AmendmentsLeasuithe STATUTORY RULES AND ORDERS. 1927. No. 104. THE DINGLE HARBOUR (TEMPORARY INCREASE OF CHARGES) ORDER, 1927. HARBOUR INCREASE OF CHARGES. THE DINGLE HARBOUR (TEMPORARY INCREASE OF CHARGES) ORDER, 1927, DATED 10th DECEMBER, 1927, MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE UNDER THE HARBOURS, DOCKS AND PIERS (TEMPORARY INCREASE OF CHARGES) ACT, 1920 (10 & 11 Geo. 5 c. 21). WHEREAS it appears to the Minister for Industry and Commerce (hereinafter called "the Minister") to be expedient having regard to the cost of labour and materials and other circumstances that an Order should be made with regard to the Harbour Undertaking of the Dingle Harbour Commissioners (hereinafter called "the Commissioners") modifying the statutory provisions regulating the charges to be made in respect of such undertaking and any statutory provisions consequential on or supplemental to any such provisions: AND WHEREAS the Minister has referred the matter to the Rates Advisory Committee constituted under Section 21 of the Ministry of Transport Act, 1919, and the Rates Advisory Committee Order, 1925; and the Rates Advisory Committee has reported thereon: NOW, therefore, in exercise of the powers conferred upon him by the Harbours, Docks and Piers (Temporary Increase of Charges) Act, 1920, the Minister hereby orders as follows:— 1. The statutory provisions of any Act or Order regulating the charges to be made in respect of the said undertaking and any statutory provisions consequential on or supplemental to any such provisions are hereby modified so that, subject to the conditions hereinafter appearing, the Commissioners may charge as and from the First day of January, 1928, not exceeding the rates, dues and charges authorised under the statutory provisions hereby modified with an addition thereto of 100 per cent. save that as regards the items enumerated in the schedule hereto annexed the maximum rates dues and charges shall be those specified in the said schedule. 2. The conditions aforesaid are:— (
- i)That the Commissioners shall keep such accounts and shall make such returns of their receipts and expenditure and of their traffic as the Minister may from time to time direct. (
- ii)That the Commissioners shall make reasonable provisions for the proper repair, maintenance and renewal of the undertaking and shall keep such accounts of their expenditure upon such repairs, maintenance and renewals and shall furnish such returns of the provisions made by them and of their estimated future liability in respect thereof as the Minister may from time to time direct. (iii) That the Commissioners shall in future take due steps to demand and receive the statutory rates dues and charges (as modified by this Order) in respect of fishing vessels. 3. This Order shall have effect, during the continuance of the Harbours, Docks and Piers (Temporary Increase of Charges) Act, 1920, until revocation thereof or further Order by the Minister and may be cited as the Dingle Harbour (Temporary Increase of Charges) Order, 1927. SCHEDULE REFERRED TO IN THE FOREGOING ORDER. FIRST PART. LIGHTHOUSE DUTIES. For every vessel (other than fishing vessels) entering the harbour, for each time ... ... ... ... ... ... ... ... ... s. 10 d. 0 For every fishing smack or vessel engaged in the fisheries, of fifteen tons burthen and upwards entering the harbour, payable in advance, an annual sum of ... ... ... ... ... ... ... ... ... ... ... ... 5 0 These rates are to be demanded and received only while a light continues to be duly exhibited during the proper hours. SECOND PART. TONNAGE RATES, &c. For every vessel (other than fishing vessels) entering the harbour, per register ton, each time ... ... ... ... ... 0 6 But when such vessel does not break bulk, or take in cargo, one half the above rate; but no vessel is to pay the charge more than once in one calendar month.
