AmendmentsLeasuithe I, GERALD BOLAND, Minister for Justice, with the approval of the Government and in exercise of the powers conferred on me by section 14 of the Police Force Amalgamation Act, 1925 (No. 7 of 1925), and of every and any other power me in this behalf enabling hereby order as follows : 1.
(1)These Regulations may be cited as the Gárda Síochána (Retirement) (No. 2) Regulations, 1951.
(2)The collective citation " the Gárda Síochána (Retirement) Regulations, 1934 and 1951 " shall include these Regulations. 2. These Regulations shall come into operation on the 1st day of January, 1952. 3. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations. 4. In these Regulations— the expression " the Minister " means the Minister for Justice, the expression " the Commissioner " means the Commissioner of the Gárda Síochana, the expression " the existing provisions " means the provisions of paragraph 5 of the Gárda Síochána (Retirement) Regulations, 1934 ( S. R. & O. No. 146 of 1934 ), as amended by paragraph 4 of the Gárda Síochana (Retirement) Regulations, 1951 ( S.I. No. 132 of 1951 ), the expression " future members of the Gárda Síochána " means persons becoming members of the Gárda Síochána after the commencement of these regulations. 5. The existing provisions shall not apply to future members of the Gárda Síochána. 6. The following provisions shall apply to future members of the Gárda Síochána in lieu of the existing provisions : (
- a)subject to subparagraph (
- b)of this paragraph, every such member shall retire from the Gárda Síochána on attaining the age which is applicable to the rank in the Gárda Síochána for the time being held by such member, that is to say : (
- i)in the case of a member holding any rank higher than the rank of chief superintendent—on attaining the age of sixty-five years, and (
- ii)in the case of a member holding the rank of chief superintendent or of superintendent—on attaining the age of sixty years, and (iii) in the case of a member below the rank of superintendent—on attaining the age of fifty-seven years, (
- b)notwithstanding subparagraph (
- a)of this paragraph, if, but only if, the Commissioner is satisfied that it is in the interests of the efficiency of the Gárda Síochána that the age at which any such member would retire under the said subparagraph should be extended because of the possession by that member of some special qualification or experience, the Commissioner may, with the consent of the Minister, extend that age in the case of that member by such period, not exceeding five years, as the Commissioner shall determine.
