CONTROL OF IMPORTS (QUOTA No. 34) ORDER, 1937. WHEREAS it is enacted by Section 3 of the Control of Imports Act, 1934 (No. 12 of 1934), that the Executive Council may at any time by order (in that Act called a quota order) prohibit, subject to the provisions of the said Act, the importation into Saorstát Eireann on or after a specified day (in that Act referred to as the commencement of such order) not prior to the date of such order of any particular description or descriptions of goods and that the Executive Council shall, in and by every quota order, appoint the day (not more than six weeks after the commencement of such order) on which the first quota period under such quota order shall commence : AND WHEREAS by Section 2 of the Control of Imports (Amendment) Act, 1937 (No. 8 of 1937), it is enacted that the Executive Council may, in and by a quota order, do all or any of the following things, that is to say :— (
  4. a)exempt from the prohibition effected by such order goods imported for a specified purpose or in specified circumstances or in a specified manner or in limited quantities ; (
  5. b)effect any such exemption as is mentioned in the next preceding paragraph directly or by way of an authorisation to the Minister for Industry and Commerce or to the Revenue Commissioners ; (
  6. c)attach to any such exemption and specified limitation or condition, whether as to quantity, time, proof, or otherwise, and in particular a condition requiring the Minister for Industry and Commerce or the Revenue Commissioners to be satisfied of specified matters before the exemption takes effect in respect of any particular goods ; (
  7. d)give to the Minister for Industry and Commerce or to the Revenue Commissioners power, duty, or jurisdiction to determine whether particular goods are or are not entitled to the benefit of any particular such exemption ; (
  8. e)authorise the Minister for Industry and Commerce or the Revenue Commissioners to impose conditions (whether precedent or subsequent) to be complied with by persons claiming or receiving the benefit of any such exemption : NOW, the Executive Council, in exercise of the powers conferred on them by the Control of Imports Acts, 1934 and 1937, and of every and any other power them in this behalf enabling, do hereby order as follows :— 1. This Order may be cited as the Control of Imports (Quota No. 34) Order, 1937. 2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas. 3. Subject to the exceptions and qualifications mentioned in the next following paragraph of this Order, the importation into Saorstát Eireann on or after the 26th day of June, 1937, of electric filament lamps which are constructed for use in an electric circuit at not less than four volts nor more than thirty-five volts and consume not less than one watt nor more than sixty watts is hereby prohibited. 4. The prohibition effected by the next preceding paragraph of this Order shall not extend or apply to any electric filament lamp— (
  9. a)which is fitted with a carbon filament, or (
  10. b)which is cylindrical, or (
  11. c)which is of the type commonly known as a candle lamp, or (
  12. d)which is a gas discharge lamp, or (
  13. e)which is, in the opinion of the Revenue Commissioners, designed, constructed and intended for use exclusively for scientific or for medical or surgical purposes, or ( f ) which is, in the opinion of the Revenue Commissioners, designed, constructed, and intended to be energized from a dry battery, or (
  14. g)which is connected in series with other lamps and is, in the opinion of the Revenue Commissioners, ordinarily suitable for and intended to be used for decorative purposes, or (
  15. h)which is, in the opinion of the Revenue Commissioners, intended for use exclusively as a sample, or (
  16. i)which at importation forms part of another article imported temporarily, or ( j ) which is imported for the personal use of the importer or members of his household in quantities which are, in the opinion of the Revenue Commissioners, reasonable having regard to the circumstances of the case, or (
  17. k)which is imported under and in accordance with a licence in that behalf issued under the Control of Imports Acts, 1934 and 1937, or (
  18. l)to which this Order is precluded by Section 4 of the Control of Imports (Amendment) Act, 1937 , from applying. 5. The 26th day of July, 1937, is hereby appointed to be the day on which the first quota period under this Order shall commence. DUBLIN. This 25th day of June, 1937.
