(1)of section 2 of the Sugar (Control of Import) Act, 1936 (No. 16 of 1936), as adapted in consequence of the enactment of the Constitution, that the Government may, at any time and from time to time, by order (in the said Act referred to as a prohibition order) prohibit the importation into Ireland during a specified period (beginning after the date of such order) of sugar, not manufactured or produced in Ireland, save under and in accordance with a licence in that behalf granted under the said Act : AND WHEREAS it is enacted by section 5 of the said Act, as so adapted, that the Government may, in and by a prohibition order, do all or any of the following things, that is to say :— (
- a)exempt from the prohibition effected by such order sugar of any particular description, whether identified by reference to the quality, nature, or other characteristic of such sugar or by reference to the purposes for which or the manner or the circumstances in which such sugar is imported, or by reference to any other matter or thing ; (
- b)effect any such exemption as is mentioned in the next preceding paragraph either directly or by way of an authorisation to the Minister for Industry and Commerce or to the Revenue Commissioners ; (
- c)attach to any such exemption any specified limitation or condition, whether as to quantity, time, proof, or otherwise, and in particular a condition requiring the said Minister or the Revenue Commissioners to be satisfied of specified matters before the exemption takes effect ; (
- d)give to the said Minister or to the Revenue Commissioners power, duty, or jurisdiction to determine whether particular quantities or descriptions of sugar are or are not entitled to the benefit of any particular such exemption ; (
- e)authorise the said Minister or the Revenue Commissioners to impose conditions (whether precedent or subsequent) to be complied with by persons claiming or receiving the benefit of any such exemption : NOW, the Government, in exercise of the powers conferred on them by sections 2 and 5 of the Sugar (Control of Import) Act, 1936 (No. 16 of 1936), as adapted in consequence of the enactment of the Constitution, and of every and any other power them in this behalf enabling, do hereby order as follows :— 1. This Order may be cited as the Sugar (Prohibition of Import) Order, 1942. 2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. 3. The importation into Ireland in the period from the 1st day of May, 1942, to the 30th day of April, 1943, of sugar not manufactured or produced in Ireland is hereby prohibited, save under and in accordance with a licence in that behalf granted under the Sugar (Control of Import) Act, 1936 (No. 16 of 1936). 4. Sugar imported into Ireland by parcel post and shown, to the satisfaction of the Revenue Commissioners, to be imported for the personal use of the person to whom it is sent shall be exempted from the prohibition effected by this Order.
