JAMS AND MARMALADES (MAXIMUM PRICES) ORDER, 1951. I, THOMAS F. O'HIGGINS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942), (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946) as amended by the Supplies and Services (Temporary Provisions) Act, 1946 (Continuance and Amendment) Act, 1950 (No. 34 of 1950)) and of every and any other power me in this behalf enabling, hereby order as follows :— 1.—

(1)This Order may be cited as the Jams and Marmalades (Maximum Prices) Order, 1951.
(2)This Order shall come into operation on the 14th day of April, 1951. 2. In this Order— the expression " the Minister " means the Minister for Industry and Commerce ; the words " manufacturer," " wholesale " and " retail " have the meanings customarily attached to them in the course of trade in jams and marmalades ; references to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy. 3. For the purpose of this Order, any fraction of a halfpenny shall be regarded as one halfpenny. 4. Where a direction is given by the Minister in respect of any particular person or group of persons or in respect of any particular jam or marmalade or group of jams, marmalades, or jams and marmalades the provisions of this Order shall, if and in so far as they are inconsistent with the direction, have effect subject thereto. 5. Where the rates of maximum wholesale and retail price of any jam or marmalade are to be determined by the manufacturer thereof in accordance with a direction given by the Minister and such rates as so determined are less respectively than the appropriate rates of maximum wholesale and retail price indicated in respect of the jam or marmalade in the Schedule to this Order, the manufacturer shall— (
  1. a)specify the rate of maximum wholesale price of the jam or marmalade, determined in accordance with the direction, on an invoice furnished to the purchaser of the jam or marmalade, and (
  2. b)as respects each container of the jam or marmalade mark thereon or on a suitable label affixed thereto the maximum retail price, determined in accordance with the direction, of the jam or marmalade in the container. 6. Where a person sells by wholesale any jam or marmalade the maximum retail price of which is marked under this Order on the containers or labels affixed to the containers, he shall specify on an invoice furnished to the purchaser the rate of maximum wholesale price of the jam or marmalade as determined by the manufacturer thereof in accordance with the relevant direction of the Minister. 7. No person shall sell by wholesale any jam or marmalade at a price exceeding— (
  3. a)in the case of jam or marmalade, the maximum retail price of which is marked under this Order on the containers or labels affixed to the containers, a price calculated at the rate of maximum wholesale price determined in respect of the jam or marmalade by the manufacturer thereof in accordance with the relevant direction of the Minister, and (
  4. b)in any other case a price calculated at the appropriate rate of maximum wholesale price indicated in respect of the jam or marmalade in the Schedule to this Order. 8. No person shall sell by retail any jam or marmalade at a price exceeding— (
  5. a)where the maximum retail price is marked under this Order on the containers or labels, affixed to the containers—the price so marked, and (
  6. b)in any other case—a price calculated at the appropriate rate of maximum retail price indicated in respect of the jam or marmalade in the Schedule to this Order. 9. Where a person sells by wholesale any jam or marmalade the net weight of which is not less than 144 lb., he shall pay carriage thereon to the premises of the purchaser or, in the case of delivery by rail, to the railway station nearest to the premises of the purchaser. 10. A price determined or marked under this Order or a direction of the Minister for any jam or marmalade includes the cost of the containers. 11. Where any jam or marmalade is sold on condition that the purchaser delivers empty containers to the vendor, the vendor shall,in calculating the price of the jam or marmalade, make an allowance for each container so delivered according to its size as follows :— s. d. 1-lb. container 0 0½ 2-lb. container 0 1 3-lb. container 0 1½ 4-lb. container 0 2 7-lb. container 1 0 12. A person who sells jam or marmalade by retail in any premises shall either— (
  7. a)keep displayed in the part of the premises where such sale is carried on a list showing the rates of maximum retail price specified in the Schedule to this Order, or (
  8. b)(
  9. i)keep in the premises a list showing the rates of maximum retail price specified in the Schedule to this Order, and (
  10. ii)produce such list for inspection by any person who requests that it be produced for his inspection, and (iii) keep displayed in the part of the premises where such sale is carried on a notice stating that such list is in the premises and is available for inspection on request. 13. Where the maximum retail price of any jam or marmalade is marked under this Order on the containers or labels affixed to the containers, no person who sells the jam or marmalade shall remove, alter, deface, or destroy any of the marks or labels. 14. The Emergency Powers (Jams and Marmalades) (Maximum Prices) Order, 1944 (S. R. & O. No. 154 of 1944), as amended by the Emergency Powers (Jams and Marmalades) (Maximum Prices) Order, 1944 (Amendment) (No. 4) Order, 1949 ( S.I. No. 37 of 1949 ) is hereby revoked. SCHEDULE.
