WILD BIRDS (COUNTY DONEGAL) ORDER, 1938. WHEREAS it is enacted by subsection
(1)of Section 7 of the Wild Birds Protection Act, 1930 (No. 16 of 1930), that the Minister for Justice may, by order made on the application of a county or a county borough, prohibit for reasons stated in such application the taking or destroying either generally or in any particular years or year in such county or county borough or any particular parts or part thereof of the eggs of any wild bird whatsoever or any particular kinds or kind of wild bird, and the said Minister may by any subsequent order made on the like application revoke or amend any such first-mentioned order : AND WHEREAS by the Wild Birds (County Donegal) Order, 1936 (Statutory Rules and Orders, No. 307 of 1936), made on the application of the council of the County of Donegal, the Minister for Justice prohibited the taking or destroying of the eggs of certain kinds of wild birds in each of certain years therein specified : AND WHEREAS the said council of the County of Donegal has applied to the Minister for Justice, because of the rarity of the birds concerned and the desirability of protecting them from persecution by egg collectors, to revoke the said Wild Birds (County Donegal) Order, 1936, and to make a new order prohibiting generally in the County of Donegal the taking or destroying of the eggs of the following wild birds, that is to say: golden eagle, sea eagle, buzzard, peregrine falcon, chough, raven, dunlin or sea-lark, phalaropes (all kinds), divers (all kinds), grebes (all kinds), terns (all kinds), petrel (all kinds), partridge, and goldfinch : NOW, I, PATRICK RUTTLEDGE, Minister for Justice, in exercise of the powers conferred on me by Section 7 of the Wild Birds Protection Act, 1930 (No. 16 of 1930), and of every and any other power me in this behalf enabling, do hereby, because of the rarity of the birds concerned and the desirability of protecting them from persecution by egg collectors, order as follows :— 1. This Order may be cited as the Wild Birds (County Donegal) Order, 1938. 2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. 3. The Wild Birds (County Donegal) Order, 1936 (Statutory Rules and Orders, No. 307 of 1936), is hereby revoked. 4. No person shall in any part of the County of Donegal take or destroy the eggs of the following wild birds, that is to say : golden eagle, sea eagle, buzzard, peregrine falcon, chough, raven, dunlin or sea-lark, phalaropes (all kinds), divers (all kinds), grebes (all kinds), terns (all kinds), petrel (all kinds), partridge, and goldfinch.
