LANDLORD AND TENANT (FINANCE) REGULATIONS, 1933. WHEREAS it is enacted by sub-section
(3)of section 26, sub-section
(2)of section 30 and sub-section
(2)of section 49 of the Landlord and Tenant Act, 1931 (No. 55 of 1931), that the Commissioner of Valuation and Boundary Surveyor shall send with each of the several documents mentioned in the said sub-sections respectively a statement of the fee, calculated in accordance with regulations made by the Minister for Finance, payable in relation to such documents respectively : NOW, THEREFORE, the Minister for Finance in exercise of the several powers respectively conferred upon him by sub-section
(3)of section 26, by sub-section
(2)of section 30, and by sub-section
(2)of section 49 of the Landlord and Tenant Act, 1931 (No. 55 of 1931), and of every and any other power him in this behalf enabling doth hereby make the following regulations :
- These regulations may be cited as the Landlord and Tenant (Finance) Regulations,
- The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.
- Each of the several fees mentioned in the said sub-sections respectively, that is to say, sub-section
(3)of section 26, sub-section
(2)of section 30, and sub-section
(2)of section 49 of the said Act, shall be calculated by the Commissioner of Valuation and Boundary Surveyor at an amount, as nearly as may be computed, equal to the total of the following sums, that is to say :— (
- a)the cost of the time of the officers of the General Valuation Office directly engaged upon the work to which such fee relates, and (
- b)the cost of the travelling, subsistence allowance and incidental expenses actually and necessarily incurred by such officers while engaged upon such work, and (
- c)the addition of the sum of twelve and one-half per cent. of the aggregate of the costs specified at sub-paragraphs (
- a)and (
