The Minister for Health, in exercise of the powers conferred on him by sections 9 and 13 of the Local Government Act, 1941 (No. 23 of 1941), hereby orders as follows :— 1. This Order may be cited as the Health (Offices) Order, 1958. 2. In this Order— " the Act " means the Local Government Act, 1941 (No. 23 of 1941) ; " the appropriate Minister " means the appropriate Minister for the purposes of Part II of the Act, Part III of the Local Government Act, 1946 (No. 24 of 1946), and Chapter I of Part II of the Local Government Act, 1955 (No. 9 of 1955) ; " the Minister " means the Minister for Health ; " office " means any office within the meaning of Part II of the Act in relation to which the Minister is the appropriate Minister. 3. This Order shall come into operation on the 1st day of April, 1958. 4.

(1)Every office mentioned in the Schedule hereto, and every office the duties of which are analogous to the duties of any such office, shall be a major office.
(2)The Schedule to and sub-articles
(1)and
(2)of article 9 of the Local Government (Officers) Regulations, 1943 (S.R. & O., 1943, No. 161), are hereby revoked as respects any office mentioned in the Schedule to the said Regulations.
(3)Every declaration made or deemed to have been made under section 9 of the act declaring an office to be a major office is hereby revoked. 5.
(1)The following orders shall cease to have effect and are hereby revoked as respects any office— (
  1. a)Every order in force immediately before the 26th day of August, 1942, and continued in force by section 14 of the act— (
  2. i)directing the kind or number of officers to be appointed by a local authority, (
  3. ii)determining the duties, conditions of service or remuneration of an office. (
  4. b)The Local Government (Minor Officers) Order, 1943 (S.R. and O., 1943, No. 46); (
  5. c)The Local Officers (Removal by Local Authority) Regulations, 1943 (S.R. and O., 1943, No. 106) ; (
  6. d)The Local Government (Minor Officers) (Amendment) Order, 1944 (S.R. and O., 1944, No. 16) ; (
  7. e)The Local Government (Minor Officers) (Amendment) (No. 2) Order, 1944 (S.R. and O., 1944, No. 291) ; (
  8. f)The Local Government (Minor Officers) (Amendment) Order, 1948 ( S.I. No. 352 of 1948 ).
(2)Article 36 of the Local Government (Officers) Regulations, 1943 (S.R. and O., 1943, No. 161) is hereby revoked in so far as it applies to orders and regulations respecting offices and employments in relation to which the Minister is the appropriate Minister. SCHEDULE. MAJOR OFFICES. Accountant. Accounts Clerk. Analytical chemist. Any office, other than that of house physician or house surgeon, the holder of which is required by virtue of his office to be a registered medical practitioner. Any office the holder of which is required by virtue of his office to be a registered dentist. Any office in a district mental hospital, other than that of nurse, deputy charge nurse or charge nurse, the holder of which is required by virtue of his office to be a registered nurse. Architect. Assistant clerk of a district mental hospital. Assistant matron. Biochemist. Catering superintendent. Chief clerk of a district mental hospital. Chief health inspector. Clerk of works. Compounder or compounder of medicine. Engineer. Head nurse. Health inspector. Land Steward. Matron. SCHEDULE—continued. Pharmacist. Public analyst. Staff officer. Storekeeper in a health institution designated by the Minister or in a district mental hospital. Supervising health inspector. Tutor sister. Veterinary surgeon. GIVEN under the Official Seal of the Minister for Health this Fifteenth day of February, One Thousand Nine Hundred and Fifty-eight. SEÁN MACENTEE, Minister for Health. EXPLANATORY NOTE. This Order provides, for the convenience of health authorities, a comprehensive and up-to-date list of offices declared by the Minister for Health to be " major offices " for the purposes of the Local Government Acts. It replaces and repeals declarations contained in previous statutory instruments and repeals certain other statutory instruments no longer needed.
