Made by the Minister for Industry and Commerce with the consent of the Minister for Finance, pursuant to sub-section
(1)of Section 8 of the Weights and Measures Act, 1928 . WHEREAS it is provided by sub-section
(1)of Section 8 of the Weights and Measures Act, 1928 , that there shall be paid in respect of the verification and stamping of bottles to which that Act applies by the person requiring the same to be verified, such fees as may be prescribed by regulations made under the said sub-section by the Minister for Industry and Commerce, with the consent of the Minister for Finance, and that different fees may be so prescribed for different classes of bottles and for different methods of testing : NOW THEREFORE the Minister for Industry and Commerce, pursuant to the powers conferred on him by the said sub-section
(1)of Section 8 of the Weights and Measures Act, 1928 , and all other powers enabling him in that behalf, hereby makes the following Regulations :— 1. In these Regulations " Minister " means the Minister for Industry and Commerce. 2. These Regulations may be cited for all purposes as the Weights and Measures (Stamping of Bottles Fees) Regulations, 1929. 3. These Regulations shall come into force on the first day of May, 1929. 4. The following fees shall be paid in respect of the verification and stamping of bottles whether before or after the date when these Regulations come into force, under a licence granted under Section 7 of the Weights and Measures Act, 1928 , authorising the stamping of bottles during the process of manufacture, that is to say :— In respect of an annual output by any one factory of bottles estimated by the Minister for Industry and Commerce at the commencement of each year to be (
- a)Less than one million 6s. od. per gross (
- b)Not less than one million 3s. 6d. ,, (
- c),, ,, two ,, 2s. 3d. ,, (
- d),, ,, three ,, 1s. 8d. ,, (
- e),, ,, four ,, 1s. 4d. ,, (
- f),, ,, five ,, 1s. 1d. ,, An additional fee of 6d. per gross shall be payable where the Minister is not satisfied that the proprietor of the factory has provided accommodation, equipment, requisites, and assistance in accordance with the requirements of paragraph (
- c)of Regulation 11 of the Weights and Measures (Bottle Factory) Regulations, 1928. The fees accruing in respect of the output of bottles during each calendar month shall, save as regards any fees accrued due previous to the date when these Regulations came into force, be paid within ten days from the expiration of that month. In the event of the actual output of bottles in any one year being different from the annual output estimated by the Minister at the commencement of that year, such additional fees shall be paid, or such refund of fees shall be made, as the Minister with the consent of the Minister for Finance may decide. 5. The following fees shall be paid in respect of the verification and stamping of bottles to which the Weights and Measures Act, 1928 , applies, other than the bottles to which the preceding Regulation applies, that is to say :— For each bottle...... .. .. .. ... .. ½d.
