DUBLIN DISTRICT MILK BOARD (MINIMUM PRICES FOR MILK) ORDER, 1947 (AMENDMENT) ORDER, 1947. WHEREAS a determination of the Dublin District Milk Board under Section 42 of the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), was communicated to the Minister for Agriculture and has been considered by him. NOW, I PATRICK SMITH, Minister for Agriculture, in exercise of the Powers conferred on me by sub-paragraph (
  4. ii)of paragraph (
  5. b)of sub-section

(1)of section 43 of the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), and of every and any other power me in this behalf enabling, hereby order as follows :—
  1. This Order may be cited as the Dublin District Milk Board (Minimum Prices for Milk) Order, 1947 (Amendment) Order, 1947, and shall come into operation on the 1st day of November,
  3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.
  4. The Dublin District Milk Board (Minimum Prices for Milk) Order, 1947 (No. 122 of 1947), is hereby amended— (I) by the deletion of paragraphs
(2)and
(3)of Article 5 and the substitution therefor of the following paragraphs : "
(2)where the milk is delivered during the month of October— (
  1. a)if the milk is delivered at the registered premises of the purchaser, two shillings and two pence halfpenny per gallon ; (
  2. b)if the milk is delivered, in the case of a registered retailer carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, in the case of any, other registered retailer, at the railway station nearest to such retailer's registered premises, two shillings and two pence farthing per gallon ; (
  3. c)if the milk is delivered at the registered premises of the producer or at the collecting place, (
  4. i)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises does not exceed ten miles, two shillings and one penny halfpenny per gallon ; (
  5. ii)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds ten miles, but does not exceed twenty miles, two shillings and one penny farthing per gallon ; (iii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises, exceeds twenty miles, but does not exceed thirty miles, two shillings and one penny per gallon ; (
  6. iv)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds thirty miles, but does not exceed forty miles, two shillings and three farthings per gallon ; (
  7. v)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds forty miles, two shillings and a halfpenny per gallon ;
(3)where the milk is delivered during the months of November and December— (
  1. a)if the milk is delivered at the registered premises of the purchaser, two shillings and four pence halfpenny per gallon ; (
  2. b)if the milk is delivered, in the case of a registered retailer, carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, in the case of any other registered retailer, at the railway station nearest to such retailer's registered premises, two shillings and four pence farthing per gallon ; (
  3. c)if the milk is delivered at the registered premises of the producer or at the collecting place, (
  4. i)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises does not exceed ten miles, two shillings and three pence halfpennv per gallon, (
  5. ii)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds ten miles, but does not exceed twenty miles, two shillings and three pence farthing per gallon ; (iii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises, exceeds twenty miles, but does not exceed thirty miles, two shillings and three pence per gallon ; (
  6. iv)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds thirty miles, but does not exceed forty miles, two shillings and two pence three farthings per gallon ; (
  7. v)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds forty miles, two shillings and two pence halfpenny per gallon ;
(4)where the milk is delivered during the months of January to April inclusive— (
  1. a)if the milk is delivered at registered premises of the purchaser, two shillings and six pence halfpenny per gallon. (
  2. b)if the milk is delivered, in the case of a registered retailer carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, in the case of any other registered retailer, at the railway station nearest to such retailer's registered premises, two shillings and six pence farthing per gallon ; (
  3. c)if the milk is delivered at the registered premises of the producer or at the collecting place, (
  4. i)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises does not exceed ten miles, two shillings and five pence halfpenny per gallon ; (
  5. ii)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds ten miles, but does not exceed twenty miles, two shillings and five pence farthing per gallon ; (iii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds twenty miles, but does not exceed thirty miles, two shillings and five pence per gallon ; (
  6. iv)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds thirty miles, but does not exceed forty miles, two shillings and four pence three farthings per gallon ; (
  7. v)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds forty miles, two shillings and four pence halfpenny per gallon." (II) by the deletion of paragraphs

(3)of Article 6 and the substitution therefor of the following paragraphs : "
(2)where the milk is delivered during the month of October— (

  3. c)if the milk is delivered at the registered premises of the producer or at the collecting place, (
  4. i)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises does not exceed ten miles, two shillings per gallon ; (
  5. ii)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds ten miles, but does not exceed twenty miles, one shilling and eleven pence three farthings per gallon ; (iii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds twenty miles, but does not exceed thirty miles, one shilling and eleven pence halfpenny per gallon ; (
  6. iv)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds thirty miles, but does not exceed forty miles, one shilling and eleven pence farthing per gallon ; (
  7. v)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds forty miles, one shilling and eleven pence per gallon ;
(3)where the milk is delivered during the months of November and December— (
  1. a)if the milk is delivered at registered premises of the purchaser, two shillings and three pence per gallon ; (
  2. b)if the milk is delivered in the case of a registered wholesaler carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, in the case of any other registered wholesaler, at the railway station nearest to such wholesaler's registered premises, two shillings and two pence three farthings per gallon ; (
  3. c)if the milk is delivered at the registered premises of the producer or at the collecting place, (
  4. i)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises does not exceed ten miles, two shillings and two pence per gallon ; (
  5. ii)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds ten miles, but does not exceed twenty miles, two shillings and one penny three farthings per gallon ; (iii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds twenty miles, but does not exceed thirty miles, two shillings and one penny halfpenny per gallon ; (
  6. iv)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds thirty miles, but does not exceed forty miles, two shillings and one penny farthing per gallon ; (
  7. v)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds forty miles, two shillings and one penny per gallon ;
(4)where the milk is delivered during the months of January to April inclusive— (
  1. a)if the milk is delivered at registered premises of the purchaser, two shillings and five pence per gallon ; (

  6. iv)where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds thirty miles, but does not exceed forty miles, two shillings and three pence farthing per gallon ; (
  7. v)where the distance by public road between the producer's registered premises, or the collectingplace, as the case may be, and the purchaser's registered premises exceeds forty miles, two shillings and three pence per gallon."
