No. 59 of 1957. TRANSPORT ACT, 1950 (COMPULSORY ACQUISITION OF LAND) ORDER, 1957. WHEREAS Córas Iompair Éireann (hereinafter referred to as " the Board ") has applied to the Minister for Industry and Commerce (hereinafter referred to as " the Minister ") to authorise it by Order under section 17 of the Transport Act, 1950 , to acquire compulsorily the land hereinafter specified for the purpose of the exercise of its powers and duties : AND WHEREAS the Board has published notice of the nature of the proposed Order in accordance with the directions of the Minister : AND WHEREAS the Minister has had regard to any objections and representations furnished in accordance with the said notice :— NOW, I, WILLIAM NORTON, Minister for Industry and Commerce, in exercise of the powers conferred on me by section 17 of the Transport Act, 1950 (No. 12 of 1950), hereby order as follows : 1. This Order may be cited as the Transport Act 1950 (Compulsory Acquisition of Land) Order, 1957. 2. The Board is hereby authorised to acquire compulsorily the lands set forth in the Schedule to this Order, for the purpose of the exercise of its powers and duties. 3.—
(1)Compensation shall be paid by the Board to the several persons having estates or interests in the lands to which this Order relates.
(2)Any question of disputed compensation shall be determined under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919, and for this purpose the Board shall be deemed to be a public authority within the meaning of the said Act. 4. The Lands Clauses Acts as amended by the Second Schedule to the Housing of the Working Classes Act, 1890, shall be incorporated with this Order subject to any necessary adaptation and to the following modifications :— (
- a)For the purposes of the Lands Clauses Acts as so amended the Board shall be deemed to be the promoter and the Minister shall be deemed to be the confirming authority ; (
- b)The Board shall be deemed to be the local authority for the purposes of the Second Schedule to the Housing of the Working Classes Act, 1890 ; (
- c)This Order shall be deemed to be the Special Act. SCHEDULE LANDS TO BE ACQUIRED 1. All that piece or plot of ground with the buildings now standing thereon known as Numbers 17, 17a and 17b Anderson's Quay and 1, 2 and 3 Parnell Place situate in the Parish of Holy Trinity and City of Cork bounded on the North by Anderson's Quay, on the West by Parnell Place, on the East partly by premises in the occupation of Córas Iompair Éireann, partly by premises in the occupation of James Sullivan and Company Limited, and partly by premises in the occupation of P. F. Goggin & Company Limited, and on the South by premises in the occupation of R. Merrick and Sons Limited. 2. All that piece or plot of ground with the buildings now standing thereon known as Number 16, Anderson's Quay situate in the Parish of Holy Trinity and City of Cork bounded on the North by Anderson's Quay, on the West by premises in the occupation of Córas Iompair Éireann, on the East by Clontarf Street formerly Deane Street, and on the South partly by premises formerly in the occupation of the late Nora Cassidy and partly by premises in the occupation of James Sullivan and Company Limited. 3. All that piece or plot of ground with the buildings now standing thereon known as Numbers 8 and 9 Clontarf Street formerly Deane Street situate in the Parish of Holy Trinity and City of Cork bounded on the North by premises in the occupation of Córas Iompair Éireann, on the West partly by premises in the occupation of Córas Iompair Éireann and partly by premises in the occupation of P. F. Goggin & Company, Limited, on the East by Clontarf Street, and on the South by premises in the occupation of P. F. Goggin & Company, Limited. EXPLANATORY NOTE The effect of the Instrument is to enable C.I.E. to acquire compulsorily certain properties at Anderson's Quay, Parnell Place and Clontarf St., Cork, for the purpose of erecting a new bus station.
