DILLON, Minister for Agriculture, in exercise of the powers conferred on me by the Agriculture Acts, 1931 to 1955, and the Diseases of Animals Acts, 1894 to 1954, hereby order as follows : 1. This Order may be cited as the Swine Fever (Dublin) Order, 1956. 2. This Order applies to the infected area established by the Swine Fever Infected Area Order, 1956 ( S.I. No. 223 of 1956 ). 3. In this Order " Inspector " means an Inspector of the Minister for Agriculture. 4.—
(1)An Inspector may by notice in writing direct the owner of swine not suspected of being infected with swine fever to dispose of any or all of those animals within the period, and in the manner, specified in the notice.
(2)Failure to comply with the notice shall be an offence against the Diseases of Animals Act, 1894.
(3)The notice may be withdrawn at any time by the same or another Inspector. 5.—
(1)An Inspector may, in respect of premises in the infected area as to which he is satisfied that adequate precautions are not being taken to prevent the introduction or spread of swine fever, direct the owner of the premises orally or by notice in writing to take such measures as the Inspector considers necessary for the purpose.
(2)Failure to comply with the direction shall be an offence against the Diseases of Animals Act, 1894.
(3)In the event of such failure the Minister may cause the required measures to be taken and the expenses thereof shall be recoverable by the Minister from the owner in any court of competent jurisdiction. This Order applies to the County Borough of Dublin and the rural district of Rathdown No. 1 (including the Borough of Dun Laoghaire.) The effect of the Order is that (
- a)an owner of healthy pigs in the area may be directed in writing by an Inspector of the Minister for Agriculture to dispose of any or all of those pigs and (
- b)an owner of premises in the area may be directed by an Inspector to take such measures as the Inspector considers necessary to prevent the introduction and spread of swine fever.
