LOCAL ELECTIONS (AMENDMENT) (No. 2) ORDER, 1942. DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH. The Minister for Local Government and Public Health in exercise of the powers conferred on him by Article 5 of the Schedule to the Local Government (Application of Enactments) Order, 1898, as amended by Section 39 of the Local Government Act, 1941 , and by Section 1 of the Local Government (Ireland) Act, 1919, and in exercise of every other power enabling him in this behalf hereby orders as follows, that is to say :— 1. This Order may be cited as the Local Elections (Amendment) (No. 2) Order, 1942. 2. The Local Elections Order, 1942, the Local Elections (Amendment) Order, 1942, and this Order, shall be read as one order and may be collectively cited as the Local Elections Orders, 1942. 3. The following provisions shall apply in relation to the prescribed form (Form L E 6) of the directions for the guidance of the voter in voting, that is to say :— (
4. a)For the reference to the Local Elections Order, 1925, there shall be substituted a reference to the Local Elections Orders, 1942. (
5. b)If any candidate has the same surname as that of any of the fictitious candidates in the examples of ballot papers validly marked some other surname shall be substituted for such surname in the said examples. 4. The following provisions shall apply in relation to the preparation of the ballot paper (Form L E 7), that is to say :— (
6. a)Nothing is to appear on the ballot paper except in accordance with the Local Elections Orders, 1942. (
7. b)The surname of each candidate shall be printed in large characters as shown in the prescribed form, and his full name, address and description, and the number on the back of the paper shall be printed in small characters. (
8. c)Whenever the surnames of two or more candidates are the same there shall also be printed in large characters the other names of such candidates and so much of the description of each of such candidates as appearing in their respective nomination papers, whether rank, profession, occupation or abode, as will, in the opinion of the returning officer effectively distinguish such candidate. (
9. d)The list of candidates shall be arranged either in one continuous column or in two or more columns in such manner (without departing from the alphabetical order) as in the opinion of the returning officer is best for marking and counting.
