CIVIL SERVICE (REMUNERATION) REGULATIONS, 1951. I, PATRICK McGILLIGAN, Minister for Finance, in exercise of the powers conferred on me by subsection

(1)of section 9 of the Civil Service Regulation Act, 1924 (No. 5 of 1924), hereby make the following regulations— 1.—
(1)These Regulations may be cited as the Civil Service (Remuneration) Regulations, 1951.
(2)The Regulations of 1947 and these Regulations may be cited together as the Civil Service (Remuneration) Regulations, 1947 and 1951.
(3)These Regulations shall be deemed to have come into operation on, and shall have effect as on and from, the operative date.
  1. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.
  2. In these Regulations— the expression " the Minister " means the Minister for Finance ; the word " officer " means a person serving full-time in the Civil Service ; the expression " the operative date " means the 1st day of October, 1950 ; the expression " the Regulations of 1947 " means the Civil Service (Remuneration) Regulations, 1947 ( S. R. & O. No. 182 of 1947 ) ; references to the remuneration of a person shall be construed as references to the annual or weekly (whichever is appropriate having regard to his conditions of service) remuneration of that person. 4.—
(1)This Regulation does not apply to an officer to whom the Regulations of 1947 apply.
(2)The remuneration of an officer (not being an officer serving in the Department or Office mentioned in column
(2)of the Second Schedule hereto at any reference number and of the grade mentioned in column
(3)of the said Second Schedule at that reference number) of any grade mentioned in column
(2)of the First Schedule hereto, shall :— (a) if a scale or scales is or are mentioned in column
(3)of the said First Schedule opposite the mention of that grade, be determined by reference to that scale or whichever of those scales is applicable to him, (b) if no scale is mentioned in column
(3)of the said First Schedule opposite the mention of that grade, be the amount set out in the said column
(3)opposite the mention of that grade.
(3)Any direction (including a direction as to mode of entry on a scale mentioned in column
(3)of the First Schedule hereto) given before the operative date by the Minister in anticipation of the making of this Regulation shall, for the purposes of sub-paragraph (a) of paragraph
(2)of this Regulation, be deemed to be a determination of remuneration by reference to that scale. 5.—
(1)This Regulation does not apply to an officer to whom the Regulations of 1947 apply.
(2)The remuneration of an officer serving in the Department or Office mentioned in column
(2)of the Second Schedule hereto at any reference number and of the grade mentioned in column
(3)of the said Second Schedule at that reference number shall :— (a) if a scale or scales is or are mentioned in column
(4)of the said Second Schedule at that reference number, be determined by reference to that scale or whichever of those scales is applicable to him ; (b) if no scale is mentioned in column
(4)of the said Second Schedule at that reference number, be the amount set out in the said column
(4)at that reference number.
(3)Any direction (including a direction as to mode of entry on a scale mentioned in column
(4)of the Second Schedule hereto) given before the operative date by the Minister in anticipation of the making of this Regulation shall, for the purposes of sub-paragraph (a) of paragraph
(2)of this Regulation, be deemed to be a determination of remuneration by reference to that scale. 6.—
(1)This Regulation does not apply to an officer to whom the Regulations of 1947 apply.
(2)The remuneration of an officer serving in the Department or Office mentioned in column
(2)of the Third Schedule hereto at any reference number and of the grade mentioned in column
(3)of the said Third Schedule at that reference number shall :— (a) if a scale or scales is or are mentioned in column
(4)of the said Third Schedule at that reference number, be determined by reference to that scale or whichever of those scales is applicable to him, (b) if no scale is mentioned in column
(4)of the said Third Schedule at that reference number, be the amount set out in the said column
(4)at that reference number.
(3)Any direction (including a direction as to mode of entry on a scale mentioned in column
(4)of the Third Schedule hereto) given before the operative date by the Minister in anticipation of the making of this Regulation shall, for the purposes of sub-paragraph (a) of paragraph
(2)of this Regulation, be deemed to be a determination of remuneration by reference to that scale. 7.—
(1)The remuneration payable under the Regulations of 1947 to an officer to whom the Regulations of 1947 apply (not being an officer serving in the Department or Office mentioned in column
(2)of the Second Schedule hereto at any reference number and of the grade mentioned in column
(3)of the said Second Schedule at that reference number) of any grade mentioned in column
(2)of the First Schedule hereto shall be increased by a sum equal to the difference between :— (
  1. a)the amount of his remuneration as calculated in accordance with the Regulations of 1947, and (
  2. b)the amount which would be his remuneration if the Regulations of 1947 had ceased to apply to him and if paragraphs
(2)and
(3)of Regulation 4 of these Regulations were applied to him.
(2)The remuneration payable under the Regulations of 1947 to an officer to whom the Regulations of 1947 apply serving in the Department or Office mentioned in column
(2)of the Second Schedule hereto at any reference number and of the grade mentioned in column
(3)of the said Second Schedule at that reference number shall be increased by a sum equal to the difference between :— (
  1. a)the amount of his remuneration as calculated in accordance with the Regulations of 1947, and (
  2. b)the amount which would be his remuneration if the Regulations of 1947 had ceased to apply to him and if paragraphs
(2)and
(3)of Regulation 5 of these Regulations were applied to him.
(3)The remuneration payable under the Regulations of 1947 to an officer to whom the Regulations of 1947 apply serving in the Department or Office mentioned in column
(2)of the Third Schedule hereto and of the grade mentioned in column
(3)of the said Third Schedule at that reference number shall be increased by a sum equal to the difference between :— (
  1. a)the amount of his remuneration as calculated in accordance with the Regulations of 1947, and (
  2. b)the amount which would be his remuneration if the Regulations of 1947 had ceased to apply to him and if paragraphs
(2)and
(3)of Regulation 6 of these Regulations were applied to him. 8.—
(1)Any determination of remuneration of an officer by reference to a scale mentioned in any Schedule hereto or any adjustment of remuneration made before the operative date by the Minister in anticipation of the making of these Regulations shall have effect as if such determination and adjustment had been made under these Regulations.
(2)Any payments in respect of the remuneration of an officer made by direction of the Minister subsequent to making of the Regulations of 1947 and before the operative date shall be deemed to have been duly made. 9. Nothing in these Regulations shall be construed as affecting the powers of the Minister under subsection
