AmendmentsLeasuithe DEPARTMENT OF AGRICULTURE AND TECHNICAL INSTRUCTION. No. 37. THE ANIMALS (TRANSIT AND EXPORTATION) ORDER OF 1925. [Extract from Iris Oifigiúil, November 3, 1925.] (No. 37.) ORDER OF THE DEPARTMENT OF AGRICULTURE AND TECHNICAL INSTRUCTION. (Dated 29th October, 1925.) The Department of Agriculture and Technical Instruction, by virtue and in exercise of the powers vested in them under the joint operation of the Agriculture and Technical Instruction (Ireland) Act, 1899, and of the Diseases of Animals Acts, 1894 to 1914, and of every other power enabling them in this behalf do, with the concurrence of the Minister for Lands and Agriculture, hereby order :— 1 Application. 1. Notwithstanding anything in any previous Order of the Department, and in addition to the provisions of other such Orders, the provisions of this Order shall apply in respect of all animals carried on a railway in Saorstát Eireann, or brought to a port in Saorstát Eireann for export to Great Britain, and to railway vehicles and vessels on which animals are carried. 2 Female Cattle awaiting shipment or on board ship. 2.
(1)All Milch cows and all cows and heifers in calf, while undergoing detention in a place of inspection for animals intended for exportation and while on board ship, shall be accommodated in pens containing no other animals, and shall each be securely tied by the head or neck therein.
(2)All Milch cows and all cows and heifers in calf carried on a vessel shall be penned on the main deck thereof as far as the penning accommodation there permits, and no other animal shall be carried on the main deck to the exclusion therefrom of any milch cow or any cow or heifer in calf. 3 Tying of Cattle on board ship. 3. For the purpose of this Order, and the provisions of every other Order of the Department requiring cattle to be tied on board a vessel, the manner of tying shall be as follows, that is to say : (
- a)the cattle in each pen shall be tied athwartships, and so as to face the passageway giving access to the pen ; (
- b)the tying shall be by means of a head rope passing through a hole in the top pen-board. 4 Unfavourable Weather. 4. Animals shall not be carried on any voyage of a vessel if, in the judgment of the Master of such vessel, there are reasonable grounds for anticipating that owing to adverse weather conditions the voyage would be attended by serious injury or suffering to, or loss of life among, the animals. 5 Pens on Vessels. 5.
(1)In each pen containing animals on a vessel there shall be available sufficient room for an attendant to move freely across the pen at one end.
(2)In each compartment of a vessel in which animals are being carried, at least one pen shall be reserved for the accommodation of any animals it may be necessary to remove from other pens during the voyage, unless in such compartment an approved hatch, the coming of which does not exceed 18 inches in height is available, and may, without contravention of Article 3 (i) and (ii) of the Animals (Transit and General) (Ireland) Order of 1913, be used for that purpose. 6 Ventilation. 6.
(1)A part of a vessel in which animals are carried below deck shall not be regarded as sufficiently and suitably ventilated unless in such part provision is made of centrifugal rotary fans or other mechanical means of ventilation for the removal of foul air and the admission of fresh air at least twenty times in each hour.
(2)The owner or charterer of each vessel carrying animals shall take all necessary steps to ensure that the mechanical means of ventilation required by this Article is kept in proper working order.
(3)This Article shall operate subject to any exception which may be made by the Department in respect of any particular vessel. 7 Railway Vehicles. 7.
(1)In each railway truck or other railway vehicle in which animals are carried, there shall be available sufficient room for an attendant to move freely across the vehicle at one end.
(2)Where a railway train comprises twenty-five or more vehicles containing animals, an additional vehicle shall be attached thereto for the purpose of conveying any animal or animals it may be necessary to remove from the other vehicles during the journey. 8 Returns to be furnished. 8.
(1)Each Railway Company shall keep a record of all animals which die or are seriously injured, and of all cows which calve while in transit on the Company's system or under the Company's charge, and shall at the end of each week make a return to the Department of all such casualties,
(2)Each Railway Company shall furnish to the Department at the commencement of each week a Return showing in respect of the previous week the day, hour, and place of despatch and arrival of each live stock train (including goods trains carrying live stock), with the number of wagons and the number of each kind of animal carried by each train. 9 Interpretation.
- In this Order " Milch Cows " means cows giving or yielding milk ; " in calf " means visibly or obviously in-calf ; " approved hatch " means a hatch which in the opinion of an Inspector of the Department is suitable for use as a pen ; other terms have the same meaning as in the Animals (Transit and General) (Ireland) Order of
- 10 Commencement.
- This Order shall come into operation on the fifteenth day of November,
- 11 Short Title.
- This Order may be cited as the Animals (Transit and Exportation) Order of
