LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942,) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)) hereby order as follows :— 1.—

(1)This Order may be cited as the Bread (Maximum Prices) Order, 1957.
(2)This Order shall come into operation on the 20th day of May, 1957. 2. This Order applies to the whole of the State. 3. In this Order— " batch bread " means bread commonly known as batch bread, that is to say bread which is not baked in containers and is sold or offered for sale in loaves of which the outside is not all crust ; " fancy bread " means bread other than— (
  1. a)batch bread, or (
  2. b)bread of any of the following proprietary brands : (
  3. i)Hofda, (
  4. ii)Procea, (iii) Bermaline, (
  5. iv)Thoma, (
  6. v)Halcon, (
  7. vi)Wheta, (vii) Hovis, or (
  8. c)bread of any of the following special brands : (
  9. i)Perfection—produced by Johnston Mooney and O'Brien, Ltd., of Dublin. (
  10. ii)Ideal—produced by Bolands, Ltd., of Dublin. (iii) Tru-Gael—produced by James Rourke of Dublin. (
  11. iv)Maltex—produced by Simcox and Sons, Ltd., of Cork. (
  12. v)Ormah—produced by Ormond and Ahern, Ltd., of Cork. (
  13. vi)Numalt—produced by Richard V. Jago, of Cork. (vii) Sunshine Malt—produced by Peter Lyons of Drogheda. (viii) Macamalt—produced by Alexander MacArthur of Sligo. (
  14. ix)Brandon—produced by Patrick E. Barry of Tralee. (
  15. x)Abermalt—produced by T. W. Abernethy and Sons, Ltd., of Castlemartyr, Co. Cork. (

  18. d)bread commonly known as soda bread or soda cake, that is to say, aerated bread containing aerating powders, salt and milk or (
  19. e)bread commonly known as Vienna bread. 4. The maximum price at which bread which is batch bread or fancy bread may be sold or offered for sale, whether delivery of the bread is made by the vendor or not, shall be as follows :— Batch Bread Fancy Bread When sold or offered for sale in units of 1 lb 6¾d. per lb. 6¾d. per lb. When sold or offered for sale in units of multiples of 1 lb 6½d. per lb. 6¾d. per lb. 5. The maximum prices mentioned in Article 4 of this Order shall not apply to batch bread or fancy bread which is sliced and sold in wrappers. 6.—
(1)Bread (other than bread referred to in paragraphs (b), (c), (
  1. d)and (
  2. e)of Article 3 of this Order) shall not be baked for sale unless it is baked so as to produce finished units— (
  3. i)of less than eight ounces in weight, or (
  4. ii)of one pound or multiples of one pound.
(2)For the purposes of this Article the weight of bread shall be (
  1. a)if the bread leaves the bakery on the day on which it is baked, its weight on leaving the bakery and (
  2. b)if the bread does not leave the bakery on the day on which it is baked, its weight at the close of baking operations at the bakery on the day on which it is baked.
(3)Where a person is charged with an offence consisting of a contravention of this Article in respect of the weight of any bread— (
  1. a)any inconsiderable variation in the weight of a single loaf shall be disregarded, and regard shall be had to the average weight of a reasonable number of loaves of the same kind baked on the same occasion, and generally to all the circumstances of the case, and (
  2. b)it shall be a good defence if the person so charged shows that such deficiency was due to a bona fide mistake or accident, or to other causes beyond his control and that it occurred in spite of all reasonable precautions being taken and all due diligence being exercised by him to prevent its occurrence, or that it was due to the action of some person over whom he had no control. This instrument fixes the maximum retail prices of batch bread and fancy bread, including delivery, at the prices mentioned in Article 4. It also prescribes that controlled bread shall be baked only in units of less than 8 oz. or in units of 1 lb. or multiples of 1 lb. and also prescribes how these weights shall be determined.
