MILK AND DAIRIES ACT, 1935 (APPEALS TO DISTRICT COURT UNDER SECTION 41) REGULATIONS, 1936. I, P. J. RUTTLEDGE, Minister for Justice, in exercise of the powers conferred on me by the joint operation of sub-section
(1)of Section 15 and sub-section
(7)of Section 41 of the Milk and Dairies Act, 1935 (No. 22 of 1935), and of every and any other power me in this behalf enabling, do hereby order and make the following regulations, that is to say:—
- These Regulations may be cited as the Milk and Dairies Act, 1935 (Appeals to District Court under Section 41) Regulations,
- The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.
- Any dairyman desiring to appeal to the District Court under sub-section
(7)of Section 41 of the Milk and Dairies Act, 1935 , against the making or continuance of a prohibition order shall serve personally or by post on the District Court Clerk for the Court Area in which the dairy to which such order relates is situate and on the medical officer by whom such order was made, not later than seven clear days before the date of the sitting of the District Court for the said Court Area at which he desires such appeal to be heard, a notice, signed by himself or his solicitor, in the form set out in the schedule hereto.
