MINIMUM FARES ON OMNIBUSES ORDER, 1947. The Government, in exercise of the powers conferred on them by section 2 of the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946), hereby order as follows :— 1 Short title 1. This Order may be cited as the Minimum Fares on Omnibuses Order, 1947. 2 Definitions 2. In this Order— licence. the word " licence," when used in relation to an omnibus, means the licence under the Road Transport Act, 1932 (No. 2 of 1932), by virtue of which the omnibus is operating, omnibus. the word " omnibus " means an omnibus within the meaning of the Road Traffic Act, 1933 (No. II of 1933), stopping place. the expression " stopping place " means a place at which an omnibus may, apart from the provisions of this Order, lawfully be stopped for the purpose of setting down passengers. 3 Minimum fare arrangement and minimum fare zone 3.—
(1)An omnibus which is travelling in a particular part (in this Order referred to as the minimum fare zone) of its route during a period— (
- a)when a minimum fare authorised by the conditions of the licence relating to the omnibus is payable by every passenger boarding the omnibus at any point along such part of its route, and (
- b)when a minimum fare notice is displayed in a conspicuous place at or near the outside of the entrance to the omnibus, shall be regarded for the purposes of this Order as operating under a minimum fare arrangement.
(2)In paragraph
(1)of this Article the expression " minimum fare notice " means a notice indicating the charging of the minimum fare in question, the amount thereof, and the terminal point of the minimum fare zone. 4 Restriction on boarding omnibus operating under minimum fare arrangement 4.—
(1)A person shall not board as a passenger an omnibus operating under a minimum fare arrangement unless he intends to travel to the end of the minimum fare zone or further.
(2)In a prosecution for an offence consisting of a contravention of paragraph
(1)of this Article, it shall be presumed, until the contrary is shown by the defendant, that the defendant did not intend to travel to the end of the minimum fare zone or further. 5 Restriction on requesting stopping of omnibus operating under minimum fare arrangement 5.—
(1)A passenger travelling in an omnibus operating under a minimum fare arrangement shall not, before the omnibus has passed the stopping place next before the end of the minimum fare zone, request the driver, by signal or otherwise, to stop the omnibus.
(2)Paragraph
(1)of this Article shall not apply in any case where, in an emergency, it becomes necessary for a passenger travelling in an omnibus to request the driver to stop the omnibus. 6 Restriction on alighting from omnibus operating under minimum fare arrangement 6.—
(1)A passenger travelling in an omnibus operating under a minimum fare arrangement shall not alight before the omnibus has reached the end of the minimum fare zone.
(2)Paragraph
(1)of this Article shall not apply in any case where, in an emergency, it becomes necessary for a passenger travelling in an omnibus to alight. 7 Giving by passenger of name and address to conductor 7.—Where a passenger travelling in an omnibus operating under a minimum fare arrangement— (
- a)requests, before the omnibus has passed the stopping place next before the end of the minimum fare zone, the driver, by signal or otherwise, to stop the omnibus, or (
- b)alights before the omnibus has reached the end of the minimum fare zone, the passenger shall, on being requested by the conductor so to do give his name and address to the conductor.
