No. 103/1964 - Córas Iompair Éireann (Members) Superannuation Scheme, 1960 (Amendment) Scheme, 1964. AmendmentsLeasuithe I, ERSKINE H. CHILDERS, Minister for Transport and Power, in exercise of the powers conferred on me by section 2 of the Transport Act, 1959 (No. 31 of 1959), with the consent of the Minister for Finance, hereby make the following scheme : 1. This Scheme may be cited as the Córas Iompair Éireann (Members) Superannuation Scheme, 1960 (Amendment) Scheme, 1964. 2. In this Scheme " the Principal Scheme " means the Córas Iompair Éireann (Members) Superannuation Scheme, 1960 ( S.I. No. 139 of 1960 ). 3. This Scheme shall be construed as one with the Principal Scheme. 4. The Principal Scheme is hereby amended by the substitution of the following Article for Article 5 :— " 5. For the purposes of this Scheme, the retiring salary of a person to whom this Scheme applies shall— (
4. a)in the case of a person who has three years or more of pensionable service as a member of the Board and whose salary has not, otherwise than with the concurrence of the Minister and the Minister for Finance, been altered during the period of three years ending on the date on which his pensionable service ceased, be taken to be his yearly salary at the date of cesser of his pensionable service, and (
5. b)in any other case, be taken to be his average yearly salary during the last three years of his pensionable service." GIVEN under my Official Seal, this 27th day of April, 1964. This instrument amends the Córas Iompair Éireann (Members) Superannuation Scheme, 1960 ( S.I. No. 139 of 1960 ) by re-defining retiring salary for the purposes of that scheme.
