JURY SUMMONSES ORDER, 1955 I, JAMES EVERETT, Minister for Justice, in exercise of the powers conferred by section 69 of the Juries Act, 1927 (No. 23 of 1927), and, in relation to matters prescribed for the purposes of section 44 of that Act, after consultation with the President of the High Court, the President of the Circuit Court and the other Judge assigned to the Dublin Circuit, hereby order as follows : 1. This Order may be cited as the Jury Summonses Order, 1955. 2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. 3. The forms set out in the Schedule are hereby prescribed for the purposes of the Juries Acts, 1927 and 1945. 4.—
(1)The record to be kept by a summoning officer for the purposes of subsection
(4)of section 44 of the Juries Act, 1927 , shall be a copy of the panel stamped by the Post Office receiving the summonses for delivery by prepaid registered post to the jurors on the panel and marked by the summoning officer to indicate the receipt by him of every such summons which is returned to him without being delivered.
(2)A copy of the panel so stamped and marked and endorsed with the certificate of the summoning officer duly completed in the form set out in paragraph
(3)shall be evidence of the due posting of every such summons and of the return undelivered of any summons so returned.
(3)The certificate of the summoning officer shall be in the following form : " I certify that a jury summons was sent by prepaid registered post, on the date and from the post office indicated by the Post Office stamp hereon, to each juror named in this panel and that the summons sent to any juror indicated by the mark ' R.S. ' was returned to me without being delivered. Dated this ___________ day of _________ Summoning Officer " The words following " panel " may be omitted if not applicable.
(4)This Article applies to the High Court and the Central Criminal Court and to the Circuit Court sitting at any place in the Dublin Circuit. 5. The following orders made by the Minister for Justice on the 11th day of January, 1947, under section 69 of the Juries Act, 1927 , are hereby revoked : (
- a)an Order prescribing the forms of jury summonses ; (
- b)an Order prescribing forms informing jurors of the imposition of fines for non-attendance. SCHEDULE. Form No. 1. HIGH COURT OF JUSTICE. REQUISITION FOR JURORS. To In pursuance of the provisions of the Juries Acts, 1927 and 1945, I hereby require you as empanelling officer(
