness" was also taken into account in the case of Sakkopoulos v. Greece (no. 61828/00, § 44, 15 January 2004) in order to decide whether his continuous detention on remand was justified.
  8. In most of the cases concerning the detention of ill persons the Court has examined whether or not the applicant received adequate medical assistance in prison. The Court reiterates in this respect that even if Article 3 does not entitle a detainee to be released "on compassionate grounds", it always requires that the health and well-being of detainees are adequately secured by, among other things, providing them with the requisite medical assistance (see Kudła v. Poland [GC], no. 30210/96, § 94, ECHR 2000‑XI; see also Hurtado v. Switzerland, 28 January 1994, § 79, Series A no. 280-A, opinion of the Commission; Kalashnikov v. Russia, no. 47095/99, §§ 95 and 100, ECHR 2002‑VI; and Khudobin v. Russia, (no. 59696/00, § 96, ECHR 2006‑... (extracts)).
  9. The "adequacy" of medical assistance remains the most difficult element to determine. The CPT proclaimed the principle of the equivalence of health care in prison with that in the outside community (see "Relevant International Instruments" above). However, the Court does not always adhere to this standard, at least when it comes to medical assistance to convicted prisoners (as opposed to those detained on remand). On several occasions the Court has held that Article 3 of the Convention cannot be interpreted as securing to every detained person medical assistance of the same level as "in the best civilian clinics" (see the case of Mirilashivili v. Russia (dec.), no. 6293/04, 10 July 2007). In the case of Grishin v. Russia the Court went further, holding that it was "prepared to accept that in principle the resources of medical facilities within the penitentiary system are limited compared to those of civil[ian] clinics" (no. 30983/02, § 76, 15 November 2007).
  10. On the whole, the Court reserves sufficient flexibility in defining the required standard of health care, deciding it on a case-by-case basis. That standard should be "compatible with the human dignity" of a detainee, but should also take into account "the practical demands of imprisonment".». (η υπογράμμιση και η έμφαση είναι δική μου)
  11. Στην δε υπόθεση N. v Ηνωμένο Βασίλειο, Αίτηση υπ' αρ. 26565/05, 27/05/2008, το Ε.Δ.Α.Δ. αφού κάνει μία αναδρομή σε αποφάσεις του όπου εξετάστηκαν τυχόν παραβιάσεις του Άρθρου 3 της Ε.Σ.Δ.Α., συνοψίζει τις αρχές της νομολογίας του ως εξής: «
  12. According to the Court's constant case-law, ill-treatment must attain a minimum level of severity if

. The assessment of this minimum level of severity is relative; it depends on all the circumstances of the case, such as the duration of the treatment, its physical and mental effects and, in some cases, the sex, age and state of health of the victim (see, among many other authorities, Jalloh v. Germany [GC], no. 54810/00, § 67, ECHR 2006-IX. The suffering which flows from naturally occurring illness, physical or mental, may be covered by Article 3, where it is, or risks being, exacerbated by treatment, whether flowing from conditions of detention, expulsion or other measures, for which the authorities can be held responsible (see Pretty v. the United Kingdom, no. 2346/02, § 52, ECHR 2002-III; Kudła v. Poland [GC], no. 30210/96, § 94, ECHR 2000-XI; Keenan v. the United Kingdom, no. 27229/95, § 116, ECHR 2001-III; and Price v. the United Kingdom, no. 33394/96, § 30, ECHR 2001-VII).

