AmendmentsLeasuithe S.I. No. 116 of 1959. BOVINE TUBERCULOSIS (MOVEMENT CONTROL) (CAVAN AND MONAGHAN) ORDER, 1959. I, PATRICK SMITH, Minister for Agriculture, it appearing to me to be necessary for the purpose of the progressive eradication of bovine tuberculosis, do hereby, in exercise of the powers conferred on me by section 22 of the Diseases of Animals Act, 1894, and section 2 of the Diseases of Animals (Bovine Tuberculosis) Act, 1957 (No. 14 of 1957), order as follows :— 1 Short title, collective citation and commencement. 1.—
(1)This Order may be cited as the Bovine Tuberculosis (Movement Control) (Cavan and Monaghan) Order, 1959.
(2)The Principal Order and this Order may be cited together as the Bovine Tuberculosis (Movement Control) Orders, 1958 and 1959.
(3)This Order shall come into operation on the 20th day of July,
- 2 Principal Order.
- In this Order " the Principal Order " means the Bovine Tuberculosis (Movement Control) (No. 1) Order, 1958 ( S.I. No. 170 of 1958 ). 3 Movement control—Cavan and Monaghan.
- In the definition of " the area " contained in Article 2 of the Principal Order " Cavan, Monaghan," is hereby inserted before " Clare ". 4 Clear herd.
- In the definition of " clear herd " contained in Article 2 of the Principal Order " not earlier than the day (whether before or after the commencement of this Order) which was twelve months before the day on which the county in which the herd is located was declared to be within a clearance area " is hereby substituted for " on or after the 1st day of January, 1958 (whether before or after the commencement of this Order) ". 5 Amendment of Forms. 5.—
(1)For the heading of the Form set out in Part I of the Schedule to the Principal Order there is hereby substituted the heading set out in the First Schedule to this Order.
(2)For the heading of the Form set out in Part III of the Schedule to the Principal Order there is hereby substituted the form set out in the Second Schedule to this Order. FIRST SCHEDULE. Article 5
(1)DISEASES OF ANIMALS (BOVINE TUBERCULOSIS) ACT, 1957 . Control of Movement into Clearance Area. APPLICATION FOR MOVEMENT PERMIT (DISPOSAL IN CLEARANCE AREA). SECOND SCHEDULE. Article 5
(2)DISEASES OF ANIMALS (BOVINE TUBERCULOSIS) ACT, 1957 . Control of Movement into Clearance Area. APPLICATION FOR MOVEMENT PERMIT (TRANSIT THROUGH CLEARANCE AREA). GIVEN under my Official Seal, this 10th day of July, 1959. PATRICK SMITH, Minister for Agriculture. EXPLANATORY NOTE. The effect of this Order is to extend to Counties Cavan and Monaghan, with effect from 20th July, 1959, from which date these counties become a Clearance Area, the provisions of the Bovine Tuberculosis (Movement Control) (No. 1) Order, 1958, which prohibits the movement, except under permit, of cattle into areas declared to be clearance areas ; specifies the classes of cattle for which such permits shall be granted and regulates the movement of cattle into and out of herds within those areas.
