HARBOUR RATES (BALTIMORE AND SKIBBEREEN HARBOUR) ORDER, 1943 MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE ON THE 25th DAY OF MAY, 1943, PURSUANT TO SUB-SECTION

(1)OF SECTION 3 of THE HARBOURS (REGULATION OF RATES) ACT, 1934 . WHEREAS it is enacted by subsection
(1)of section 3 of the Harbours (Regulation of Rates) Act, 1934 (No. 2 of 1934), that the Minister for Industry and Commerce may, if and whenever he thinks fit on the application of the Harbour authority for any harbour by order (in the said Act referred to as a harbour rates order) fix all or any of the rates, or, where he so thinks fit, the maximum rates to be charged by the harbour authority of such harbour, and may for that purpose revoke, modify, alter or extend by such order any statutory or other provision fixing, restricting or otherwise regulating the rates or the maximum or minimum rates chargeable by such harbour authority: AND WHEREAS the Baltimore and Skibbereen Harbour Commissioners have applied pursuant to section 4 of the said Act to the Minister for Industry and Commerce for a harbour rates order in respect of the Harbour of Baltimore and Skibbereen fixing certain rates to be charged by the said Commissioners: AND WHEREAS the Minister for Industry and Commerce has pursuant to the provisons of subsection
(1)of section 5 of the said Act given notice dated the 15th day of March, 1943, of his proposal to make such order to the said Commissioners, and has given the directions mentioned in that subsection in respect of the notice required thereby to be published by the said Commissioners : AND WHEREAS the said Commissioners have duly published such notice, and such notice has contained the directions mentioned in subsection
(2)of section 5 of the said Act as regards making objections and representations to the Minister for Industry and Commerce in respect of such proposed order : NOW, THEREFORE, I, SEAN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by subsection
(1)of section 3 of the Harbours (Regulation of Rates) Act, 1934 (No. 2 of 1394), and of every and any other power me in this behalf enabling do hereby order as follows, that is to say :— 1 Short title and commencement 1.—
(1)This Order may be cited as the Harbour Rates (Baltimore and Skibbereen Harbour) Order, 1943.
(2)This Order shall come into operation on the first day of June,
  1. 2 Application of Interpretation Act, 1937 .
  2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. 3 Amendment of Schedule to the Baltimore and Skibbereen Harbour Order,
  3. The Baltimore and Skibbereen Harbour Order, 1884, shall have effect as if, for the Schedule thereto, there were substituted the following— SCHEDULE TO WHICH THE FOREGOING ORDER REFERS. FIRST PART. LIGHTHOUSE DUES. s. d. For every vessel (other than fishing vessels) entering the harbour, for each time 5 0 For every fishing boat or vessel engaged in the fisheries of 5 tons net register and upwards entering the harbour, payable in advance, an annual sum of 5 0 SECOND PART. TONNAGE RATES. For every vessel (other than fishing vessels) entering the harbour, per net register ton each time 0 2 But when such vessel does not break bulk or take in cargo, one-half the above rate For each vessel for waterage where water supplied, per net register ton 0 0½ For every fishing boat or vessel of 15 tons net register and upwards belonging to or entering and using the harbour for the purpose of the fishery as a composition in full of tonnage duty, payable in advance, the annual sum of 15 0 For every fishing boat or vessel of 15 tons net register and upwards using the harbour for the purpose of the fishery, and not paying the aforesaid composition, on each occasion of entering the harbour 5 0 For every fishing boat or vessel of 5 tons net register or over but less than 15 tons net register belonging to or entering and using the harbour for the purpose of the fishery as a composition in full of tonnage duty, payable in advance, the annual sum of 5 0 For every fishing boat or vessel of 5 tons net register or over but less than 15 tons net register using the harbour for the purpose of the fishery, and not paying the aforesaid composition, on each occasion of entering the harbour 2 6 For every registered fishing boat or vessel under 5 tons net register using the harbour, an annual sum of 5 0 For every unregistered boat or vessel using the harbour, an annual sum of 2 6 For every boat or vessel under 15 tons net register using the harbour for the purpose of carrying passengers or goods, and not for the purpose of the fishery, an annual sum of 5 0 For every vessel entering the harbour for the purpose of carrying fresh fish 1d. (one penny) per register ton for the first 160 tons and ½d. (one halfpenny) per ton thereafter. RATES ON GOODS SHIPPED OR UNSHIPPED RECEIVED OR DELIVERED WITHIN THE LIMITS OF ORDER. Bricks, tiles and slates per 1,000 1 0 Calves, pigs, sheep and lambs each 0 4 Cattle, bulls, cows, oxen and horses each 1 0 Clover, turnip and other seeds per ton 2 0 Coals do. 0 6 Deals per 120 2 0 Fish, dried, salted or in pickle per ton 2 0 Fish, fresh do. 2 6 Flour and meal do. 1 0 Guano and all other artificial manures do. 0 6 Gunpowder per 100 lbs. 0 3 Ice per ton 0 6 Iron and lead do. 1 0 Malt and grain do. 2 0 Potatoes do. 1 0 Salt do. 0 6 Timber of all kinds per 50 cubic feet 0 6 ALL OTHER GOODS NOT ENUMERATED ABOVE. Light goods per 2½ cwt. or 5 cubic feet 0 6 Heavy goods per ton 1 0 In charging the rates on all goods, the gross weight or measurement of all goods to be taken, and for any less weights, measures, and quantities than those specified, a proportionate part of the respective rates shall be charged. RATES FOR BALLAST. All vessels, for any quantity taken on board per ton 0 4 4 Saving

Nothing in this Order contained shall prejudice or affect the powers of the Baltimore and Skibbereen Harbour Commissioners to levy, collect or recover any rates, dues or sums of money leviable by or due to the said Commissioners at the commencement of this Order, and such rates, dues, and sums of money may be levied, collected and recovered by the said Commissioners in the same manner and subject to the same conditions as if this Order had not been made and come into operation.
