We, the Circuit Court Rules Committee, constituted pursuant to the provisions of section 69 of the Courts of Justice Act, 1936 , and section 12 of the Courts of Justice Act, 1947 , by virtue of the powers conferred upon us by section 66 of the Courts of Justice Act, 1924 , and section 70 of the Courts of Justice Act, 1936 , and of all other powers enabling us in this behalf, do hereby, with the concurrence of the Minister for Justice, make the annexed Rules of Court. Haughey Minister for Justice CIRCUIT COURT RULES (No. 2), 1962 These Rules, which may be cited as the Circuit Court Rules (No. 2), 1962, shall come into operation on the 2nd day of October, 1962. The Order referred to in these Rules as being revoked is the Order contained in the Circuit Court Rules, 1962 ( S. I. No. 84 of 1962 ). ORDER 4 This Order is hereby revoked and the following Order is substituted therefor :—
(1)Until December 31st, 1962, the Court shall use in each Circuit the Seal which had been in use prior to October 1st, 1962. Such Seal shall be placed and retained in the custody of the County Registrar. It shall not be necessary that any Decree, Order, Warrant or other document, shall be signed by the Judge, but all such documents shall be authenticated by the Seal of the Court impressed thereon and the signature of the County Registrar.
(2)As and from January 1st, 1963, the Court shall have for use in each County an embossing Seal with an appropriate inscription, as directed by the Minister, specifying the name of the Circuit in connection with which it is to be used. Such Seal shall be placed and retained in the custody of the County Registrar. It shall not be necessary that any Decree, Order, Warrant or other document, shall be signed by the Judge, but all such documents shall be authenticated by the Seal of the Court impressed thereon and the signature of the County Registrar. EXPLANATORY NOTE The effect of these Rules is to postpone until the 1st January, 1963, the introduction of the revised form of seal for the Circuit Court ordered by the Circuit Court Rules, 1962 ( S. I. No. 84 of 1962 ) and to authorise the continued use of the present seal until that date.