  1. It is the Court's settled case-law that as a matter of well-established international law, and subject to their treaty obligations, including those arising from the Convention, Contracting States have the right to control the entry, residence and removal of aliens. However, expulsion by a Contracting State may give rise to an issue under Article 3, and hence engage the responsibility of that State under the Convention, where substantial grounds have been shown for believing that the person concerned, if deported, faces a real risk of being subjected to treatment contrary to Article
  2. In such a case, Article 3 implies an obligation not to deport the person in question to that country (see Saadi v. Italy [GC], no. 37201/06, §§ 124-25, ECHR 2008).
  3. Article 3 principally applies to prevent a deportation or expulsion where the risk of ill-treatment in the receiving country emanates from intentionally inflicted acts of the public authorities there or from non-State bodies when the authorities are unable to afford the applicant appropriate protection (see H.L.R. v. France, 29 April 1997, § 32, Reports 1997-III, and Ahmed v. Austria, 17 December 1996, § 44, Reports 1996-VI). .
  4. In summary, the Court observes that since D. v. the United Kingdom it has consistently applied the following principles. Aliens who are subject to expulsion cannot in principle claim any entitlement to remain in the territory of a Contracting State in order to continue to benefit from medical, social or other forms of assistance and services provided by the expelling State. The fact that the applicant's circumstances, including his life expectancy, would be significantly reduced if he were to be removed from the Contracting State is not sufficient in itself to give rise to breach of Article
  5. The decision to remove an alien who is suffering from a serious mental or physical illness to a country where the facilities for the treatment of that illness are inferior to those available in the Contracting State may raise an issue under Article 3, but only in a very exceptional case, where the humanitarian grounds against the removal are compelling. In the D. v. the United Kingdom case the very exceptional circumstances were that the applicant was critically ill and appeared to be close to death, could not be guaranteed any nursing or medical care in his country of origin and had no family there willing or able to care for him or provide him with even a basic level of food, shelter or social support.
  6. The Court does not exclude that there may be other very exceptional cases where the humanitarian considerations are equally compelling. However, it considers that it should maintain the high threshold set in D. v. the United Kingdom and applied in its subsequent case-law, which it regards as correct in principle, given that in such cases the alleged future harm would emanate not from the intentional acts or omissions of public authorities or non-State bodies, but instead from a naturally occurring illness and the lack of sufficient resources to deal with it in the receiving country.
  7. Although many of the rights it contains have implications of a social or economic nature, the Convention is essentially directed at the protection of civil and political rights (see Airey v. Ireland, 9 October 1979, § 26, Series A no. 32). Furthermore, inherent in the whole of the Convention is a search for a fair balance between the demands of the general interest of the community and the requirements of the protection of the individual's fundamental rights (see Soering v. the United Kingdom, 7 July 1989, § 89, Series A no. 161). Advances in medical science, together with social and economic differences between countries, entail that the level of treatment available in the Contracting State and the country of origin may vary considerably. While it is necessary, given the fundamental importance of Article 3 in the Convention system, for the Court to retain a degree of flexibility to prevent expulsion in very exceptional cases, Article 3 does not place an obligation on the Contracting State to alleviate such disparities through the provision of free and unlimited health care to all aliens without a right to stay within its jurisdiction. A finding to the contrary would place too great a burden on the Contracting States.
  8. Finally, the Court observes that, although the present application, in common with most of those referred to above, is concerned with the expulsion of a person with an HIV and Aids-related condition, the same principles must apply in relation to the expulsion of any person afflicted with any serious, naturally occurring physical or mental illness which may cause suffering, pain and reduced life expectancy and require specialised medical treatment which may not be so readily available in the applicant's country of origin or which may be available only at substantial cost.».   9. Στην προκείμενη περίπτωση, το γεγονός και μόνο ότι η Καθ' ης η Αίτηση αντιμετωπίζει τα προαναφερόμενα προβλήματα υγείας, δεν επαρκεί ώστε να απορριφθεί το αίτημα έκδοσης της, γιατί κάτι τέτοιο θα σήμαινε κακομεταχείριση της κατά παράβαση των προνοιών του Άρθρου 3 της Ε.Σ.Δ.Α. Εν προκειμένω, δεν έχει αποδειχθεί στον απαιτούμενο βαθμό, ότι, η κατάσταση της υγείας της σήμερα, είναι αρκετά σοβαρή ή και ότι δυνατόν να επιδεινωθεί από μόνο το γεγονός της κράτησης της σε κέντρο κράτησης ή φυλακής, ή της έκδοσης (ή και γενικότερα ότι δύναται να επιδεινωθεί και πως), ή και ότι ενυπάρχουν σε συνδυασμό με αυτήν εξαιρετικές περιστάσεις, ώστε να δικαιολογείτο αντίθετη προσέγγισης από το Δικαστήριο. Το Δικαστήριο, έχει μόνο ως δεδομένο ότι η Καθ' ης η Αίτηση αντιμετωπίζει τα προαναφερόμενα προβλήματα υγείας. Δεν έχει καμία μαρτυρία (ακόμη και εάν γινόταν αποδεκτή η μαρτυρία της κας Irina Semerikova, δεν έχει καμία μαρτυρία με το απαιτούμενο βάρος), ότι η ιατρική περίθαλψη και φροντίδα που θα έχει (σύμφωνα με τις περιστάσεις της), εάν εκδοθεί, σε κέντρο κράτησης ή φυλακή στην Ρωσική Ομοσπονδία, θα είναι ανεπαρκής ή ασύμβατη με την ανθρώπινη αξιοπρέπεια, δεδομένων πάντοτε των πρακτικών αναγκών που το ίδιο το γεγονός της κράτησης επιβάλλει. Δεν έχει επίσης καμία μαρτυρία ως προς το εάν, δεδομένης της κατάστασης της υγείας της, από ιατρικής απόψεως, δεν συνίσταται η κράτηση της σε κέντρο κράτησης ή φυλακή. Συναφώς, πρέπει να σημειωθεί και το ότι, σύμφωνα με την προαναφερόμενη νομολογία του Ε.Δ.Α.Δ., η Καθ' ης η Αίτηση δεν μπορεί να επικαλείται (ως φαίνεται να ήταν η τελική της εισήγηση προς το Δικαστήριο), ότι, επειδή λαμβάνει σίγουρα καλύτερη θεραπεία για την κατάσταση της στις Κεντρικές Φυλακές στην Κύπρο, από ότι ενδέχεται να λάβει σε κέντρο κράτησης ή φυλακή στην Ρωσική Ομοσπονδία, δεν πρέπει το Δικαστήριο να εγκρίνει το αίτημα. Συνθήκες κράτησης γενικά
  10. Η Καθ' ης η Αίτηση, μέσα από την προαναφερόμενη τοποθέτηση της, φαίνεται να εγείρει και ζήτημα πιθανής παραβίασης του δικαιώματος της που το Άρθρο 3 της Ε.Σ.Δ.Α. κατοχυρώνει, λόγω των απάνθρωπων συνθηκών που επικρατούν στα κέντρα κράτησης ή φυλακές της Ρωσικής Ομοσπονδίας (στην πόλη της Μόσχας και στην πόλη Perm). Έχει ευρέως παρατηρηθεί, εκζητούμενα πρόσωπα να ενίστανται στην έκδοση τους, λόγω των συνθηκών κράτησης στην αιτούσα την έκδοση τους χώρα, ή λόγω της μεταχείρισης που ισχυρίζονται ότι θα λάβουν εκεί. Όταν ενυπάρχει ο κίνδυνος ότι ο καθ' ου η αίτηση θα κρατηθεί σε φυλακές όπου επικρατούν άθλιες συνθήκες στην χώρα όπου θα εκδοθεί, τότε, η έκδοσης του, μπορεί να παραβιάζει τις πρόνοιες του Άρθρου 3 της Ε.Σ.Δ.Α., όταν αποδειχθεί ότι ο κίνδυνος υπερβαίνει, ως έχει προαναφερθεί, το ελάχιστο επίπεδο σοβαρότητας. Ως εκ τούτου, το Δικαστήριο, εστιάζει την εξέταση του στην επίπτωση που οι συνθήκες που επικρατούν στις φυλακές της παραγγέλουσας χώρας θα έχουν στον καθ' ου η αίτηση. Διάφορα στοιχεία έχουν αναγνωριστεί από το Ε.Δ.Α.Δ. ότι επηρεάζουν το κατά πόσο υφίσταται παραβίασης των προνοιών του Άρθρου 3 της Ε.Σ.Δ.Α. σε μια τέτοια περίπτωση. Εντούτοις, κάθε περίπτωση εξετάζεται στην βάση των δικών της ιδιαίτερων περιστατικών, ως αυτά υφίστανται κατά τον χρόνο της εξέτασης του αιτήματος, και για τον λόγο αυτό, στο πλαίσιο μιας διαδικασίας έκδοσης, δεν γίνεται αποδεκτή η επίκληση του ότι τέτοιες συνθήκες υπάρχει η προοπτική ότι θα διαμορφωθούν μελλοντικά.
  11. Πολύ πρόσφατα, το Ε.Δ.Α.Δ., στην απόφαση του στην υπόθεση Mursic v Croatia, Αίτηση υπ' αρ. 7334/13, 20/10/2016 [[xi]], συνόψισε τις αρχές της νομολογίας του αναφορικά με το πότε οι συνθήκες κράτησης ενός ατόμου (με ειδικότερη έμφαση ως προς το ζήτημα του υπερπληθυσμού των φυλακών) παραβιάζουν τα δικαιώματα του που κατοχυρώνονται από το Άρθρο 3 της Ε.Σ.Δ.Α., ως εξής: «

