No. 47 of 1966. ROAD TRAFFIC (LICENSING OF DRIVERS) (AMENDMENT) REGULATIONS, 1966. The Minister for Local Government in exercise of the powers conferred on him by sections 5 , 33 , 34 , 35 and 42 of the Road Traffic Act, 1961 (No. 24 of 1961) hereby makes the following Regulations :— 1. These Regulations may be cited as the Road Traffic (Licensing of Drivers) (Amendment) Regulations, 1966. 2. These Regulations and the Road Traffic (Licensing of Drivers) Regulations, 1964 ( S.I. No. 29 of 1964 ) shall be construed as one and may be cited together as the Road Traffic (Licensing of Drivers) Regulations, 1964 and 1966. 3. In these Regulations the " Principal Regulations " means the Road Traffic (Licensing of Drivers) Regulations, 1964. 4. Sub-article

(5)of article 19 of the Principal Regulations is hereby amended by the insertion in sub-paragraph (
  1. i)of paragraph (
  2. a)after the words " Class B " of the words " or Class G ". 5. Article 21 of the Principal Regulations is hereby amended by the substitution for sub-article
(1)of the following sub-article— "
(1)Subject to the provisions of sub-article
(2)of this article a person shall not apply for a provisional licence where, within the period of two years preceding the commencement day, he has held two or more provisional licences (other than a provisional licence which has been surrendered pursuant to sub-article (7A) of article 22 of the Principal Regulations) unless during the period for which the last such licence was granted to him he made an application for a certificate of competency." 6. (4)of article 21 and sub-article
(2)of article 30 of the Principal Regulations are hereby revoked. 7.
(1)Article 22 of the Principal Regulations is hereby amended by the insertion after sub-article
(7)of that article of the following sub-articles :— " (7A) An applicant for a provisional licence, who at the time of application is the holder of a provisional licence, shall surrender that licence to the licensing authority where the commencement day of the licence applied for is the day on which it is granted. (7B) Where, in pursuance of sub-article (7A) of this article, a provisional licence is surrendered to a licensing authority the licensee may apply to such licensing authority for a repayment in respect of the fee paid by him on taking out that provisional licence and the licensing authority may make such repayment. (7C) A repayment under sub-article (7B) of this article shall be made at the rate of three shillings for each complete month of the licence period which remains unexpired at the date of surrender of the provisional licence. "

(4)of article 22 of the Principal Regulations is hereby amended by the addition thereto of the words " except where he is applying for a provisional licence in respect of vehicles of a class which he is not then licensed to drive."

(8)of article 22 of the Principal Regulations is hereby amended by the insertion after the words " sub-article
(5)" of the words " and sub-article (7A) ". 8. Article 27 of the Principal Regulations is hereby amended by the insertion after sub-article
(2)of the following sub-articles :— "
(3)Where a person does not submit to a test for a certificate of competency arranged pursuant to an application made by him and the fee paid by him in respect of such application is not refunded he shall, before submitting to a test for such a certificate, make a fresh application for a certificate unless— (
  1. a)not later than three days before the date arranged for the test he notifies the issuing authority of his decision not to submit to the test, or (
  2. b)the issuing authority is satisfied that the applicant had adequate reason for not undergoing the test. " 9.
(1)Part III of the First Schedule to the Principal Regulations is hereby amended by the insertion in paragraph 1 of Page 2 of the form set out in the said Part III after the words " Class B " of the words " or Class G ".
(2)The First Schedule to the Principal Regulations is hereby amended by the substitution for Part VIII and Part X thereof of Part A and Part B respectively of the Schedule to these Regulations. These Regulations amend the Road Traffic (Licensing of Drivers) Regulations, 1964 so as to provide— (
  4. i)that the holder of a provisional licence may surrender that licence during its currency and take out a new provisional licence for a different or additional class of vehicle. Ancillary amendments cover refunds of duty paid on surrendered licences : (
  5. ii)that the holder of a provisional licence for Class G vehicles will be subject to the same provisions as those applying to holders of licences for other " one seater " vehicles : (iii) for the revocation of the provision determining a prescribed waiting period between failure in a test of competency and application for a further test : (
  6. iv)for the making of fresh applications for certificates of Competency in cases where the applicants, without good reason, fail to attend for tests at the times appointed, and (
  7. v)for revised and simplified forms of application for certificates.
