  4. The Minister for Health,

exercise of the powers conferred on him by section 109 of the Health Act, 1947 (No. 28 of 1947) and of every other power

that behalf enabling him, hereby orders as follows :— 1. This Order may be cited as the Health Act, 1947 (Adaptation) Order, 1951, and shall come

to operation on 1st day of February,

  1. The Milk and Dairies Act, 1935 (No. 22 of 1935) shall be adapted as follows :—

(1)

paragraph (

  1. c)of Section 53 thereof : (
  2. a)the word " sanitary " shall be deleted where it first occurs ; (
  3. b)after the word " authority " and before the word " whom " where such words occur

sequence, the words " or of a health authority to " shall be

serted ; (c) the words " assigned the duty of acting as " shall be substituted for the words " appointed to be a," where they occur.

(2)

sub-section

(1)of section 54 thereof the words " an officer of a sanitary authority or a health authority " shall be substituted for the words " a sanitary officer ", where they occur. 3. For the definition of the expression " authorised sanitary officer "

sub-section

(4)of Section 2 of the Sale of Food and Drugs (Milk) Act, 1936 (No. 44 of 1936), there shall be substituted the following definition : " the expression ' authorised sanitary officer ' when used

relation to a sanitary district means a person to whom the duty of acting as milk sampling officer under the Milk and Dairies Act, 1935 (No. 22 of 1935) has been assigned by the sanitary authority for such district ". 4. The Public Health (Saorstát Éireann) (Preservatives, etc.

Food) Regulations, 1928 (S. R. & O., 1928, No. 54) shall be adapted as follows :—

Article 3

thereof the words " health authority " shall be substituted for the words " Sanitary Authority " and the words " functional area " shall be substituted for the word " district " wherever they occur.

(2)

Article 6thereof the words " health authority " shall be substituted for the words " Sanitary Authority " wherever they occur.

(3)

Article 7thereof the words " functional area " shall be substituted for the word " district " wherever it occurs.

(4)The following paragraph shall be substituted for paragraph
(1)of Article 9 thereof :— "
(1)A health authority and any officer of a health authority authorised by them

writing shall also have power to enforce and execute this Part of these Regulations ".

(5)

Articles 10 and 14 thereof the words " health authority" shall be substituted for the words " Sanitary or Port Sanitary Authority".
