COPYRIGHT (PUBLICATION OF CERTAIN WORKS) REGULATIONS, 1964. I, JOHN LYNCH, Minister for Industry and Commerce, in exercise of the powers conferred on me by subsection
(6)of section 12 of the Copyright Act, 1963 (No. 10 of 1963), hereby make the following regulations: 1.—
(1)These Regulations may be cited as the Copyright (Publication of Certain Works) Regulations, 1964.
(2)These Regulations shall come into operation on the 1st day of October, 1964. 2. In these Regulations "work" means a literary, dramatic or musical work— (
- a)in which copyright subsists, (
- b)which has not been published, (
- c)the manuscript or a copy of which is kept in a library, museum or other institution where (subject to any provisions regulating the institution in question) it is open to inspection, (
- d)which was made or completed not less than one hundred years previously, and (
- e)the author of which died not less than fifty years before the previous 31st day of December. 3. A person shall not publish a work— (
- a)if the identity of the owner of the copyright in the work is known to the person, without obtaining the consent of the owner, and (
- b)if the identity of the owner of the copyright in the work is not known to the person, without publishing, at least two months before the publication of the work, in two daily newspapers published and printed in the State a notice stating his intention to publish the work and containing the following— (
- i)the name and address of the person intending to publish the work, (
- ii)the title (if any) of the work, a brief description of it and the date or estimated date on which it was made, (iii) the name of the author of the work if it is known to the person intending to publish it, (
- iv)the name and address of the library, museum or other institution in which the manuscript or a copy of the work is kept, (
- v)the name of the person from whom the library, museum or institution aforesaid acquired the manuscript or copy or, if after reasonable inquiries, the name cannot be ascertained, a statement to that effect, (
- vi)an invitation to any person claiming to be the owner of the copyright in the work to give notice of his claim to the person intending to publish the work. 4. Where a person intends to publish a work, he shall notify the library, museum or other institution in which the manuscript or a copy of the work is kept of such intention. These regulations prescribe the conditions under which certain old copyright manuscripts may be published.
