No. 12/1962 - Mechanically Propelled Vehicles (International Circulation) (Amendment) Order, 1962. AmendmentsLeasuithe S.I. No. 12 of 1962. MECHANICALLY PROPELLED VEHICLES (INTERNATIONAL CIRCULATION) (AMENDMENT) ORDER, 1962. The Minister for Local Government in exercise of the powers conferred on him by section 12 of the Roads Act, 1920, section 42 of the Road Traffic Act, 1933 (No. 11 of 1933), sections 80 and 123 of the Road Traffic Act, 1961 (No. 24 of 1961), sections 1 and 3 of the Finance (Excise Duties) (Vehicles) Act, 1952 (No. 24 of 1952) and section 38 of the Local Government Act, 1955 (No. 9 of 1955) hereby makes the following regulations and order :— 1.—
(1)This Order may be cited as the Mechanically Propelled Vehicles (International Circulation) (Amendment) Order, 1962.
(2)This Order shall come into operation on the 1st day of May, 1962.
(3)The Mechanically Propelled Vehicles (International Circulation) Order, 1961 ( S.I. No. 269 of 1961 ) and this Order shall be construed as one and may be cited together as the Mechanically Propelled Vehicles (International Circulation) Orders, 1961 and 1962. 2.—
(1)In this Order " the Principal Order " means the Mechanically Propelled Vehicles (International Circulation) Order, 1961 ;
(2)The Interpretation Act, 1937 (No. 38 of 1937) applies to this Order. 3. Article 2 of the Principal Order shall be amended as follows :— (
- a)in the definition of " bureau " " under the Road Traffic Act, 1961 " shall be substituted for " under the Act of 1933 " and " section 66 of the Road Traffic Act, 1961 " shall be substituted for " section 68 of the Act of 1933 " ; (
- b)in the definition of " relevant evidence of insurance " in respect of a vehicle " the Road Traffic Act, 1961 " shall be substituted for " the Act of 1933 " wherever the latter words occur in the definition and " an approved policy of insurance or an approved guarantee " shall be substituted for " an approved policy of insurance, an approved guarantee or an approved combined policy and guarantee ". 4. Sub-paragraph (
- a)of paragraph
(1)of article 3 of the Principal Order shall be amended by the deletion of the words " has not more than eight seats in addition to the driver's seat and ". 5. Article 13 of the Principal Order shall be amended as follows :— (a) by the substitution in paragraphs
(1)and
(2)of " section 66 of the Road Traffic Act, 1961 " for " section 68 of the Act of 1933 " ; (b) by the substitution in paragraph
(2)of " Part VI of the Road Traffic Act, 1961 " for " Part V of the Act of 1933 " and (c) by the substitution for paragraph
(3)of the following paragraph :— "
(3)section 58 of the Road Traffic Act, 1961 shall not apply to the Irish Bureau and paragraphs
(3)and
(8)of article 7 of the Road Traffic (Compulsory Insurance) Regulations, 1962 shall not apply to an international insurance card." 6. Article 16 of the Principal Order shall be amended by the insertion after " Part III of the Act of 1933 " of " other than driving licences granted under article 15 of this order." EXPLANATORY NOTE. This Order amends the Mechanically Propelled Vehicles (International Circulation) Order, 1961 ( S.I. No. 269 of 1961 ) by—
(1)substituting references to the insurance provisions of the Road Traffic Act, 1961 (which come into operation on 1st May, 1962), for references to the corresponding provisions of the Road Traffic Act, 1933 ;
(2)removing the limitation on the number of seats in visiting private vehicles which are exempt from motor vehicle duty in accordance with article 3 of the 1961 Order ;
(3)terminating the authorisation of the Automobile Association and the Royal Irish Automobile Club to issue international driving permits to non-residents who hold visitors' driving licences under article 15 of the 1961 Order.
