REFORMATORY AND INDUSTRIAL SCHOOLS (AVERAGE COST OF MAINTENANCE OF YOUTHFUL OFFENDERS AND CHILDREN) ORDER, 1958. WHEREAS it is enacted by subsection

(1)of section 75 of the Children Act, 1908, as adapted by or under subsequent enactments, that the parent or other person liable to maintain a youthful offender or child ordered to be sent to and detained in a certified school shall, if able to do so, contribute to his maintenance therein a sum not exceeding such sum as may be declared, by order made by the Government, to represent approximately the average cost of maintenance of youthful offenders or children in the class of school to which such school belongs in the locality in which such school is situate: AND WHEREAS it is enacted by subsection
(1)of section 9 of the Children (Amendment) Act, 1957 (No, 28 of 1957), that the amount which may be fixed by an order under subsection
(1)of section 75 of the Children Act, 1908, as the contribution to be made by the parent or other person liable to maintain a youthful offender or child ordered to be detained in a certified school shall not exceed the sum of the contributions in respect of the child to be made for the time being from the Exchequer and by the local authority, and that the said subsection
(1)of the section 75 of the Children Act, 1908, shall stand amended accordingly: AND WHEREAS (
  1. a)the sum of the weekly contributions, in respect of a youthful offender or child detained in an industrial school, to be made from the Exchequer and by the local authority is now forty-five shillings, and (
  2. b)the sum of the weekly contributions, in respect of a youthful offender or child detained in a reformatory school, to be made from the Exchequer and the local authority is now (dependent on the amount of the contributions made by the local authority) either forty-eight shillings or forty-nine shillings: NOW, THEREFORE, the Government, in exercise of the powers conferred on them by subsection
(1)of section 75 and by section 130 of the Children Act, 1908, as adapted by or under subsequent enactments, do hereby order as follows:— 1. This Order may be cited as the Reformatory and Industrial Schools (Average Cost of Maintenance of Youthful Offenders and Children) Order, 1958. 2. The Interpretation Act, 1937 (No. 38 of 1937), applies to the interpretation of this Order. 3. It is hereby declared that— (
  1. a)the sum of forty-five shillings represents approximately the weekly average cost of maintenance of a youthful offender or child in an industrial school throughout the State, and (
  2. b)the sum of forty-eight shillings represents approximately the weekly average cost of maintenance of a youthful offender or child in a reformatory school throughout the State. 4. The Reformatory and Industrial Schools (Amendment) Order, 1924, No. O.S. 2 of 1924, is hereby revoked. GIVEN under the Official Seal of the Government, this 4th day of November, 1958. SEAN F. This order prescribes the maximum amount which a parent or other person liable to maintain a youthful offender or child ordered to be sent to a Certified School shall contribute to his maintenance under an Order made in accordance with Section 75 of the Children Act, 1908.
