CHEESE (LEVY) (AMENDING) ORDER, 1940. WHEREAS it is enacted by Section 18 of the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935), hereinafter referred to as the Principal Act, that the Minister for Agriculture may from time to time by Order make regulations prescribing the rates of levy under Part III of the Principal Act on milk products, and may at any time by Order revoke or amend any such Order and may by any such Order prescribe different rates of levy on different substances and on different classes (defined in such manner as the said Minister shall think proper) of any particular substance and the date on which any particular rate of levy shall come into force : AND WHEREAS by virtue of Section 3 of the Principal Act raw cheese is a milk product for the purposes of the said Act : AND WHEREAS it is enacted by Section 7 of the Dairy Produce (Price Stabilisation) (Amendment) Act, 1938 (No. 30 of 1938), that whenever the Minister for Agriculture makes an Order (in the said Section referred to as an amending Order) under sub-section

(1)of Section 18 of the Principal Act amending an Order prescribing rates of levy and by the amending Order reduces the rates of levy or any of them, the said Minister may, by the amending Order, prescribe a date, earlier than the date of the making thereof, as the date on which the reduced rates of levy are to come into force : AND WHEREAS the Cheese (Levy) (No. 2) Order, 1938 (Statutory Rules and Orders, No. 272 of 1938), was made under Section 18 of the Principal Act on the 30th day of September, 1938 : NOW, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the joint operation of sub-section
(1)of Section 18 of the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935), and Section 7 of the Dairy Produce (Price Stabilisation) (Amendment) Act, 1938 (No. 30 of 1938), and of every and any other power me in this behalf enabling, do by this Order make the following Regulations :—
  1. This Order may be cited as the Cheese (Levy) (Amending) Order,
  3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.
  4. In this Order the expression " the Principal Order " means the Cheese (Levy) (No. 2) Order, 1938 (No. 272 of 1938). 4.—
(1)So much of Article 4 of the Principal Order as fixes the rate of levy on raw cheese shall cease to have effect in relation to raw cheese manufactured on or after the 1st day of December, 1939.
(2)There shall be no levy on raw cheese manufactured on or after the 1st day of December,
