AmendmentsLeasuithe EIRE STATUTORY RULES AND ORDERS. 1938. No. 215. DUBLIN DISTRICT MILK BOARD (MINIMUM PRICES FOR MILK) (No. 2) ORDER, 1938. WHEREAS a determination of the Dublin District Milk Board under Section 42 of the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), was communicated to the Minister for Agriculture and has been considered by him: NOW, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by clause (
  4. i)of paragraph (
  5. b)of subsection

(1)of Section 43 of the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), and of every and any other power me in this behalf enabling, do hereby order as follows:— I. This Order may be cited as the Dublin District Milk Board (Minimum Prices for Milk) (No. 2) Order, 1938, and shall come into operation on the 1st day of August, 1938. 2. In this Order— the expression "registered producers" means persons registered in the register of producers kept by the Dublin District Milk Board; the expression "registered retailers" means persons registered in the register of retailers kept by the Dublin District Milk Board; the expression "registered wholesalers" means persons registered in the register of wholesalers kept by the Dublin District Milk Board; the expression "collecting place" means a place other than the producer's registered premises at which milk is delivered by mutual agreement between the producer and the purchaser. 3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. 4. The Dublin District Milk Board (Minimum Prices for Milk) Order, 1938 (No. 123 of 1938), is hereby revoked. 5. The minimum prices to be paid to registered producers for milk sold by them to registered retailers shall be at the following rates— (I) where the milk is delivered during the months of August and September— (
  1. a)if the milk is delivered at registered premises of the purchaser, one shilling and one penny farthing per gallon; (
  2. b)if the milk is delivered, in the case of a registered retailer carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, in the case of any other registered retailer, at the railway station nearest to such retailer's registered premises, one shilling and one penny per gallon; (
  3. c)if the milk is delivered at the registered premises of the producer or at the collecting place, (
  4. i)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises does not exceed ten miles, one shilling and one farthing per gallon; (
  5. ii)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds ten miles but does not exceed twenty miles, one shilling per gallon; (iii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds twenty miles but does not exceed thirty miles, eleven pence three farthings per gallon; (
  6. iv)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds thirty miles but does not exceed forty miles, eleven pence halfpenny per gallon; (
  7. v)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds forty miles, eleven pence farthing per gallon;
(2)where the milk is delivered during the months of October to April inclusive— (
  1. a)if the milk is delivered at registered premises of the purchaser, one shilling and five pence three farthings per gallon; (
  2. b)if the milk is delivered, in the case of a registered retailer carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, n the case of any other registered retailer, at the railway station nearest to such retailer's registered premises, one shilling and five pence halfpenny per gallon; (
  3. c)if the milk is delivered at the registered premises of the producer or at the collecting place, (
  4. i)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises does not exceed ten miles, one shilling and four pence three farthings per gallon; (
  5. ii)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds ten miles but does not exceed twenty miles, one shilling and four pence halfpenny per gallon; (iii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds twenty miles but does not exceed thirty miles, one shilling and four pence farthing per gallon; (
  6. iv)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds thirty miles but does not exceed forty miles, one shilling and four pence per gallon. (
  7. v)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds forty miles one shilling and three pence three farthings per gallon. 6. The minimum prices to be paid to registered producers for milk sold by them to registered wholesalers shall be at the following rates.
(1)where the milk is delivered during the months of August and September— (
  1. a)if the milk is delivered at registered premises of the purchaser, eleven pence three farthings per gallon; (
  2. b)if the milk is delivered, in the case of a registered wholesaler carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, in the case of any other registered wholesaler, at the railway station nearest to such wholesaler's registered premises, eleven pence halfpenny per gallon; (
  3. c)if the milk is delivered at the registered premises of the producer or at the collecting place, (
  4. i)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises does not exceed ten miles, ten pence three farthings per gallon; (
  5. ii)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds ten miles but does not exceed twenty miles, ten pence halfpenny per gallon; (iii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds twenty miles but does not exceed thirty miles, ten pence farthing per gallon; (
  6. iv)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds thirty miles but does not exceed forty miles, ten pence per gallon; (
  7. v)where the distance by public road between the producer's registered premises, or the collecting place as the case may be, and the purchaser's registered premises exceeds forty miles, nine pence three farthings per gallon;
(2)where the milk is delivered during the months of October to April inclusive— (
  1. a)if the milk is delivered at registered premises of the purchaser, one shilling and four pence farthing per gallon; (
  2. b)if the milk is delivered, in the case of a registered wholesaler carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, in the case of any other registered wholesaler, at the railway station nearest to such wholesaler's registered premises, one shilling and four pence per gallon; (
  3. c)if the milk is delivered at the registered premises of the producer or at the collecting place, (

  6. iv)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds thirty miles but does not exceed forty miles, one shilling and two pence halfpenny per gallon; (
  7. v)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds forty miles, one shilling and two pence farthing per gallon.
