AmendmentsLeasuithe STATUTORY RULES AND ORDERS. 1946. No. 216. THE MENTAL TREATMENT ACT, 1945 (ADAPTATION OF ENACTMENTS) ORDER, 1946. DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH. MENTAL TREATMENT ACT, 1945 . WHEREAS by sub-section
(2)of Section 281 of the Mental Treatment Act, 1945 (in this Order referred to as " the Act ") it is provided that the Minister for Local Government and Public Health (in this Order referred to as " the Minister ") may by order make, in respect of any statutory or other enactment in force at the commencement of the said section and relating to any matter or thing dealt with or affected by the Act, all such adaptations of and modifications in such enactment as appear to him to be necessary or expedient for carrying into effect the provisions of the Act ; AND WHEREAS the enactments which are set forth in the Schedule to this Order are enactments in force at the commencement of Section 281 of the Act and relate to matters or things dealt with or affected by the Act ; NOW THEREFORE the Minister in exercise of the powers vested in him by sub-section
(2)of Section 281 of the Act hereby orders as follows, that is to say :—
- Each of the enactments mentioned in the Schedule to this Order is hereby adapted in the manner and to the extent specified in the said Schedule.
- This Order may be cited as the Mental Treatment Act, 1945 (Adaptation of Enactments) Order,
- SCHEDULE.
- The Cork City Management Act, 1929 , shall be adapted as follows :—
(1)For paragraph (b) of sub-section
(2)of Section 18, the following shall be substituted :— " (b) compliance with the requirements of article 5 of the Third Schedule of the Mental Treatment Act, 1945 ."
(2)In sub-sections
(3)and
(4)of Section 18 for " joint committee of management of the Cork District Mental Hospital " and " committee of management of the Cork District Mental Hospital " there shall be substituted " Cork Mental Hospital Board, " and for " committee " there shall be substituted " board." 2. The Local Government (Dublin) Act, 1930 , shall be adapted as follows :—
(1)For paragraph (b) of sub-section
(2)of Section 40, the following shall be substituted :— " (b) compliance with the requirements of Article 5 of the Third Schedule of the Mental Treatment Act, 1945 ."
(2)In sub-sections
(3)and
(4)of Section 40 for " joint committee of management of the Grangegorman District Mental Hospital " and " committee " there shall be substituted " Grangegorman Mental Hospital Board " and " board " respectively. 3. The Limerick City Management Act, 1934 , shall be adapted as follows :—
(1)for paragraph (b) of sub-section
(2)of Section II, the following shall be substituted :— " (b) compliance with the requirements of Article 5 of the Third Schedule of the Mental Treatment Act, 1945 ."
(2)In sub-sections
(3)and
(4)of Section II for " joint committee of management of the Limerick District Mental Hospital " and " committee " there shall be substituted " Limerick Mental Hospital Board " and " board " respectively. 4. The Waterford City Management Act, 1939 shall be adapted as follows :—
(1)For paragraph (b) of sub-section
(2)of section 10, the following shall be substituted :— " (b) compliance with the requirements of article 5 of the Third Schedule of the Mental Treatment Act, 1945 ."
(2)In sub-section
(3)and
(4)of Section 10 for " joint committee of management of the Waterford District Mental Hospital " and " committee " there shall be substituted " Waterford Mental Hospital Board " and " board " respectively.