  13. Article 3 of the Convention enshrines one of the most fundamental values of democratic society. . The assessment of this minimum is relative; it depends on all the circumstances of the case, such as the duration of the treatment, its physical and mental effects and, in some cases, the sex, age and state of health of the victim (see, among other authorities, Ireland v. the United Kingdom, 18 January 1978, § 162, Series A no. 25; Jalloh v. Germany [GC], no. 54810/00, § 67, ECHR 2006‑IX; Idalov, cited above, § 91; and also, Kalashnikov v. Russia, no. 47095/99, § 95, ECHR 2002‑VI).

  1. Ill-treatment that attains such a minimum level of severity usually involves actual bodily injury or intense physical or mental suffering. However, even in the absence of these, where treatment humiliates or debases an individual, showing a lack of respect for or diminishing his or her human dignity, or arouses feelings of fear, anguish or inferiority capable of breaking an individual's moral and physical resistance, it may be characterised as degrading and also fall within the prohibition of Article 3 (see, among other authorities, Idalov, cited above, § 92; and also, Pretty v. the United Kingdom, no. 2346/02, § 52, ECHR 2002‑III; Ananyev and Others, cited above, § 140; Varga and Others, cited above, § 70). Indeed, the prohibition of torture and inhuman or degrading treatment or punishment is a value of civilisation closely bound up with respect for human dignity (see Bouyid v. Belgium [GC], no. 23380/09, § 81, ECHR 2015).

In the context of deprivation of liberty the Court has consistently stressed that, to fall under Article 3, the suffering and humiliation involved must in any event go beyond that inevitable element of suffering and humiliation connected with detention.
