BUTTER BOXES (RESTRICTION ON SALE) REGULATIONS, 1957. I, JAMES M. DILLON, Minister for Agriculture, in exercise of the powers conferred on me by section 6 of the Dairy Produce (Price Stabilisation) (Amendment) Act, 1956 (No. 39 of 1956), hereby make the following regulations : 1.—
(1)These Regulations may be cited as the Butter Boxes, (Restriction on Sale) Regulations, 1957.
(2)These Regulations shall come into operation on the 1st day of April, 1957. 2. In this Order— " society " means a society registered under the Industrial and Provident Societies Acts, 1893 to 1936 ; " butter (wholesale) dealer " means a person who carries on the business of selling creamery butter by wholesale only, and shall include a society which was at any time the registered proprietor of premises registered in the register of creameries kept in pursuance of the Dairy Produce Act, 1924 (No. 58 of 1924), but does not include— (
- a)a company (including a society) which purchases creamery butter mainly for resale to a company (including a society) in which it, or any of its shareholders, is a shareholder, or to two or more such companies, or (
- b)a company (including a society) which purchases creamery butter mainly for resale to a shareholder in itself, or to two or more such shareholders. 3. Empty butter boxes which are 56 lb. boxes in which creamery butter has been sold shall not be sold save— (
- a)to the proprietor of a creamery or, in the case of boxes sold by a person who is not a butter (wholesale) dealer, to a butter (wholesale) dealer, and (
- b)at such one of the following prices as is appropriate : (
- i)if the vendor is the proprietor of a creamery or a butter (wholesale) dealer, 4s. 6d. per box delivered by the vendor free of charge at the railway station nearest to the vendor's premises, which is most directly connected with the railway station nearest to the purchaser's premises, (
- ii)if the vendor is neither the proprietor of a creamery nor a butter (wholesale) dealer and the purchaser is a butter (wholesale) dealer, 5s. 0d. per box delivered at the vendor's premises. (iii) if the vendor is neither the proprietor of a creamery nor a butter (wholesale) dealer and the purchaser is the proprietor of a creamery, 5s. 0d. per box delivered by the vendor free of charge at the railway station nearest to the vendor's premises, which is most directly connected with the railway station nearest to the purchaser's premises. EXPLANATORY NOTE This Order, which operates from 1st April, 1957, provides that empty 56lb. butter boxes in which creamery butter has been sold shall not be sold save to a creamery or a butter (wholesale) dealer. The Order also fixes the prices at which such empty boxes may be sold. The Order which is made under the Dairy Produce (Price Stabilisation) (Amendment) Act, 1956 , is in replacement of similar provisions hitherto contained in the Emergency Powers Order entitled Creamery Butter and Butter Boxes Order, 1954.
