No. 207 of 1957. OIL POLLUTION OF THE SEA (TRANSFER RECORDS) REGULATIONS, 1957. I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by subsection
(2)of section 17 of the Oil Pollution of the Sea Act, 1956 , (No. 25 of 1956), hereby make the following regulations :— 1.
(1)These Regulations may be cited as the Oil Pollution of the Sea (Transfer Records) Regulations, 1957.
(2)These Regulations shall come into operation on the first day of November,
- These Regulations shall apply to every vessel, whether registered in the State or not, which is capable of carrying in bulk, whether for cargo or bunker purposes, more than twenty-five tons of oil or which is capable of carrying in bulk as aforesaid more than five tons of oil in any one space or container. 3.
(1)Subject to paragraph
(2)of this Regulation, the master of every vessel to which these Regulations apply shall keep a record of the particulars specified in Regulation 4 of these Regulations relating to the transfer of oil to or from the vessel while within the territorial seas or inland waters of the State.
(2)In the case of the transfer of oil to or from a barge, the records shall be kept, respectively, by the person by whom the oil is supplied, or to whom it is delivered. 4.
(1)The records required to be kept by Regulation 3 of these Regulations shall show clearly the following particulars : (
- a)the name and port of registry (if any) of the vessel or barge; (
- b)the date and time of transfer; (
- c)the place of transfer; (
- d)the amount and description of oil transferred; (
- e)from what vessel, barge or place on land, and to what vessel, barge or place, the oil was transferred.
(2)The record of each operation shall be separately signed and dated by the person required by Regulation 3 of these Regulations to keep such record. These Regulations apply to certain vessels (of whatever nationality) and require records to be kept of transfers of oil to and from such vessels within the territorial waters of the State.
