No. 244 of 1961. COMMITTEES OF AGRICULTURE (OFFICERS' TRAVELLING EXPENSES AND MAINTENANCE ALLOWANCE AND EXPENSES) REGULATIONS, 1956 (AMENDMENT) REGULATIONS, 1961. I, PATRICK SMITH, Minister for Agriculture, in exercise of the powers conferred on me by section 28 of the Agriculture Act, 1931 (No. 8 of 1931), and section 6 of the Agriculture (Amendment) Act, 1958 (No. 17 of 1958), hereby make the following regulations: 1.

(1)These Regulations may be cited as the Committees of Agriculture (Officers' Travelling Expenses and Maintenance Allowance and Expenses) Regulations, 1956 (Amendment) Regulations, 1961.
(2)These Regulations shall be deemed to have come into operation on the 1st day of April, 1961.
(3)The Committees of Agriculture (Officers' Travelling Expenses and Maintenance Allowance and Expenses) Regulations, 1956 to 1960, and these Regulations may be cited together as the Committees of Agriculture (Officers' Travelling Expenses and Maintenance Allowance and Expenses) Regulations, 1956 to
  1. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.
  2. Part III of the Schedule to the Committees of Agriculture (Officers' Travelling Expenses and Maintenance Allowance and Expenses) Regulations, 1956 ( S.I. No. 70 of 1956 ), is hereby amended by the deletion of paragraphs 10 and 11 (inserted by the Committees of Agriculture (Officers' Travelling Expenses and Maintenance Allowance and Expenses) Regulations, 1956 (Amendment) Regulations, 1957 ( S.I. No. 92 of 1957 )) and the substitution therefor of the following paragraphs: "10.
(1)Subject to the provisions of paragraph 9 of this Schedule, the following shall be the rates of maintenance expenses in the form and by way of a night allowance which shall be payable by a committee to its officers, that is to say: (
  1. a)in the case of a Chief Agricultural Officer or a Secretary of a committee, the rate shall be thirty-eight shillings and sixpence per night covering a period of twenty-four hours' absence from the officers' headquarters; after a continuous period of absence of seven nights in any one place the rate of thirty-eight shillings and sixpence shall be reduced to the rate of thirty-five shillings and sixpence per night for the remainder of the officer's stay; (
  2. b)in the case of an officer (other than a Chief Agricultural Officer or a Secretary of a committee) who is in receipt of a salary of more than £682 per annum, the rate shall be thirty-four shillings and sixpence per night covering a period of twenty-four hours' absence from the officer's headquarters; after a continuous period of absence of seven nights in any one place the rate of thirty-four shillings and sixpence shall be reduced to the rate of twenty-nine shillings and sixpence per night for the remainder of the officer's stay; (
  3. c)in the case of an officer who is in receipt of a salary of not less than £441 and not more than £682 per annum, the rate shall be twenty-nine shillings per night covering a period of twenty-four hours' absence from the officer's headquarters; after a continuous period of absence of seven nights in any one place the rate of twenty-nine shillings shall be reduced to the rate of twenty-four shillings per night for the remainder of the officer's stay, and (
  4. d)in the case of an officer who is in receipt of a salary of less than £441 per annum, the rate shall be twenty-five shillings per night covering a period of twenty-four hours' absence from the officer's headquarters; after a continuous period of absence of seven nights in any one place the rate of twenty-five shillings shall be reduced to the rate of twenty-one shillings per night for the remainder of the officer's stay.
(2)In this paragraph "salary" shall be construed as excluding any allowance for travelling and maintenance allowances. 11. The following shall be the rates of maintenance expenses in the form and by way of a day allowance payable by a committee to such of its officers as are entitled to a day allowance, that is to say: (
  1. a)in the case of a Chief Agricultural Officer or a Secretary of a committee who is absent from headquarters for a period of not less than ten hours (not extending overnight) or a period of not less than ten hours immediately following the period of twenty-four hours covered by a night allowance, the rate shall be one-third of the rate payable to the officer in the case of a night allowance applicable to the first seven nights of a continuous period of absence by the officer in any one place; (
  2. b)in the case of a Chief Agricultural Officer or a Secretary of a committee who is absent from headquarters for a period of not less than seven but less than ten hours (not extending overnight) or a period of not less than seven but less than ten hours immediately following the period of twenty-four hours covered by a night allowance, the rate shall be six shillings; (
  3. c)in the case of an officer (other than a Chief Agricultural Officer or a Secretary of a committee) who is absent from headquarters for a period of not less than ten hours (not extending overnight) or a period of not less than ten hours immediately following the period of twenty-four hours covered by a night allowance, the rate shall be one-third of the rate payable to the officer in the case of a night allowance applicable to the first seven nights of a continuous period of absence by the officer in any one place; (
  4. d)in the case of an officer (other than a Chief Agricultural Officer or a Secretary of a committee) who is absent from headquarters for a period of not less than seven but less than ten hours (not extending overnight) or a period of not less than seven but less than ten hours immediately following the period of twenty-four hours covered by a night allowance, the rate shall be— (
  5. i)five shillings and threepence, in case the rate of night allowance payable to the officer in respect of the first seven nights of a continuous period of absence in any one place is thirty-four shillings and sixpence; (
  6. ii)five shillings, in case the rate of night allowance payable to the officer in respect of the first seven nights of a continuous period of absence in any one place is either twenty-nine shillings or twenty-five shillings."
