I, Daniel Morrissey, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946) as amended by the Supplies and Services (Temporary Provisions) Act, 1946 (Continuance) Act, 1947) and of every and any other power me in this behalf enabling order as follows :— 1.
(1)This Order may be cited as the Maize Meal (Maximum Prices) Order, 1948.
(2)This Order shall come into operation on the 1st day of March,
- References in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy. 3.
(1)For the purposes of this Order the expression " maize meal " shall include flake maize.
(2)Each of the following areas shall be a port area for the purposes of this Order, that is to say— (
- a)the area included within a circle having a radius of five miles and its centre at the principle Post Office in the County Borough of Dublin, (
- b)the area included within a circle having a radius of five miles and its centre at the principal Post Office in the County Borough of Cork, (
- c)the area included within a circle having a radius of five miles and its centre at the principal Post Office in the County Borough of Limerick, (
- d)the area included within a circle having a radius of five miles and its centre at the principal Post Office in the County Borough of Waterford, (
- e)the area included within a circle having a radius of five miles and its centre at the principal Post Office in the Borough of Sligo, (
- f)the area included within a circle having a radius of five miles and its centre at the principal Post Office in the Urban District of Tralee, and the expression " port area " shall in this Order be construed accordingly. 4.
(1)No person shall sell maize meal to a retail merchant at a price exceeding a price calculated at the following rates :— (
- a)in case such maize meal is sold in a port area—£24 17s. 6d. per ton ; (
- b)in case such maize meal is sold in any other area—£24 17s. 6d. per ton, together with the cost of transport (such cost being calculated by reference to the transport of a six-ton consignment by the cheapest mode but not exceeding 16s. Od. per ton) from whichever of the following ports is nearest to the vendor's premises, that is to say Dublin, Cork, Limerick, Waterford, Sligo or Tralee.
(2)Whenever a person sells maize meal to a retail merchant in an area other than a port area, such person shall, on the demand in writing of the purchaser, deliver to such purchaser a statement in writing setting out the amount of the price which is referable to the cost of transport mentioned in clause (b) of the immediately preceding paragraph. 5.
(1)No person shall sell maize meal by retail in a port area at a price exceeding (
- a)if the quantity sold is not less than one hundredweight, a price calculated at the rate of 26/8 per hundredweight, or (
- b)if the quantity sold is less than one hundredweight, a price calculated at the rate of 3s. 6d. per stone.
(2)No person shall sell maize meal by retail in any area other than a port area at a price exceeding (
- a)if the quantity sold is not less than one hundredweight, a price calculated at the rate of 27/8 per hundredweight, or (
- b)if the quantity sold is less than one hundredweight, a price calculated at the rate of 3s. 7d. per stone. 6. Where a direction is given by the Minister in respect of any particular person or group of persons or in respect of any particular maize meal or description of maize meal, the provisions of this Order shall, if and in so far as they are inconsistent with such direction, have effect subject to such direction. 7. Emergency Powers (Maize Meal) (Maximum Prices) Order, 1946 (S. R. & O. No. 174 of 1946) is hereby revoked. GIVEN under my Official Seal this 26th day of February, 1948.
