S.I. No. 249/1963 - Agricultural Wages (Minimum Rates) Order, 1963.

(1)This Order may be cited as the Agricultural Wages (Minimum Rates) Order, 1963.

(2)Save in respect of the provisions relating to the Eighth Schedule hereto this Order shall come into operation on the 30th day of December, 1963, and the provisions relating to the Eighth Schedule shall come into operation on the 1st day of June, 1964. 2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. 3. In this Order— the word "summer" means the period commencing on the 1st day of March in any year and terminating on the 30th day of September in that year; the word "winter" means the period commencing on the 1st day of October in any year and terminating on the last day of February in the next succeeding year; the word "week" means any period of seven consecutive days; the expression "weekly half-holiday" means a half-holiday under the Agricultural Workers (Weekly Half-Holidays) Act, 1952 . 4. The minimum rates of wages in respect of each wages district specified in the first column of the First Schedule and Eighth Schedule hereto shall be the rates set out in the Schedule or Schedules mentioned in the fourth column of the said First Schedule and Eighth Schedule opposite to the mention in such first column of such wages district and in the application of such rates to such wages district the following provisions shall have effect— (

1. a)where in the third column of the First Schedule and Eighth Schedule hereto the whole of a wages district is mentioned as the scope of application of the minimum rates of wages fixed in respect of such wages district by this Order, such rates shall apply to such wages district universally, (
2. b)where in the third column of the First Schedule and Eighth Schedule hereto special parts of a wages district are mentioned as the scope of application of the minimum rates of wages fixed in respect of such wages district by this Order, the rates of wages set out in the Schedule mentioned in the fourth column of such First Schedule and such Eighth Schedule opposite to the mention of each of such special parts shall apply to each of such special parts respectively, (
3. c)the rates of wages specified in any Schedule made applicable under this Order to a wages district, or to a special part of a wages district, shall in such wages district, or special part of a wages district, be payable in respect of the special classes of workers mentioned in the first column of such Schedule. 5. In its application to the Agricultural Wages Districts consisting of the Administrative County of Carlow, the County Borough of Cork and the Administrative County of Cork, the Administrative County of Kilkenny, the County Borough of Limerick and the Administrative County of Limerick, the Administrative County of the North Riding of Tipperary, the Administrative County of the South Riding of Tipperary, the Administrative County of Wexford, and the Administrative County of Wicklow, this Order shall have the further effect that as from the 1st day of June, 1964, the Eighth Schedule to this Order shall be substituted for the First Schedule to this Order in respect of those Agricultural Wages Districts. 6. Where the minimum rates of wages set out in the Second, Third or Fourth Schedule hereto are made applicable by this Order to any wages district or to any special part of a wages district, and any agricultural employer in such wages district or special part provides any agricultural worker in his employment with all or any of the benefits or advantages specified in the first column of the Fifth Schedule hereto, such benefits or advantages shall, for the purpose of computing the wages paid to such agricultural worker, be reckoned as payment of wages in lieu of payment in cash, and the value at which any such benefit or advantage so provided is to be so reckoned shall be that indicated in respect thereof in the said Fifth Schedule. 7. Where for any district a rate of wages (hereinafter referred to as the summer rate) is fixed by this Order in respect of work done by an agricultural worker in summer and a different rate (hereinafter referred to as the winter rate) is fixed by this Order as the rate of wages in respect of work done by such agricultural worker in winter, then for the purpose of calculating the amount of any sum payable as wages to such agricultural worker for work done partly in summer and partly in winter, the summer rate shall be the rate of wages for so much of such work as may be done in summer, and the winter rate shall be the rate of wages for so much of such work as may be done in winter. 8. Where an agricultural worker for whom an overtime rate is prescribed by this Order is allowed a holiday under the Agricultural Workers (Holidays) Acts, 1950 to 1961, he shall be regarded as having completed nine hours' work on that holiday for the purpose of computing the wages, if any, payable to him for overtime in the week in which the holiday is allowed. 9. For the purpose of computing the wages payable to a worker who, by his contract of employment, is allowed a holiday on St. Patrick's Day or on Christmas Day in respect of the week in which St. Patrick's Day or Christmas Day (as the case may
4. be)falls, notwithstanding that he does not or is not required to work on such holiday, he shall be regarded as having completed 9 hours work on such day; and (
5. a)he shall be entitled to wages in respect of such week at the same rate per week or per hour as he would be entitled to if the said St. Patrick's Day or Christmas Day fell on the Sunday of that week, and (
6. b)for work (if any) done by such worker on St. Patrick's Day or on Christmas Day he shall be entitled to wages at the rate per hour payable in respect of work done on a Sunday in addition to the wages under paragraph (

The effect of this Order is (I) to increase the minimum rates of wages payable to male agricultural workers in all counties and to femal agricultural workers in counties Dublin and Kildare, who are 16 years of age and over; (II) to fix minimum rates oÍ wages for male agricultural workers of 14 to 16 years in all counties and for female agricultural workers of 14 to 16 years in Counties Dublin and Kildare; (III) to make provision whereby agricultural workers entitled to St. Patrick's Day and Christmas Day as holidays with pay under their contracts of employment become entitled to receive payment at not less than minimum Sunday rates for work done on those days; (IV) to apply, as from 1st June, 1964, the rates in the Third Schedule of the Order to Counties Carlow, Kilkenny, Limerick, Tipperary (North and South Ridings), Wexford, the eastern part of County Cork (as defined under reference 2 in the Eighth Schedule to the Order), and part of County Wicklow comprising the District Electoral Divisions of Ballybeg, Kilpipe, Tinahely, Cronelea, Killinure, Rath, Money, Aghowle, Shillelagh, Coolattin, Coolboy, Carnew and Ballingate. (The rates in the Fourth Schedule apply to these areas up to 1st June, 1964).
