WHEREAS section 17 of the Public Records (Ireland) Act, 1867, provides for the making of rules by the Master of the Rolls respecting the fees to be payable for the use of records in the Public Record Office : AND WHEREAS in pursuance of subsection
(2)of section 11 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922), it was determined by the Taoiseach by instrument under his Official Seal dated the 23rd day of May, 1951, that the Minister for Justice exercises in the State functions corresponding to those formerly exercised by the Master of the Rolls under the said section 17 : NOW, I, James Everett, Minister for Justice, in exercise of the powers conferred by section 17 of the Public Records (Ireland) Act, 1867, with the approval of the Minister for Finance, hereby order as follows :— 1. This Order may be cited as the Public Records (Fees) Order, 1955. 2. This Order shall come into operation on the 1st day of April, 1955. 3. Th Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. 4.—
(1)The fees to be paid for the use of records in the Public Record Office and for making copies of records and the rules affecting the charging of fees shall be as provided for in the Schedule.
(2)The order relating to fees made on the 26th day of August, 1921, is hereby revoked. SCHEDULE. SCALE OF FEES. PUBLIC RECORD OFFICE. Fees are in every case payable by Public Record Office stamps. The word record used in the following rules signifies all rolls, books, papers, maps, plans and other instruments deposited in the Public Record Office. I. Copies of Records : (
- a)Authenticated copies : £ s. d. *Negative photostat, each sheet size 18" x 12" or less 2 0 *Negative photostat, each sheet size 18" x 24" or less 4 0 Fee for authentication, first sheet 3 0 Fee for authentication, each additional sheet 1 6 Additional charge for colouring maps, plans and drawings etc., per hour 10 0 *Positive photostats will be made at double the charge for negatives. (
- b)Where photographic reproduction of a record is unsuitable the Deputy Keeper may give a manuscript or typed copy for such fees as would normally be charged for positive photostat copies. Manuscript copies of maps, plans, drawings, etc., are charged at the rate of 10s. per hour. Where abnormal difficulty is involved in the production of manuscript or typed copies of documents double fees are charged. (
- c)Unauthenticated copies which are required for purposes of literary or historical research and not for any purpose of law, may, at the discretion of the Deputy Keeper, be made at the rates set out in (
- a)above for negative or positive photostats, as appropriate. II. Inspections £ s. d. For the inspection of any record 2 6 III. Attendances £ s. d. For the attendance of an officer of the Public Record Office at any court or place with a record 3 3 0 (The officer attending shall be paid his reasonable expenses.) IV. Rules for Dispensing in Certain Cases with the Payment of Fees. When applications are made for copies, inspections or attendances by any Public Department, the fees on which, if paid, would be a charge on public funds, the foregoing fees are not to be charged. The Deputy Keeper of the Records may, at his discretion, permit inspections solely for purposes of historical or literary research to be made without charge.
