DILLON, Minister for Agriculture, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)); and of every and any other power me in this behalf enabling, hereby order as follows :— 1. This Order may be cited as the Cream Order, 1948. 2. This Order shall come into operation on the 16th day of August, 1948. 3.—

(1)In this Order— the expression "the Minister" means the Minister for Agriculture, the word "creamery" means premises registered in the Register of Creameries kept under the Dairy Produce Act, 1924 (No. 58 of 1924), or the Register of Cream Separating Stations kept under that Act.
(2)Each of the following persons shall be an authorised officer for the purposes of this Order :— (
  1. a)any member of the Garda Síochána, (
  2. b)any inspector for the purposes of the Dairy Produce Act, 1924 (No. 58 of 1924), (
  3. c)any person appointed by the Minister to be an authorised officer for the purposes of this Order. 4. A person shall not use cream containing more than ten per cent. by weight of butter fat for any purpose other than the manufacture of butter. 5. A person shall not have cream containing more than ten per cent. by weight of butter fat in his possession or in premises occupied by him. 6. Article 5 of this Order shall not apply in relation to cream which is intended to be used for the manufacture of butter and which is— (
  4. a)in a creamery or in the possession of the proprietor of a creamery, or (
  5. b)in the possession of or in premises occupied by a person who obtained such cream from milk from his own cows, or (
  6. c)in the possession of or in premises occupied by a person who, during the whole of the year 1947, was engaged in the business of manufacturing butter. 7. In a prosecution for an offence consisting of a contravention of Article 4 or Article 5 of this Order, the Court shall presume, unless the contrary is shown by the defendant, that the cream in relation to which the prosecution is brought contained more than ten per cent by weight of butter fat. 8. An authorised officer may at all reasonable times enter and inspect any premises in which he suspects that cream is kept. GIVEN under my Official Seal, this 11th day of August, 1948.
