HAY, STRAW AND PEAT MOSS LITTER ORDER, 1938. The Minister for Agriculture, by virtue and in exercise of the powers vested in him by the joint operation of the Agriculture Act, 1931 (No. 8 of 1931), and of the Diseases of Animals (Ireland) Acts, 1894 to 1938, and of every and any other power him in this behalf enabling, hereby orders as follows:— 1.
(1)This Order may be cited as the Hay, Straw and Peat Moss Litter Order, 1938.
(2)This Order shall come into operation on the twelfth day of September,
- The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.
- In this Order— the expression "the Act of 1894" means the Diseases of Animals Act, 1894; the expression "approved disinfectant" means disinfectant approved for the time being by the Minister for Agriculture for use for the purpose of the Diseases of Animals (Disinfection) Order of 1931 (Statutory Rules and Orders No. 59 of 1931), if used at the dilution at which it is so approved.
- This Order shall not apply in respect of any vessel which for the time being trades between ports in the State only. 5.
(1)It shall not be lawful to have on board any vessel coming into any port in the State— (
- a)any hay, straw or peat moss litter in bulk, other than hay, straw or peat moss litter intended for delivery at a place outside the State, or (
- b)any article packed in hay, straw or peat moss litter, other than an article intended for delivery at a place outside the State.
(2)If in relation to any vessel there is a contravention of this Article, each of the following persons, namely, the master, owner and the charterer (if any) of such vessel, shall be guilty of an offence against the Act of 1894. 6.
(1)While any vessel, on which there is on board any hay, straw or peat moss litter or any article packed in hay, straw or peat moss litter, is in port, it shall not be lawful to remove from such vessel such hay, straw or peat moss litter or to land such article.
(2)If in relation to any vessel there is a contravention of this Article, each of the following persons, namely, the master, the owner and the charterer (if any) of such vessel, shall be guilty of an offence against the Act of 1894. 7. Every person upon leaving any vessel in which hay, straw, or peat moss litter is or has recently been kept shall before landing from such vessel, if he has been in contact with such hay, straw, or peat moss litter, do the following things, that is to say:— (
- a)remove from his clothes any traces of hay, straw, or peat moss litter, and (
- b)disinfect his boots or shoes with an approved disinfectant, and (
- c)take such steps as may be required to disinfect his clothes and (
- d)thoroughly wash his hands with soap and water. 8. If any person aids, abets, counsels or procures the commission of any breach of the provisions of this Order such person shall be guilty of an offence against the Act of 1894. 9. Nothing in this Order shall be construed as in any way limiting or affecting the operation of any of the following Orders:— The Foreign Hay and Straw (Ireland) Order of 1912 made on 29th March, 1912. The Hay and Straw (Movement from Great Britain to the Irish Free State) Order of 1923 made on 20th June, 1923. The Hay and Straw (Movement from Great Britain to the Irish Free State) Order of 1923, Amendment Order made on 22nd December, 1923. The Foreign Hay and Straw (Ireland) Order of 1912 Amendment Order of 1924 made on 14th January, 1924. The Manufactured Straw (Movement from Great Britain) Order 1924, made on 28th January, 1924. The Peat Moss Litter (Prohibition) Order, 1926, made on 30th June, 1926 (Statutory Rules and Orders No. 36 of 1926). The Hay and Straw Orders Amendment Order of 1929 made on 6th February, 1929 (Statutory Rules and Orders No. 6 of 1929). 10. The provisions of this Order shall be enforced by the local authority.
